Staff present: Community Development Director Laura Oakden, Planner Melanie Curtis, Planner Matt Kearny, Parks Superintendent Joe Ruthenberg, City Clerk Christine Lusian TREE PRESERVATION The Council held a work session to discuss whether the city should pursue a tree preservation ordinance and to provide direction on its scope and purpose. Staff reviewed current tree -related regulations, including conservation design requirements, protections within lake setback and bluff areas, and restrictions on clear -cutting. Discussion focused on what types of development should trigger tree preservation requirements, what trees should be protected, allowable tree removal thresholds, and how any future ordinance could be enforced. Staff presented examples from other communities and recommended a tree preservation ordinance that would apply at the time of subdivision, require a tree preservation plan, identify significant trees for protection, and establish standards for allowable tree removal and replacement. Council discussed considerations such as administration and enforcement, potential impacts on development, treatment of invasive species, and whether protections should be limited to subdivisions or applied more broadly. Council directed staff to prepare draft ordinance language and bring the topic to the Planning Commission for further review later this summer. ADJOURNMENT Work session ended at 6:00 pm. PRESENTATIONS 14. 2025 Annual Comprehensive Financial Report Presentation Following completion of the City's annual audit, Abdo's CPA -Senior Manager, Tyler See, presented the 2025 audit results to the Council. The auditors issued a clean or unmodified opinion, the best possible. The unassigned fund balance was slightly below, but very close to the City's fund balance policy of 40 percent. Both revenue and expenditure were over budget, but the general fund balance increased by 540,000. He reviewed the General Fund and special funds, as well as the City's tax rate in comparison to the surrounding area. PUBLIC COMMENTS There were no public comments. Service Recognition — Resolution 7683 Ricks recognized retiring Police Chief Correy Farniok for 30 years of service to the Orono Police Department, including 19 years as Chief. A celebration was planned for that week. Schwingler moved, Ricks seconded, to adopt Resolution 7683 extending appreciation to Correy Farniok for dedicated service to the community. VOTE: Ayes 4, Nays 0. COMMUNITY DEVELOPMENT REPORT 15. LA26-000017, 1520 Bohns Point Road, Variance The property owner requested approval for a patio expansion that was completed without prior approval. The expanded patio extends 3.3 feet farther into the required lake setback than allowed, while the retaining wall meets zoning requirements. Staff recommend denial due to its convenience rather than necessity. The Planning Commission voted 6-1 to recommend approval, noting that the project improved overall site conditions by removing other existing nonconforming hard surfaces. Commissioners also noted that the variance likely would have been approved if requested before construction, the neighboring property owner supported the project, and the retaining wall complies with code. The Council discussed the item and asked questions of staff and the applicant, Travis Van Liere, the landscape architect representing the owners. Council members expressed concerns about approving variances after work has already been completed and about allowing additional encroachments into setback areas. Schwingler moved, Ricks seconded, to direct staff to draft findings of approval for a variance for 1520 Bohns Point Road. VOTE: Ayes 3, Nays 1 (Benson). PARKSREPORT 16. Master Plan — Antoine Park The Council approved the Antoine Park Master Plan, establishing a long-term framework for future park improvements focused on accessibility, tree replacement, and preserving the park's neighborhood character. The plan was developed through community input, including a public open house and survey. Ricks moved, Schwingler seconded, to support the Master Plan for Antoine Park. VOTE: Ayes 4, Nays 0. PUBLIC SAFETY REPORT 17. Funding Request from Long Lake — Hwy 12 Access Gate Repairs The Council approved a one-time contribution of $2,439.33 to the City of Long Lake to assist with replacement of the Highway 12 Emergency Access Gate used for emergency response access and directed staff to provide written clarification that the contribution does not constitute a commitment to participate in future funding, ownership, or maintenance responsibilities. Background: Finance Director Maggie Jin will be out on leave starting around mid -July for approximately fourteen weeks. This position is critical to the operations of the Finance Department with duties to include attending and presenting at work sessions and council meetings, attending management team meetings, managing the City's bank and investment accounts, dealing with insurance claims, completing work on the 2027 budgets, and working closely with departments regarding financial operations, and other duties as needed. Therefore, it is requested that the City Council consider the appointment of Anne Hentges, Accountant/HR Representative, to the position of Interim Finance Director effective upon Maggie's leave until her return to work. Staff has been discussing redelegating duties during Maggie's absence with a recommendation to hire Alicia Johnson as a temporary Finance Assistant for the duration of Maggie's leave. This temporary position would assist with accounts payable, utility billing certification and other administrative finance duties on a part-time basis while the Accounting Technician Kellie Intlekofer cover payroll duties. Having an assistant position is especially critical during this busy time of the year with the Finance Department focused on certification, budgeting and upcoming benefit enrollment and wellness fair planning. Staff is recommending appointing Anne Hentges as Interim Finance Director and hiring Alicia Johnson as a temporary Finance Assistant for the duration of Maggie's leave. Ms. Johnson's hire is not to exceed six month under PERA exclusion guidelines for temporary hire. Ms. Johnson is a former employee and had left the City on good terms in January 2025. She was temporary Accounting Technician during the Accounting Technician's leave in 2025 and is available to come back again to assist. 