Mr. Myhre proposes a plat of two lots. Each lot ibutts
a public road and will sharp a common access over the
existing private driveway. Lot B will provide a drive-
way and utilities easement in favor of Lot A if necessary.
A park fee of $440.00 will be required for the newly
crested lot.
My only concern is with the triangular shaped lot. To
maintain the required 100' of width along a 100' deems
building line, the shiared lot line must be moved further
north as noted or ,xhibit 3.
The proposed setbacks for the new lot conform with the
LR-lC zoning district standards.
A public hearing will be scheduled for June 15, 1981.

Preliminary Subdivision
Staff Update
The applicant's surveyo- has asked the Planning Commission
to reconsider their request to move the lot line further
north to allow for an increase in the depth along the
required building line width of 100'. He notes the access
road and topography will determine the only building site.
At the referenced building site there is approximately 115'
of width. In the given lot configuration lot B maintains
a 100' width for a 45' depth.
Your recommendation of approval should refer to either the
current survey dated April 27, 1981, or a revised plan re-
flecting the lot line change 'based on the following findings:
1) The newly created lot and the remaining homestead lot
meet all the standards of the LR-lC zoning district.
2) Adequate sewer and water service for site and stubs
available for hook up.

1) Access to both lots shall be via the existing drive-
way - no direct access onto Casco Point Road
2) Lot A must grant an access and utilities easement in
favor of Lot B.
3) Lot B is non riparian to Lake Minnetonka. City will
not approve nor recognize in the future an access ease-
ment to the lake via Lot A or any abutting lakeshore
property.
4) All new construction and improvements _)n the site will
be limited to the hardcover allowance of 25% within the
75' - 250' setback area and 30% within the 250' - 500'

5) Before a building permit can be issued the City staff
will review all proposed filling of the Site along Casco
Point Road for adequate sizing of culvert and approved

June 15, 1981
Grace Baptist Church has a sell/purchase agreement with David
and Constance Myhre to move the Church annex (old parsonage)
off the corner of County Road 19 and County Road 15. They are
working with the City of Orono to subdivide property on Cosco
Point and move and modify the annex to become their home.
Grace Baptist would appreciate all that the City of Orono could
do to, in a businesslike way, expedite the move; particularly
if the building permits could be issued at the same time as
subdivision approval.
The annex at prest-nt is too close to Co. Rd. 19 and certainly
would not be permitted in this location.

6) Developer to submit copy of proposed Homeowners As-
sociation Articles of Incorporation by laws and pro-
tective covenants provicing for common ownership and
maintenance of pond and walking outlots.
7) Enter into a Subdivider's Agreement (to be completed
before improvement construction begins) to include
construction cost estimate, commencement and completion
date estimates, performance bond or letter of credit
and warrantee bond.
8) Payment of the following fees:
1 - Park Dedication fee - 3.14 per/acre = $1,300/bldg
x 12 = 15,600.
2 - Street signing: 1 name and 1 stop sign ($75.00
each) = $150.00.
3 - Legal review fees and filing fees in the amount

Minority Opinion - Frahm - tiis position remains the same;

was to realign the plat road by shortening it 1751.
Adams moved to approve the realignment of the driveway
based on the findings that it would decrease the hard-
cover and also create less disturbance for the sensitive
land peninsula.

line. Planning Commission advised the applicant that a
realignment of the lot line was necessary so that the re-

Jabbour noted that the assessed value was under $3,000
and by right this should have been removed by 1978.
Structures like this, he noted, are allowed the normal
amount of maintenance to keep the building safe but this
kind of repair involves major structural repair. This is
not consistent with the City's policy on non -conforming
structures, and the City has dealt with similar problems
in other Conditional Use Permits and this body has
always been consistent in this interpretation of policy.
Adams noted that this building consists of 250 sy ft. of
area and according to the fair market value of the struc-
ture it should have been removed by now.
Goetten roted that this is definately major structural
repair and not maintenance repair.

Mr. Myhre proposes a 2 lot plat of the Stephen Woodrich property
located off Casco Point Road. Each lot abutts the public road.
The existing driveway to the Woodrich residence will also serve
the newly created lot. The public works department advises
there is adequate sewer and water service available for Lot B.
Lot B has service slope problems along Casco Point Road and
to the south of the lot. The 28,900 sf within Lot B has pro-
vided adequate area for the location of a site for a new
residence.
Please review the Planning Commission minutes of May 18, 1981,
and June 15, 1981, for background and recommendation.
The Planning Commission approved the following staff recommen-
dation: To approve the two lot plat subdivision application
of David Myhre as proposed on the survey doted April 27, 1981,
by Gordon Coffin based on the following findings:
1) The newly created lot and the remaining homestead lot
meet all the standards of the LR-lC zoning district.
2) Adequate sewer and water service for site, stubs available
for hook up.

