The addition would conform to the existing dwelling (also two story). The proposed addition would meet the side yard setback requirement of this district as it would be 16.8 feet from the side lot line. The existing house and proposed addition meet the shoreline setback requirement of 75' as shown on the enclosed survey. Lakeshore setback is 89.81. The lot area is 22,187 sq. ft. snd meets the 1/2 acre lot area requirement. The lot is 62.5 feet wide - 100 ft. is required so a variance of 3'.5 ft. is necessary. The location of the existing house is S' from the northeast side lot line and lacks S' from required 101. The proposed addition, however, is on the opposite side so the proposed addition has no effect on the required setbacks. I would recommend waiving the customary work session review so we can expedite the proposal. I recommend approval of the variances as the proposed addition itself would not encroach on any of the required setbacks in this district. MINUTES OF A PLANNING (a1MISSION FETING HELD DECEMBER 20, 1976 SAGE 6 Hank Muhich presented mylars and final plat. Preliminary JAMIES SIDIVELL approval was granted several months ago. Some of the 1375 PARK DRIVE Commission Members felt that preliminary approval should SUBDIVISION (FINAL) not have been granted as approval was based on the 800 (#120) area requirement which is used for variances of existing parcels and should not be applied to new subdivisions. Mr. Sidwell was present. He stated that they had the understanding that preliminary approval by the Council assured them of final approval. They then proceeded with the expense of obtaining mylars and hardshells. After some discussion, Pesek moved, Dunlap seconded, to deny and recommended that prelininary approval be reversed as the 80% area requirement is used for variances of existing parcels and not in new subdivisions. Motion - Ayes (2) Pesek, Dunlap, Nays (3) Hosfield, ?1cDonald, Woolley, Abstain (1) Hannah. Motion failed. Woolley then moved, Hosfield seconded, to recommend final approval on t;ie basis that lots are consistent with the neighborhood, applicant was led to believe that preliminary approval assured final approval and went to additional time and expense of mylars and hardshells, assessed two sewer charges, subject to Park Dedication Fee of $2,000 and engineer's approval of house location and drainage plans. Motion - Ayes (3) Woolley, Hosfield, McDonald, Nays (2) Pesek, Dunlap, Abstain (1) Hannah. The Planning Commission took action on the following Work Session items: Hank Muhich explained that the applicant is requesting D. C. Justifications: 1. No more land available. 2. Proposed addition would not encroach on setback requirements. 3. Subject lot is larger than lots on either side. Butler moved, tiassengale seconded, to approve the variance request of Thomas Frahm, 2520 Casco point Road, per the Planning Commission Minutes of December 20, 1976. Motion, Ayes (4) - Nays (0). Her Iluhich, Building & Zoning Administrator, VARIANCE stated that at the Planning Commission meeting 1165 West Ferndale Roa of December 20, 1976, the Planning Commission #214 recommanded approval for the variance request gordon Ritz of Gordon Ritz, 1165 West Ferndale. Justifications: 1. Proposed second story addition would not add to existing hardcover area. 2. Proposed second story addition would be a;ove 29' X 24' garage wing which is located the greatest distance from all lot lines and lakeshore. A►:plicant was also informed that the adjoining land to the east is a platted riqht of way. They suggested he and Woodhill Country club apply for vacation of right of way. (Continued)