3. Cost: The cost of the interim finance director is approximately $9,500 and temporary finance assistant is approximately $10,000 with employment taxes included which will be then be offset by the Finance Director's leave of absence, totaling a cost saving of approximately $8,000 overall during this period. This will be reflected within the General Fund budget. 4. Requirements: Per Local 12 bargaining agreement, if the employee of that unit is assigned to department head duties, the employee shall earn the starting step of the department head pay. 5. MN§15.99 Application Deadline: The application was made on April 22, 2026, and deemed complete on April 27, 2026. The 60-day review period expires on June 26, 2026. 3. Background: The applicant is pursuing after -the -fact approval for the newly constructed patio. The patio amounts to an encroachment of 65 square feet, 6.3 feet to the side property line where a 10-foot side setback is required. At the May 26, 2026, the City Council directed staff to draft findings of approval passed on a vote of 3 to 1. The draft resolution has been submitted for the Council's consideration an Exhibit A. (hereinafter the "Property"); WHEREAS, the Applicant has made application to the City of Orono for a variance from Orono Municipal Zoning Code Section 6.12.1450 for after -the -fact approval of a patio located 6.7 feet from the side property line where 10 feet is required; and WHEREAS, on May 18, 2026, after published and mailed notice in accordance with Minnesota Statutes and the City Code, the Planning Commission held a public hearing, at which time all persons desiring to be heard concerning this application were given the opportunity to speak thereon; and WHEREAS, on May 18, 2026, the Planning Commission voted 6 to 1 in favor of a motion to recommend approval of the after -the -fact variance against the recommendation made by staff; and WHEREAS, on May 26, 2026, the City Council reviewed the recommendations of staff and the Planning Commission, and voted 3 to 1 in favor of a motion to direct staff to draft a resolution with findings of approval; and WHEREAS, on June 8, 2026 the City Council accepted the findings of the approval for the requested after -the -fact variance; and 46 CITY OF ORONO RESOLUTION OF THE CITY COUNCIL NO.7687 NOW, THEREFORE, BE IT RESOLVED that the City Council of Orono, Minnesota hereby grants approval after -the -fact for the requested variance as described above based on one or more of the following findings of fact concerning the Property: FINDINGS OF FACT: Al. This application was reviewed as Zoning File LA26-000017. The analysis contained within staff memos and the exhibits attached to the aforesaid memos, all minutes from the above -mentioned meetings, and any and all other materials distributed at these meetings are hereby incorporated by reference. A2. The Property is located in the LR-1 B, One -Family Lakeshore Residential Zoning District. A3. The Property is within Tier 1 and hardcover is limited to 25% of lot area according to the Stormwater Quality Overlay District, and the Applicant is proposing 29.7% hardcover. Prior to proposed project, the existing hardcover on the Property was legally nonconforming at 30.7%. A4. In August of 2024, an admirative zoning permit, Z24-000032, was issued for landscaping work on the Property that included patio space. In April of 2025, an amended patio plan was provided with the permit for review, but was not approved. The work on the Property was completed in 2025 without zoning approval for the changes in the patio. A5. The Applicant applied for an after -the -fact side setback variance for a patio. A6. 65 square feet of the proposed patio encroaches 3.3 feet into the accessory structure side setback of 10 feet. A7. In considering this application for a variance, the Council has considered the advice and recommendation of the Planning Commission and the effect of the proposed variances upon the health, safety and welfare of the community, existing and anticipated traffic conditions, light and air, danger of fire, risk to the public safety, and the effect on values of property in the surrounding area. VARIANCE ANALYSIS: B1. Variances shall only be permitted when they are in harmony with the general purposes and intent of the ordinance; the intent and purpose of the ordinance is to create separation and orderly spacing of improvements from property to property. The Applicant's plan does not create the required physical separation between the patio and 47 CITY OF ORONO RESOLUTION OF THE CITY COUNCIL NO.7687 the adjacent property, but implements screening to ensure the use of this space will not create an adverse impact on the adjacent property; and B2. Variances shall only be permitted when consistent with the comprehensive plan; the proposal of patio space, accessory to a residential use within LR-1B zoning district, is consistent with the comprehensive plan; and B3. Variances may be granted when the Applicant for the variance establishes that there are practical difficulties in complying with the zoning ordinance. `Practical difficulties,' as used in connection with the granting of a variance, means that: a. The property owner in question proposes to use the property in a reasonable manner, however, the proposed use is not permitted by the official controls; the proposal for a