1) Access to both lots shall be via the existing driveway -
no direa± access onto Casco Point Road
t) Lot B must grant an access and utilities easement in favor
of Lot A.
3) Lot B is non riparian to Lake Minnetonka. City will

be limited to the hardcover allowance of 25% within the

Staff recommends approval of this final plat per the attached
resolution. All conditions of preliminary approval have been
met. Private easement will be filed for the driveway and
utilities.
At the last minute, a problem surfaced which had been overlooked
in the preliminary review. 'rhe southwest corner of Lot 2 extends
out to touch the pavement of Casco Point Road. Extra right of
way dedication should have been required for ditching, snow
removal, etc. Preferably, this should have been shown on the
plat. However, because of the late hour of this discovery,
such a change would delay Mr. Myhre through no fault of his.
For this reason, I recommend requiring and accepting a quit
claim deed to this small right of way corner, in lieu of plat
dedication. Mr. Myhre has agreed to sign such a deed.

MINUTES OF THE PLANNING COMMISSION MEETING OF OCTOBER 19, 1981
The Planning Commission met on the above date. The following ATTENDANCE
memters were present: Chairman Hammerel, Goetten, Rovegno, 7:30 PM
and McDonald. Adams arrived at 9:04 PM. Councilmember Mary
Butler was also present. Mabusth represented the City staff.
Applicant was present. Mabusth reviewed with the Planning ✓ DAVID MYHRE
Commission the final plat of Navarre Woods. The Planning 2590 Casco Point
Commission found no problems. Final Subdivision
#614
Hammerel moved to approve the final subdivision of David
Myhre subject to the findings and conditions setforth in the
staff resolution.
McDonald seconded. Vote: A, -es (4), Nays (0).
Richard Speeter was present. The Planning Commission wanted
to compare the City Engineer's comments with Mr. Gray's,
applicant's engineer, comments. Mabusth informed the Planning
Commission that there was no written comments from the City
Engineer but that she had talked to him. Mabusth reviewed
Cook's comments noting that the environmental standards of
the City would have prohibited the construction of the flume
if an adequate review had taken place. He asked to review
all the data that the applicant's engineer must have compiled
to make his recommendation. At this time he feels a more
eetailed study of the watershed and storm sewer system should
be made to afford adequate review.
Goetten asked the appl.cant what the purpose of the construc-
tion of the retaining wall was and if there was a building
permit issued?
Applicant states: that a building permit was not taken out
because he didn't know that one was required. The purpose
was to extend his back yard.
Rovegno asked the applicant if he had plated hay bales along
the shoreline yet?
Applicant stated that he had moved a pile of debris over to
protect the shoreline, but that he had not Wised had- bales.
Rovegno asked the applicant abouL the apparent tire tracks
on the cement slab?
Applicant explained that those were the tire track, of q
bobcat he had rented to lick up six cement slabs near ;i i s
shoreline. Applicant stated that he could or would nover
use the slab as a boat ramp.

NO. 1329
A RESOLUTION APPROVING THE PLAT
OF NAVARRE WOODS
WHEREAS, the City of Orono is a municipal corporation
organized and oxisting under the laws of the State of Minnesota; and
WHERLAS, the City Council of the City of Orono has adopted
subdivision regulations for the orderly, economic and safe development
of land within the City; and
WHEREAS, the City Council has considered the application for
a subdivision plat by David Myhre, Steven and Jean Woodrich, the
subdividers; and
WHEREAS, the subdivision has been approved as meeting all
standards of the LR-IC :tonin , 6istrict finding that each lot is of a
size and configuration that will allow its use as a single family
residence to be located without the need of any setback variances; and
WHEREAS, the subdividers have completed all requirements of
the platting regulations of the City, including:
Payment to the City of a Park Dedication Afee in the
amount of $440.00.
Payment to the City for legal roview and filing fees
in the amount of $75.00.
NOW, THEREFORE BE IT RESOLVED that the City Council of the
City of Orono hereby approves the plat of NAVARRF WOODS, Hennepin
County, Minnesota; subject to.the following conditions:
1) Granting of a quit claim deed to the Cite for
public road purposes over the southwest corner
of Lot 2, as legally described in said deed.
2) Lot1',Block 1 is riparian to Lake Minnetonka.
3) Lot 2, block 1 is not riparian to Lake Minnetonk
and shall be without dockage or access rights to
use of the shoreline in this plat.
4) The City Council does hereby approve joint use of
the existing driveway for ingress, ertress and access
to both lo*s, s►ibject to the recording of a private
driveway and access easement between the parties.
Nothir.q in this approval shall prevent the future
,levelopment or usC )f in._iivioual driveways provided
they are located and built in ronformace with all
applicable ordinances and re qulations.

require, continuance of sewer service for Lot 1
over,--ndr.r and across Lot 2. Such approval

Sewer service for both lots shall be by means of
seiarac-2 lines. All costs for connection,
reconnection, shall be borne by the property
owners and not by the City.

of Orono with the Hennepin County Recorder's
Office together -,,ith a certified original copy
of this Resolution.

