Staff issued a stop work order advising owner to contact staff immediately and obtain the necessary permits. Cloutier had constructed a retaining wall approximately 30 high dividing a sandy beach and the grassed area. A pile of fill was placed along the lakeshore. Owner explained the proposed work was to protect an existing sand beach from the eroding grassed bank to the immediate rear. The pile of fill consisted of portions of soil released by the cutting into the bank and the sand from the beach area. This pile has been removed and hay bales installed along the lakeshore. Staff issued a citation the following day in consideration of Cloutier's conditional use permit application reviewed earlier that year. We concurred that this applicant was aware of the ordinances that deal with lakeshore improvements. #674 Cortlen Cloutier Page 2 Conditional Use Permit & Variance I have enclosed a copy of the denial resolution for that earlier application (Exhibit F). Briefly, Cloutier filed an after the fact application with the City to permit a guest home use of a non conforming boat house structure that had sustained several improvements without the benefit of building permits. As the resolution states, Cloutier was to remove the second story of the boat house by September 9, 1981, and cap it off with an originally authorized deck. Cloutier has pleaded not guilty to the citation issued on July 17, 1982 and a trial has been scheduled for Miy 11, 1982. During these many months of discussion, the resolution of the boat house and the pending application for the lakeshore improvements have been linked together. The attorney and staff have encouraged this course of action (Exhibit F). Review of Current Proposal Cloutier has advised that the plans enclosed for this review were drafted by an over ambitious draftsman. I have designated the proposed improvements on Exhibit G; Cloutier reviews than as follows: 1 - Remo✓al of second story of boat house structure and capping with deck. 2 - Rip rap of shoreline - rip rap to be continued up to each edge of the existing retaining wall. 3 - Construction of access stairs - stairs to be buil, according to recommendations of City staff not as sketched on site plan. Stairs need not run to the shoreline but may stop 20' to 30' from the shoreline. 4 - Grass sitting area - applicant claims this will involve cutting into a Dank and may require some physical structure to prevent the bank from eroding to the rear and along the front. Amount of fill to be removed and the actual size of the sitting area. b) Proposed method co support disturbed banks - if retaining walls then sections of walls arc needed for review by City Enqineer. #674 Cortlen Cloutier Page Conditional Use Permit & Variance Staff Recommendation To approve an after the fact application for Cortlen Cloutier consisting of a conditional use permit and hardcover and setback variances subject to the following conditions: 1 - Retaining wall may remain because of the greater environmental harm done if removed. The north section of the retaining wall may be continued along the disturbed section of the bank for 6' to 8' providing the required support. 2 - Access stairs to be constructed down the lakeshore bank - not to run to the lakeshore but to stop at level grade. 20' L1 30' setback from lakeshore. City Engineer to advise applicant on access stairs. 3 - Second story of boat house to be removed per Council's directive of Resolution 1254. Applicant must obtain the necessary permits. 4 - Applicant must obtain the necessary permits from the DNR and MCWD for rip rap of shoreline - rip rap may be placed along the outer edges of the sand beach until it connects to retaining wall. 5 - Deny the additional grass sitting area finding adequate level areas for sitting at the beach area, second story deck and top of lakeshore bank. Denial will prevent additional disturbance within 0 - 75' setback area. 6 - Restoration of all disturbed areas and placing of hay bales along the shoreline prior to reconstruction. The excavation for the band beach area has been completed and a portion of the railroad tie retaining wall has been constructed. The completion of the remaining eight foot sections of railroad tie retaining wall and the rip rap in the area of the proposed sand beach should be completed as soon as possible to minimize erosion. We ask that you refrain from any discussion of the removal of the second story of the boat house during the review of application #674. Staff has asked that a formal complaint be filed against Mr. Cloutier for failing to respond to the Council directive of Resolution 1254. It was the inclusion of the 'goat house issue in my review memo that caused Cloutier to withdraw the application at our last meeting. The original packet has been recopied for your convenience. In the staff memo dated April 12, 1982, please remove condition 3 of my recommendation (F.)age 3) and please no discussion of the boat house. BRUCE HAUGLID 2245 Bayview Place Rovegno questioned the applicant about the NSP wires Variance and advised him that this problem shou l be NSP's #684 problem and that it shouldn't be a con ideration in this application. Also he noted that NSP should have an easement over his property for those wires. Mabusth stated that there was tin c,ich PaGPment. Applicant stated that the slashed area is a proposed 12' x 24' deck. Mabusth stated that a deck is considered hardcover and that he was allowed 35% hardcover