patio in an area of the Property that has been historically used for this purpose is reasonable and appropriate; and b. The plight of the landowner is due to circumstances unique to his property not created by the landowner; the patio is designed around a challenging grade that the existing house was built into. In order to protect the lower -level walkout from erosion and drainage, utilizing most of the once existing, nonconforming patio space is logical; and c. The variance, if granted, will not alter the essential character of the locality; most of the properties along Bohns Point Road have lake -facing patio spaces. Allowing for a patio design and location that meets the needs of the Property is sensible. Given this part of the Property has accommodated patio space in the past and the encroachment amounts to less than 100 square feet, the character of the area will not be adversely impacted. B4. Economic considerations alone do not constitute practical difficulties; economic considerations do not impact the finding of practical difficulties with the Property; and B5. Practical difficulties also include but are not limited to inadequate access to direct sunlight for solar energy systems. Variances shall be granted for earth -sheltered construction as defined in Minn. Stat. § 216C.06, subd. 2, when in harmony with Orono City Code Chapter 78; this condition is not applicable to the variance; and B6. The board or the council may not permit as a variance any use that is not permitted under Orono City Code Chapter 78 for property in the zone where the affected person's land is located; structures, such as patios that are accessory to single-family residences, are permitted within LR-1B zoning district; and 48 CITY OF ORONO RESOLUTION OF THE CITY COUNCIL NO.7687 B7. The board or council may permit as a variance the temporary use of a one -family dwelling as a two-family dwelling; this condition is not applicable to the variance; and B8. The special conditions applying to the structure or land in question are peculiar to such property or immediately adjoining property; the proposed patio location is wedged in between a notable grade change and the side property line, where the least amount of land disturbance would occur. Grading in this area to support a patio would either adversely impact the lower -level walkout, or involve significant clearing of earth to make the land suitable for a conforming patio; and B9. The conditions do not apply generally to other land or structures in the district in which the land is located; the patio space on the Property has historically been located near the northern side property line, at a similar grade as the first floor of the house. There is a lower -level walkout south of the patio space, with a several -foot grade change in between. The only lake -facing egress from the first floor of the house exits to this patio space; and B10. The granting of the application is necessary for the preservation and enjoyment of a substantial property right of the Applicant; the patio is partially screened by a retaining wall that is subject to a lesser setback. The patio allows for the Property to come closer to conformance with hardcover, and moves the patio into a better screened location further from the lake. The approval of a variance is necessary for the property rights of the owners; and B11. The granting of the proposed variance will not in any way impair health, safety, comfort or morals, or in any other respect be contrary to the intent of this chapter; the granting of a variance will not impact the health, safety or welfare of residents and owners in the area. The previously administratively -approved plan had a similar encroachment, but with grass or a pervious surface opposed to stone. Ample screening has been provided to alleviate the potential impacts of the encroachment; and B12. The granting of such variance will not merely serve as a convenience to the Applicant, but is necessary to alleviate demonstrable difficulty; the granting of a variance for the patio will alleviate a difficulty placed on the Applicant. Shifting the patio space into the Property to meet the side setback would create difficulties with the slope and retaining wall solutions in the lakeyard or reduce the functional use of the space. 49 CITY OF ORONO RESOLUTION OF THE CITY COUNCIL NO.7687 CONCLUSIONS, ORDER AND CONDITIONS: Based upon one or more of the above findings, the Orono City Council hereby grants variances from Orono Municipal Zoning Code Section 6.12.1450 for a patio located 6.7 feet from the side property line, subject to the following conditions: 1. Council approval is based on the entire record, above Findings. 2. The approved project shall conform to the site plan submitted by the Applicant, attached to this Resolution as Exhibit A. 3. Any amendments to the plans which are not in conformity with City codes may require further Planning Commission and City Council review. 4. Authorities granted by this resolution run with the Property not with the Owner, but are permissive only and must be exercised by the issuance of an amended Zoning permit for the proposed project. The zoning permit must be issued within one year of the date of Council approval, or the variance will expire on that date (June 8, 2027). 