(Utility and Sewer)
THIS INSTRUMENT, made as of the day of October,
1981, by and between David A. Myhre and Constance W. Myhre, hus-
band and wife, parties of the first part ("Grantors"), and
Stephen Brown Woodrich and Jean Hayes Woodrich, husban.' and wife,
parties of the second part ("Grantees").
WHEREAS, Grantors are the fee owners of the following
described land situated in Hennepin County, Minnesota,tu-wit:
Lot 2, Block 1, Navarre Woods, Hennepin County,
Minnesota; and
WHEREAS, the Grantees are the fee owners of the following
described land situated in Hennepin County, Minnesota, to -wit:
Lot 1, Block 1, Navarre Woods, Hennepin Count,•,

WHEREAS, the Grantees wish to acquire from the Orantors a
permanent easement for utility and sewer service over and across
the land of the Grantors as hereinafter described, and Grantors
for good and valuable consideration, wish to grant such an easement
to Grantees;

operate, maintain, alter, replace and remove sewer and utility

East to the Northeasterly line of said lot, and there

reference and made a part hereof, subject to the terms and condi-
tions set forth herein, to -wit:
1. Grantors shall be responsible for the initial construc-
tion and placement of the sewer and utility pipelines and trans-
mission service within the Easement Premises and Grantees shall
not be financially responsible or liable for the cost of such
installation and restoration of the Easement Premises.
2. Upon completion of initial installation and restoration
of the Easement Premises, Grantees shall, at their expense, maintain,
repair and replace all sewer pipelines, utility transmission service
or ether such improvements constructed or placed upon the Easement
Premises. Such maintenance, repairs or replacements shall be made
promptly by the Grantees and the Easement Premises restored, as
nearly as possible, to the original condition existing prior to
such work at Grantees' sole expense.
3. Grantees shall defend, hold harmless and indemnify

The enforcement of any terms and conditions hereof shall be by a
proceeding at law or an equity against any person or persons
violating or attempting to violate any of them either to restrain
violation or compel compliance, or to recover damages. Failure of
any person to enforce any of the terms or conditions hereof shall
not be deemed a waiver of the right to do so thereafter. Attorneys'

fees and costs of any action to restrain violation, compel compliance
or recover damages as determined by the Court having jurisdiction
thereof, shall be assessable against and payable by any such
person so restrained or compelled or required to pay damages.
6. This easement shall be binding upon and inure to the
benefit of the Grantors and Grantees, their personal representatives,
successors and assigns.

THIS INDENTURE, made this 28th day of October , 19 81,
by and between David A. Myhre and -Constance W. Myhre, usbancT-
and wife,
hereinafter referred to as "Grantor(s)", and the City of Orono, a
municipal corporation, under the laws of the State of Minnesota,
hereinafter referred to as "Grantee".
WiTNESSETH, that Grantor(s), in consideration of the sum of
One Dollar ($1.00) and for other good and valuable consideration
given by Grantee, the receipt of which is acknowledged by
Grantor(s), do(es) hereby grant, bargain, sell and convey to
Grantee, its successors and assigns, an easement for public
ingress, egress, access, road and utilities purposes and uses, on,
across and under the land in the County of Hennepin and State of
Minnesota as follows:

West of the following -described line: Commencing
at the Southw^_st corner of said lot; thence East
on the South line of said lot a distance of 14.28
feet to the point of beginning of the line being
described; thence deflecting left 68039' to the
Northwesterly line of said lot, and there ending.
including, but not by way of limitation, a full and free right and
authority to enter upon said land to construct, install, maintain,
operate and repair a roadway, shoulaers, driinage ditches, a
sanitary sewer lift station, sanitary sewer interceptor, sanitary
sewer main or line, water line, ano any and all appurtenances
incidental and related thereto, (such are hereafter collectively
referred to as the Improvement), and the Grantee shall have the
right to make such use of said land as is reasonably necessary and
advisable to the construction, installation, maintenance,
operation and repair of the Improvement.
In addition to any other remedy the Grantee may have, the
covenants and restrictions contained herein may be enforced by
injunction.
TO HAVE AND TO HOLD said easement unto said Grantee, its
successors and assigns, permanently.
The Grantor(s) herein certify that the lands herein
described are free and clear of all encumbrances except:
