Each lot ibutts a public road and will sharp a common access over the existing private driveway. Lot B will provide a drive- way and utilities easement in favor of Lot A if necessary. A park fee of $440.00 will be required for the newly crested lot. My only concern is with the triangular shaped lot. To maintain the required 100' of width along a 100' deems building line, the shiared lot line must be moved further north as noted or ,xhibit 3. The proposed setbacks for the new lot conform with the LR-lC zoning district standards. A public hearing will be scheduled for June 15, 1981. Mabusth DATE: June 10, 1981 SUBJECT: #614 David Myhre, 2590 Casco Point Road - Preliminary Subdivision Staff Update The applicant's surveyo- has asked the Planning Commission to reconsider their request to move the lot line further north to allow for an increase in the depth along the required building line width of 100'. He notes the access road and topography will determine the only building site. At the referenced building site there is approximately 115' of width. In the given lot configuration lot B maintains a 100' width for a 45' depth. Your recommendation of approval should refer to either the current survey dated April 27, 1981, or a revised plan re- flecting the lot line change 'based on the following findings: 1) The newly created lot and the remaining homestead lot meet all the standards of the LR-lC zoning district. 2) Adequate sewer and water service for site and stubs available for hook up. and subject to the f^llowing conditions 1) Access to both lots shall be via the existing drive- way - no direct access onto Casco Point Road 2) Lot A must grant an access and utilities easement in favor of Lot B. 3) Lot B is non riparian to Lake Minnetonka. They are working with the City of Orono to subdivide property on Cosco Point and move and modify the annex to become their home. Grace Baptist would appreciate all that the City of Orono could do to, in a businesslike way, expedite the move; particularly if the building permits could be issued at the same time as subdivision approval. AVID MYHKE Mabusth noted the certificate of mailing and the affidavit 2590 Casco Pt. Rd. of publication. Mr. Paul Kaster of 2600 Casco Point Road, Subdivision was also present. David Myhre presented a topographical 4614 map of the new created lot showing the new house location. 7:45-7:50 The new house would appear to be positioned on the lot line. Planning Commission advised the applicant that a realignment of the lot line was necessary so that the re- quired 10 ft. side yard setback was met. Applicant was ddvised that the property would be suhject to lakeshore hardcover regulations of the LR-IC zoning district. ERICSON for the record that there was a sink in the subject assessory 1620 Shadywood Rd. structure that was draining into the yard and that it is Conditional Use necessary to correct this condition. Permit 0622 Jabbour noted that the assessed value was under $3,000 and by right this should have been removed by 1978. Structures like this, he noted, are allowed the normal amount of maintenance to keep the building safe but this kind of repair involves major structural repair. This is not consistent with the City's policy on non -conforming structures, and the City has dealt with similar problems in other Conditional Use Permits and this body has always been consistent in this interpretation of policy. Adams noted that this building consists of 250 sy ft. of area and according to the fair market value of the struc- ture it should have been removed by now.