5. Violation of or non-compliance with any of the terms and conditions of this resolution may result in the termination of any authority granted herein. Hennepin County 2026 budget update 70 AGENDA ITEM Date: June 8, 2026 Item: 11 Title: LA25-000033, Hennepin County, 3700 North Shore Drive (North Arm Public Boat Launch), Vacation, Variance, Conditional Use Permit, and Interim Use Permit - Resolution 7688 Presenter: Laura Oakden, Community Development Director Section: Community Development Report 1. Purpose: The applicant requests City approval to redesign the County -owned North Arm Public Boat Launch. The redesign includes requests for the following: 1. Vacation of public right-of-way for the eastern 20 feet of Part of Cherry Ave and Alley; 2. Variances for total hardcover and hardcover within 75-feet of the OHWL; 3. Variances for building and structures located within 75-feet of the OHWL; 4. Conditional Use Permit to reconstruct a seawall; and 5. Interim Use Permit to allow over 10 cubic yards of grading within 75 feet of the OHWL. 2. MN§15.99 Application Deadline: The application was made complete on September 22, 2025; the 120-day review period originally would have expired on January 20, 2026. The Applicant has requested an extension of the review timeline until June 18, 2026. 3. Background: The North Arm Boat Landing is located near the intersection of Shadywood Road (CSAH 19) and North Shore Drive (CSAH 51) at 3700 North Shore Drive. The site was created in the 1960's through the placement of fill, resulting in approximately 500 linear feet of shoreline on Lake Minnetonka. It has operated as a public boat access managed by Hennepin County since that time. The ±1.58-acre property is zoned LR-1C, One Family Lakeshore Residential. The existing use as a public boat access is considered to be legally nonconforming, as it existed prior to the City's zoning regulations adopted in 1975. The parcel is bisected by undeveloped, platted rights -of -way. The LR-1 C residential zoning district provides for uses such as medium -density residential development, limited agricultural activity, and other compatible uses. According to Orono's Comprehensive Plan, the property's existing land use is classified as: Park, Recreational, and Open Space. The current use of the property as a public boat landing appears to be consistent with the existing and future land use guidance within Orono's Comprehensive Plan UPDATED/ NEW INFORMATION The City Council reviewed this application at their April 13th meeting (Packet, Video). The Council directed staff to draft a resolution to approve the conditional use permit, interim use permit, and variances for the North Arm Boat Landing redesign; the motion also included denial of the requested vacations. As part the motion, Council provided direction to the applicant to provide additional information about the size of the boat launch as well as clarification about the complaint and enforcement processes. 71 Hennepin County submitted an amended plan which reflects a reduction in the proposed size of the boat ramp, the existing width of 36 feet will be maintained. An amended narrative was also provided highlighting the ramp design as well as clarification surrounding the parking lot and boat launch use. Updated hardcover calculations and landscaping plan were provided which reflect the changes to the site. 4. Planning Commission Vote and Comment: Planning Commission reviewed the item at the November 17, 2025 Meeting (Packet, Minutes, Video). 5. Public Comment: Multiple public comments were submitted to the Planning Commission (Planning Commission Written Public Comments: Herman, Jabbour, Niccum). Many members of the public also attended and spoke at the Public Hearing. One comment was submitted to the April 13, 2026 Council Meeting (Jabbour 3.18.26) One new comment from the public was received on May 19, 2026 ; the comment is attached as an Ex H. NEW Public Comment 5.19.26. 6. Staff Recommendation: Staff recommends the Council adopt Resolution 7688 as drafted which denies the request to vacate the requested rights -of -way and approves the Conditional Use Permit, Interim Use Permit and Variances to support the the site improvements for the North Arm Boat Landing redesign subject to the following conditions: 1. Hennepin County (Owner) must obtain all permits and approvals from other government agencies (MCWD, DNR, LMCD, and Met Council); and 2. Prohibition of parking and operation of special mobile equipment, material staging, vehicle maintenance and business operations within the parking lot. 3. Submittal of landscape and lighting plans which provide adequate screening and buffering of site activity and lighting for adjacent residential properties in order to minimize off -site impacts. LA25-000033 WHEREAS, on July 23,2025, Hennepin County (hereinafter the "Applicant"), applied for a conditional use permit, interim use permit, variances and vacation from the City Code for the property addressed 3700 North Shore Drive, North Arm Boat Landing, and legally in Exhibit A. The current extension period is set to expire on June 18, 2026; and WHEREAS, on August 13, 2025, notification of the vacation and request for comment was mailed to the Department of Natural Resources via certified mail, as required by Minnesota State statute; and WHEREAS, on November 17, 2025, after published and mailed notice in accordance with Minnesota Statutes and the City Code, the Planning Commission held a public hearing, at which time all persons desiring to be heard concerning this application were allowed to speak thereon; and WHEREAS, on November 17, 2025, the Planning Commission reviewed the application noting additional information should be submitted and recommended denial of the applications as applied; and WHEREAS, on March 13, 2026, the applicant submitted additional information following the planning commission's direction; and WHEREAS, on April 13, 2026, the City Council reviewed the application and directed staff to prepare written findings in support for the Conditional Use Permit, Interim Use Permits and Variances with conditions outlined in the staff report, and WHEREAS, on April 13, 2026, the City Council reviewed the vacation application and directed staff to prepare findings of denial for the vacation request; and, WHEREAS, the Orono City Council finds the vacation as proposed is not in keeping with the public interest in consideration of the following findings: 1) The rights of ways are dedicated for public use and are serving a public use. 2) The areas have been improved upon. 3) The city may need to utilize the space in the future for utility or drainage purpose. 