HomeMy WebLinkAboutResolution 7686 Approving Hidden Fox Hill PlatCITY OF ORONO RESOLUTION OF THE CITY COUNCIL yFy l No.7686 A RESOLUTION APPROVING THE PLAT OF HIDDEN FOX HILL FILE NO. LA26-000012 WHEREAS, the City of Orono (hereinafter the "City") is a municipal corporation organized and existing under the laws of the State of Minnesota; and WHEREAS, the City Council of the City of Orono (hereinafter "City Council") has adopted subdivision and land development regulations for the orderly, economic, and safe development of land within the City; and WHEREAS, Price Homes, is the Owner of the property addressed 2420 Fox Street and legally described as Lot 12, Auditor's Subdivision No. 229, Hennepin County, Minnesota (the "Property"); WHEREAS on October 22, 2025, the Developer applied for Preliminary Plat approval to subdivide the Property into two (2) buildable lots. WHEREAS, at its regular meeting on February 9, 2026, the Orono City Council approved the Preliminary Plat (LA25-000050) per the findings and conditions of Resolution 7662, approved by a 5 to 0 vote; and WHEREAS, on March 16, 2026, the Owner applied for final plat approval. The final plat application was deemed to be substantially complete on June 1, 2026, and WHEREAS, the Owner has agreed to comply with all conditions of Resolution 7662 and has completed or has agreed to complete all other requirements of the platting regulations of the City. NOW, THEREFORE, BE IT RESOLVED, based upon the findings of Resolution 7662, the Orono City Council does hereby approve the plat of HIDDEN FOX HILL, Hennepin County, Minnesota (a copy of which is attached as Exhibit A), subject to the following conditions: 1) Development within HIDDEN FOX HILL is subject to the Conclusions, Orders, and Conditions enumerated within Preliminary Plat Resolution 7662 dated February 9, 2026. 2) Dedication on the plat of the perimeter Drainage and Utility Easements as required in Resolution 7662. £ESH CITY OF ORONO RESOLUTION OF THE CITY COUNCIL NO.7686 3) Submittal of the Executed Shared Driveway Agreement for the shared access to be located on Outlot A for the benefit of both proposed lots. 4) The approvals granted in this Resolution shall become effective only when all conditions of approval requiring actions by the Developer have been satisfied. 5) Minnehaha Creek Watershed District (MCWD)-approved permits for the grading, stormwater management facilities, storm water pollution prevention plan (SWPPP) and erosion control plan shall be submitted at the time of development in the subdivision. 6) A title opinion for the Property and certified copies of all recorded easements currently affecting the Property have been submitted. 7) The Property will be served by private wells and septic systems. 8) Payment of Development Fees Required (2026 fee schedule): Total: $28,149.29 a. Final Plat application fee: $800.00. b. Final Plat application escrow: $2,500.00 c. Park Dedication Fee: $16,789.29. d. Stormwater and Drainage Trunk Fee: $8,060.00. 9) The City Clerk shall release the plat documents for filing only upon certification by the City Attorney, Community Development Director, and City Engineer that all requirements of the platting regulations have been satisfied. 10) According to City Code Section 6.20.520, the aforesaid plat shall be filed by the City of Orono with Hennepin County within one year of Council approval (on or before June 8, 2027), together with a certified original copy of this resolution and executed copies of the easements and covenants pertinent thereto. Violation of or non-compliance with any of the terms and conditions of this resolution may result in the termination of any authority granted herein.