but that her calculations did not include the deck. Callahan stated that with the included deck it would bring the total hardcover to 11t ever the allowed amount. Rovegno noted that the length of the driveway was what was really eating up all the hc:..icover allowance. He noted that if they were able to move the garage closer to the street the driveway wouldn't have to be so long. Applicant stated that he wanted enouyh room to have both vehicles parallel rather than scrambling them around. Goetten stated that their main concern was with the excessive hardcover proposed. Callahan noted that the applicant wouldn't be able to put a boat and two cars into a 1 stall garage anyway. Staff issued a stop work order advising -wner to contact staff immediately and obtain the necessary permits. Cloutier had constructed a retaining wall approximately 30" high dividing a sandy beach and the grassed area. A pile of fill was placed along the lakeshore. Owner explained the proposed work was to protect an existing sand beach from the eroding grassed hank to the immediate rear. The pile of fill consisted of portions of soil released by cutting i:to the bank and the sand from theheach -area. This pile has been removed and hay bales installed ,Tong the lakeshore. Staff issued a citation the following day in consideration of Cloutier's conditional use permit application reviewed earlier that year. Cloutier pleaded not guilty to the citation issued on July 17, 1981, and a trial was scheduled for Mav 11, 1982. #674 Cortlen Page 2 Conditional Cloutier Use & Variance During these many months of discussion, the resolution of the boat house and the pending "after the fact" application for the lakeshore improvements have been linked together. The attorney and staff had encourage this approach and we were certain that Cloutier clearly understood this connection. At the first review meeting of Application #674 in April, Mr. Cloutier asked that the application be pulled from the agenda after reading my memo that placed as a condition of approval removal of the second story of the boat house. Review Exhibit P - In that court summarv, it was agreed that the two matters were to be resolved separately. The Planning Commission was asked to omit any mention of the boat house in their review on May 17, 1982. The Prosecuting Atto;ney has advised the City staff to nroceed with the criminal tagging of Cloutier on the boat house violations as opposed to a civil action. Three tags were issued on June 2, 1982, one for building code violations and two on zoning code violations. staff asks once again that we limit all discussion to the current "after the fact" application for lakeshore improvements. Review of Current Proposal The total improvement plan will consist of the followinq:(review exhibit 1) 1 - Rip rap of shoreline - rip rap to be continued up to each edge of the existing retaining wall. 2 - A 30" high timber and limestone retaining wall dividing a :•andy beach area from the grassed hanks. It appears that you have added t the plan some additional "rip rap" on both sides of the beach area and have set forth on the plan that the access stairs end at the grade level. I have no problem with the stairs, but I am concerned about the possibility of ending up with some further misunderstanding as to what is meant by "rip rap". It has always been my understandinq that rip rapping means a foundation or sustaining wall of stones thrown together without any specific order (as in deep water or on an embankment slope to prevent erosion). It has always been my desire to use lime- stone for the decorative wall around the beach area and that the limestone be laid in a somewhat orderly but random -appearing fashion 30" or less high from the ar a starting where you have designated "steps to beach" all the way around the beach area to the shoreline on the east side of the beach. The limestone that I have purchrsed for that purpose could just as easily be used for rip rapping the shoreline. It was, however, my intention to use as the rip rap for the shoreline some other round and larger stones that I have had on the property for years. I think that the con- trast of the two types of stone will enhance the appearance of the lakefront. What I am attempting to convey to you is that it is my desire to have the entire lakeshore and be,,t:I, _"Irea separated from the land with a border of stone, but that it is my desire to only "rip rap" (with stones thrown together without order) the lakeshore only. The attorney and staff had encourage this approach and we were certain that Cloutier clearlv understood this connection. At the first review meetinq of Application #674 in April, Mr. Cloutier asked that the application be pulled from the agenda after reading my memo that placed as a condition of approval removal of the second story of the boat house. Review Exhibit F -In that court summary, it was aqreed that the two matters were to be resolved separatelv. The Planning Commiaaion was asked to omit any mention of the boat house in their review on May 17, 1982. The Prosecuting Atc0:ney has advised the City staff to proceed with the criminal tagging of Cloutier on the boat house violations as opposed to a civil action. Three taqs were issued on June 2, 1982, one for building code violations and two on zoning code violations. Staff asks once again that we limit all discussion to the current "after the fact" application for lakeshore improvements.