4) The council finds the right of way spaces may have future benefits to the public. NOW, THEREFORE, BE IT RESOLVED that the City Council of Orono, Minnesota, hereby approves the requested conditional use permit, interim use permit, and variances and 74 CITY OF ORONO RESOLUTION OF THE CITY COUNCIL NO. 76HH denies the vacation request as described above based on one or more of the following findings of fact concerning the Property: FINDINGS OF FACT: Al. The analysis contained within staff memos and the exhibits attached to the aforesaid memos, all minutes from the above -mentioned meetings, and all other materials distributed at these meetings are hereby incorporated by reference. A2. The Property is located in the LR-1 C One -Family Lakeshore Residential Zoning District. A3. The Property contains 1.63 acres in area and has a defined lot width of approximately +/- 500 feet measured at the OHWL and at the 75-foot setback. A4. The Property is within Tier 1, and hardcover is limited to 25% according to the Stormwater Quality Overlay District. A5. The Applicant has applied for the following a. Conditional Use Permit for improvements in the Floodway, including a Seawall b. Interim Use Permit for grading in the 75-foot shore setback c. Variance for hardcover to exceed 25% d. Variance for hardcover within the 75-foot shore setback e. Variance for building and structure improvements in the 75-foot shore setback f. Vacation of the eastern 20 feet of Cherry Avenue and a 14-foot alley A6. In considering this application, the Council has considered the advice and recommendation of the Planning Commission and the effect of the proposed variance upon the health, safety, and welfare of the community, existing and anticipated traffic conditions, light and air, danger of fire, risk to the public safety, and the effect on values of property in the surrounding area. CONDITIONAL USE PERMIT ANALYSIS: B1. Consistent with the community management plan; the property is currently operating as a legal nonconforming use as a public boat landing, the request for improvements including rebuilding a seawall and other improvements to the site all support access to Lake Minnetonka and are consistent with the community management plan of a Park and Recreational Space. 75 CITY OF ORONO RESOLUTION OF THE CITY COUNCIL NO. 76HH B2. Compliant with the zoning code, including any conditions imposed on specific uses as required by article V, division 3 of the City Code; The property will maintain the existing use, which is legally nonconforming, to support a public boat launch. B3. Adequately served by police, fire, roads, and stormwater management; The proposed project improves the stormwater management on the site and accessibility with a new parking lot design. This criterion is met. B4. Provided with an adequate water supply and sewage disposal system; This criterion is met. B5. Not expected to generate excessive demand for public services at public cost; The existing use of a public boat launch is being maintained. The new structures and seawall for the site are not anticipated to generate additional demand for the site. If any additional demand for public services is necessary from the site; it will be coordinated with Hennepin County as the property owner. B6. Compatible with the surrounding area as the area is used both presently and as it is planned to be used in the future; The property will maintain the existing use which is legally nonconforming to support a public boat launch which is consistent with the existing conditions. B7. Consistent with the character of the surrounding area, unless a change of character is called for in the community management plan; The property will maintain the existing, legally nonconforming use to support a public boat launch which is consistent with the existing conditions for the neighborhood and surrounding uses. The site is consistent with the community management plan. B8. Compatible with the character of buildings and site improvements in the surrounding area, unless a change of character is called for in the community management plan; The proposed seawall to support the boat launch and access to the site is compatible with the community management plan. The two proposed buildings are intended to facilitate implementation for protections against aquatic invasive species (AIS), a program Hennepin County implements for water quality protections for Lake Minnetonka. B9. Not expected to substantially impair the use and enjoyment of the property in the area or have a materially adverse impact on the property values in the area when compared to the impairment or impact of generally permitted uses. The proposed site improvements require review and approval by other governmental agencies such as MCWD, DNR and LMCD. The proposed seawall will not have adverse impact on the neighborhood. 