Mabusth July 15, 1981 #636 Audrey Ogland, 2601 Casco Point Road - Conditional Use Permit Zoning District - LR-lC Application - Work Session - Conditional Use Permit per section 34.027 - guest house Lot Area - approximately 18,000 sf required 21,780 sf Lot width - 98' required 100* The applicant seeks a conditional use permit to construct a mother-in-law, non rental unit above the existing garage. Please review the face of the application reviewing her reasons for the request. Our code classifies such use as a guest house use requiring all regular lot requirements for the guest house. The lot is under the required 1 acre of area for 2 residential units and the required lot width of 200'. The City is consistent in denying such requests when the required lot standards are not met. We can certainly understand Mrs. Ogland's problem but this clearly cannot affect our responsibility to interpret the code fairly and equally for all residents.j Plannning Commission may recommend as a compromise position the construction of a mother-in-law apartment within the prin­ cipal structure. The apartment unit would be allowed a sep­ arate kitchen and bathroom but an interior access would have to be designed through the principal residence. Apartments of this type cannot be allowed independent accesses. This type of design consideration will prevent rental of the unit when the Oglands no longer own the property. This is just a work session item, Mrs. Ogland may take the opportunity to review her situation. The application will be rescheduled for action when Mrs. Ogland determines the scope and type of application to be acted on. r MINUTES OF THE PLANNING COMMISSION MEETING OF JULY 20, 1981 Page 5 Applicant was present along with some family members. Application involves a conditional n^e permit for an apartment to be constructed above a garage. Mabusth noted in fact that this would be creating a guest house, and a guest house requires the same area and lot width as a new residence. Conditional Use Permit #636 Rovegno noted that if the mother-in-law house could be constructed in the greenhouse area thereby being attached and part of the principal structure with the required access through the principal structure that we could satisfy the code requirements. The Planning Commission reviewed the proposed 2-lot plat. All standards have been satis­ fied. Work Session Subdivision #638 ^ Mr. Lorraine Nordblom was present, two concerns for the site plan: Mabusth noted the 1 - additional stall.. 20 ft. of parking turnaround for the end LORRAINE NORDBLOM 2535 Shadywood Rd. Site Plan Review #637 2 - reconcile question of proposed access and need to r'tain a clearly defined access driveway to residential lot 3 to the road. A preliminary review done by the Hennepin County Highway Department suggested that the 24 ft. driveway easement could be relocated ong the mutual lot lines of 1 and 2. Nordblom was against this suggestion because it would be too confining in consideration of future expansion plans of the building and they may sell off one of the lots. Planning Conimission asked for more clarification concerning the question of selling off lot 2 since the office building project's parking requirements are satified by the parking stalls designated on lot 2. Jabbour stated that a condition of approval must be to combine the lots prior to the issuance of a building permit. Nordblom agreed. Mabusth September 16, 1981 SUBJECT: #636 Audrey Ogland, 2601 Casco Point Road - Conditional Use Permit Mrs. Oqland has submitted revised plans of her proposed mother- in-law apartment. The living quarters are above the garage as before with a shared access located in the greenhouse. Staff cannot approve the proposed plans in this form. Planning Commission's directions were very specific in regard to utilizing the greenhouse area for the apartment with access located within the interior (living space) of the principal structure. 4 1 have notified the applicant of this concern. It is her opinion that the Planning Commission approved a garage apartment with access via the greenhouse. The greenhouse is not an integral part of the interior floor plan of this house. I have advised her that staff could not support the application in its present form. She stated that this is the only plan feasible for her use. Mrs. Ogland is fully a\^a'e that she will bring the application before Council with a negative recommendation from staff and possibly from the Planning Commission. I have enclosed the minutes covering the review and the notification sent to the applicant after that meeting. Staff Recommendation To deny the conditional use permit application of Audrey Ogland for construction of a mother-in-law apartment at her residence at 2601 Casco Point Road based on the following findings: 1 - The proposed plan creates a separate dwelling unit. 2 - The property is substandard in area and width a) lot area required = 43,560 sf lot area existing = approximately 18,000 sf b) lot width required = 200' lot width existing = 98' 3 - Garage apartment is a "major addition" to the existing residence - total of 768 sf in area. 4 - The proposed design will encourage the rental of the unit by future owner. ■■ 1 MINUTES OF THE PLANNING COMMISSION !4EETING OF SEPTEMBER 21, 1981 Page 3 4 - Planting on the lakeshore slopes to help stability. Applicant misunderstood directions l/^VDREY OGLAND from previous meeting concerning an entryway to the pro­ posed apartment that would satisfy code. Jabbour noted for the applicant that the proposed unit is considered two separate residential units and would encourage a future owner to rent. The zoning district calls for single family units on each lot. He added that Casco Point already has problem of the similar nature. Mabusth again reviewed that there was not enough area or adequate lot width to allow for a separate guest house. Jabbour noted that they would clearly have a hardcover problem and also that this proposal was too ambitious for this size lot. Mabusth noted that the apartment above the garage con­ sisted of 780 sq ft. of area. At the applicants request Rovegno moved to table the application. Jabbour seconded. Vote: Ayes (6), Nays (0). Lloyd Sims was present for the bank. Jabbour wanted to know the hardships needed for the variance. Applicant stated it was the location of the cash window and the need for the extra lane for the overflow of traffic. Planning Commission suggested moving the cash window to the back of the bank. Applicant stated this would create traffic stack-up problems. Planning Commission stated they would need a complete site plan before they could make any determination. Jabbour moved to table the application giving the ap­ plicant time to come in with revised site plan designating all parking and traffic flow.