76 CITY OF ORONO RESOLUTION OF THE CITY COUNCIL NO. 76HH B10. Provided with screening and buffering adequate to mitigate undesirable views and activities likely to disturb surrounding uses; The applicant has submitted landscape and lighting plans to mitigate views for the abutting properties and limits activities on the site. 11311. Not create a nuisance which generates smoke, noise, glare, vibration, odors, fumes, dust, electrical interference, general unsightliness, or other means; The applicants will be required to adhere to the City's erosion control regulations as well as the permitting requirements of the DNR, LMCD, and MCWD. Timely re - vegetation and stabilization will be a requirement of the permitting process. The project should not result in a nuisance condition. B12. Not cause excessive non-residential traffic on residential streets, parking needs that cause a demonstrable inconvenience to adjoining properties, traffic congestion, or unsafe access; During construction of the improvements, the applicant will be required to keep debris off of the public roadways. The noise resulting from the trucks and equipment moving the material in and around the site should be minimized to the extent possible. The project will be evaluated and monitored by the City to minimize nuisances during construction of the project. The improvements in the floodway will not impact the existing levels of traffic, parking, traffic congestions or access. B13. Designed to take into account the natural, scenic, and historic features of the area and to minimize environmental impact; the overall long-term effect of the project should promote sustainability throughout the site with improved stormwater management, reduction of shoreline impacts and additional native vegetation areas within the site. B14. All exterior lighting shall be so directed so as not to cast glare toward or onto the public right-of-way or neighboring residential uses or districts; The proposed lighting plan includes down directed, diffused or shielded/hooded fixtures, timers, ensuring that this criterion will be met. B15. Not detrimental to the public health, public safety, or general welfare. The project should improve accessibility and safety within site. It will not be a detriment to the public health, public safety, or general welfare. INTERIM USE PERMIT ANALYSIS 77 CITY OF ORONO RESOLUTION OF THE CITY COUNCIL NO. 76HH C1.The use will meet the general performance standards in section 6.12.4090; Project has been reviewed against the CUP standards (6.12.4090). The general performance standards are met. C2.The use is allowed as an interim use in the applicable zoning district; Grading activities are permitted within the LR-1C Zoning District. This criterion is met. C3.The use will not delay anticipated development or redevelopment of the site; The grading activities necessary for future site development. This criterion is met. C4.The use will not be in conflict with any provisions of the city code on an ongoing basis; The plan will be reviewed by the City Engineer, MCWD, DNR, and the applicant will be required to follow all governing agency requirements. The applicant will obtain all necessary permits with outside agencies including MPCA, and NPDES permitting. This criterion is met. C5.The use will not adversely affect the adjacent property, the surrounding neighborhood, or other uses on the property where the use will be located; The applicant shall ensure the project scope remains within the property limits, the haul route is monitored (and cleaned as often as necessary), and that any adverse impacts are mitigated. This criterion is met. C6.The use will not impose additional unreasonable costs on the public; The project will not impose additional costs on the public. This criterion is met. C7.The date or event that will terminate the use can be identified with certainty; The applicant has provided a project timeline which will commence in the Fall of 2026 with a goal to be complete in 2028. This criterion is met. C8.And the applicant agrees in writing to any conditions that the city council deems appropriate for the use, including a requirement for a financial security to ensure removal of all evidence of the use upon termination, and restoration of the site to prior or better conditions. The conditions shall be set forth in a development agreement between the property owner and the city, which agreement shall be recorded with the Hennepin County Recorder or Registrar of Deeds. Approval of the Interim Use Permit will be memorialized through a resolution that will be recorded against the property. All requirements and conditions will be listed as part of the resolution. This criterion is met. VARIANCE ANALYSIS D1.The variance is in harmony with the general intent and purpose of the Ordinance. The proposed variances are in harmony with the intent of the Ordinance supporting the 78 CITY OF ORONO RESOLUTION OF THE CITY COUNCIL NO. 7688 improvements for the legally nonconforming use. The public boat launch is a legally nonconforming water -oriented use. The improvements proposed to the site for parking, lighting, and accessory structures support the site by improving safety, accessibility and screening on the parcel. D2.The variance is consistent with the comprehensive plan. The variances proposed to rebuild the public access boat launch are consistent with the Comprehensive Plan. The Comprehensive Plan identifies the use of this property as Park/Recreation/Open Space which include private and public areas. This site is owned by Hennepin County and operates as a public boat launch to access and support activities for Lake Minnetonka. D3.The applicant establishes that there are practical difficulties. a. The property owner proposes to use the property in a reasonable manner not permitted by the official controls; The property is a legal nonconforming use. The site has operated as a public boat launch since the 1960s before establishment of the City's current zoning classification of LR-1C. This proposed redesign will maintain this existing use. The improvements proposed are reasonable and support the public boat launch and includes a redesign of a public parking lot, ADA improvements, and improved stormwater management on the site. b. There are circumstances unique to the property not created by the landowner; The property's orientation and proximity to the lake is an existing condition, and there is no available land with which to make the property more conforming. The proposed parking lot is decreasing by 2 parking stalls with the proposed project. The restricted roadway, low topography, lot size and shape, and location are challenges with the parcel. There should be consideration for variances to setback requirements for the property which is nonconforming. The project has been designed with an effort toward promoting stormwater management, improving accessibility and safety without sacrificing functionality; and c. The variance will not alter the essential character of the locality. The variances are requested to permit the reconstruction of a parking lot, new public boat launch, and installation of additional functional features, which is reasonable. Increasing the hardcover to support the parking area will promote safer maneuverability for vehicles, but also raises concerns for promoting commercial and industrial users for the site. Staff finds the layout of the proposed plan to be reasonable and should adequately 79 CITY OF ORONO RESOLUTION OF THE CITY COUNCIL NO. 7688 support functional traffic circulation. However, the parking lot currently supports public access and recreational users of the lake. The parking and operating of special mobile equipment, material staging, vehicle maintenance and business operations are prohibited within the parking lot. D4. Economic considerations alone do not constitute practical difficulties. Economic considerations have not been a factor in the variance approval determination. D5. Practical difficulties also include but are not limited to inadequate access to direct sunlight for solar energy systems. Variances shall be granted for earth -sheltered construction as defined in Minn. Stat. § 216C.06, subd. 17, when in harmony with Orono City Code Chapter 78. This condition is not applicable. D6.The board or the council may not permit as a variance any use that is not permitted under Orono City Code Chapter 6.12 for property in the zone where the affected person's land is located. This condition is not applicable, as the property is a legal nonconforming use. The site has operated as a public boat launch since the 1960s before the City Zoning of LR-1C was adopted. This proposed redesign will maintain this existing use. Minn. Stat. § 462.357, subd. 6(2) allows the city to grant variances from restrictions on legal non conformities, such as the proposed variances from hardcover and setback restrictions. D7.The board or council may permit as a variance the temporary use of a one -family dwelling as a two-family dwelling. This condition is not applicable. D8.The special conditions applying to the structure or land in question are peculiar to such property or immediately adjoining property. The property's existing orientation and current use are peculiar to the property. This creates unique difficulties for the site that also apply to other water -oriented uses. The proposed variances are not out of character. D9.The conditions do not apply generally to other land or structures in the district in which the land is located. The property has limited land availability and the orientation of the site, which serves the established water -oriented use, create difficulties that do not apply other properties in the City. D10. The granting of the application is necessary for the preservation and enjoyment of a substantial property right of the applicant. The site is currently being used for public access to Lake Minnetonka. The redesign supports and maintains the current use. The improvements are necessary to address stormwater, accessibility and safety for the public (users of the property). D11. The granting of the proposed variance will not in any way impair health, safety, comfort, or morals, or in any other respect be contrary to the intent of this chapter. M CITY OF ORONO RESOLUTION OF THE CITY COUNCIL NO. 76HH Granting the variances in this situation is not contrary to the intent of the zoning chapter. The variances will improve safety on the site by allowing better maneuverability on the site, support the AIS program for Lake Minnetonka water quality, improve accessibility to the lake and lakeshore by disabled person, and support stormwater improvements for the site. D12. The granting of such variance will not merely serve as a convenience to the applicants but is necessary to alleviate demonstrable difficulty. The site is nonconforming as the restrictive 75 lake setback area encumbers a majority of the land. The site currently operates as a public access for Lake Minnetonka. The proposed redesign will maintain the current use and improve the stormwater, accessibility and safety. Granting the variances are necessary to maintain the current use of the property. CONCLUSIONS, ORDER, AND CONDITIONS: Based upon one or more of the above findings, the Orono City Council hereby grants a conditional use permit for improvements included a seaway withing the floodplain, an interim use permit for grading and variances for hardcover within the shore setback, buildings and structures within the shore setback and overall site hardcover to exceed 25% and denial of the vacation request for the portion of Cherry Avenue and the adjoining alley, to allow the redesign and construction of the North Arm Boat Landing, a legal nonconforming use, subject to the following conditions: C1.Council approval is based on the entire record and the above Findings. C2.The approved project shall conform to the proposed Site Plan dated 6/1/2026 by IMO Consulting Group, submitted by the Applicant attached to this Resolution as Exhibits B. C3.Any amendments to the plans that do not conform to City codes may require additional review by the Planning Commission and City Council. C4. Hennepin County must obtain all permits and approvals from other government agencies (MCWD, DNR, LMCD, and Met Council); and C5.The parking and operating of special mobile equipment, as defined by City Code Section 6.12.7810 (1), material staging, vehicle maintenance and business operations are prohibited within the parking lot. 81 CITY OF ORONO RESOLUTION OF THE CITY COUNCIL NO. 76HH C6.The landscape and lighting plans must buffer adjacent residential properties in order to minimize off -site impacts. C7.Authorities granted by this resolution run with the Property, not with the Owners, but are permissive only and must be exercised by obtaining a building permit for the new construction and commencing construction of said project. A building permit must be obtained within one year of the date of Council approval, or the approvals will expire on that date (June 8, 2027). C8. Violation of or non-compliance with any of the terms and conditions of this resolution may result in the termination of any authority granted herein. The county has consistently operated this public access as a lawful nonconforming use, and our goal with this project is to be a good neighbor and partner to the city and its residents while continuing to provide public access to Lake Minnetonka. Launch width Council members had questions about the current ramp width and the width of other public accesses to Lake Minnetonka. Council members stressed the importance of maintaining the current access width and number of lanes to ensure the redesign does not, whether real or perceived, substantially increase boater traffic. The current ramp is 36' feet wide. Over the last several decades ramp sizes have increased, both on Lake Minnetonka and on surrounding lakes. Maxwell Bay was widened to 45' in 1996 and Gray's Bay was widened to 60' in 2002. The county's proposal dated October 17, 2025 included a ramp width of 45.' Hennepin County will update the plan set to maintain the existing ramp width (36') and lanes (2) as requested by the city. After review and discussions with MnDNR, other design changes like re- orienting the ramp to address challenging backup maneuvers and reconstruction of the ramp make the safety improvements that align with the goals of this project. The redesign will also maintain spacing between the lanes and the seawall to provide buffer areas for boats. Trash and litter management Hennepin County is implementing its pack -in pack -out policy during the 2026 boating season. The trash dumpster and the fenced enclosure have been removed. Trash containers for shore anglers will remain with trash removed from them twice a week. The county is in the process of implementing signage to inform users that littering and smoking are prohibited. This signage includes a litter complaint system - offering a QR code with an online form and phone number for access users to report litter issues. Issues reported will be addressed by county staff within two business days. As we implement this new process, county staff and crews are making more frequent visits to address litter removal and inform the implementation. 86 Parking lot and ramp use Council members continued the discussion about the level of commercial activity seen at the access in recent years. As a public access, the county can't outright ban commercial access to the lake, but there are avenues to restrict or regulate commercial activity occurring at the access parking lot, primarily through parking and vehicle restrictions. Restrictions enacted through the city's land use authority —placing conditions to requested variances —was proposed by city staff in a March 11 email, and further discussed at the council meeting. Specifically, staff proposed imposing the following restrictions: "The parking lot supports public access and recreational users of the lake. The parking and operating of special mobile equipment, material staging, vehicle maintenance and business operations are prohibited within the parking lot." Accordingly, over the past several weeks, the county has been contacting and informing commercial operators that the following activities are not allowed at the access parking lot: • Commercial staging • Taking up more than one parking stall, parking in non -designated areas, or blocking traffic flow • Using the ramp and dock for more than 20 minutes Through this outreach, county staff are also conveying to commercial operators that additional restrictions in -line with those above are likely coming and that they would be notified by letter of new or modified restrictions. Additionally, county staff are talking with operators on site if these activities are occurring. This has included several contractors using the site for material staging for nearby residential construction projects. In general, the response from operators has been cooperative. Upon the city's imposition of variance conditions, county staff will work with its board to consider and recommend approval of a resolution implementing the applicable parking lot restrictions, installing signage to communicate the restrictions and corresponding authority, and will alert commercial operators with a letter regarding the restrictions. Reminders will be communicated as needed. We will also continue to actively monitor the site with county staff and AIS inspection partners. If violations occur, county staff will first work with violators to educate them about the rules and communicate clearly how they can operate within compliance and determine additional steps as appropriate. Hennepin County will also work with the Lake Minnetonka Conservation District (LMCD) to educate charter and rental watercraft operators, so they are aware of any pertinent restrictions. We look forward to the city council's consideration of the county's application on June 8 and believe the actions outlined above demonstrate the county's continued commitment to working with the City of Orono. This project addresses repairs needed to preserve the long-term integrity and function of this popular public water access. The county's redesign focus is on improving safety, accessibility, water quality of and connectivity to Lake Minnetonka, and complimenting the surrounding community. Key design elements are based on comments received from access users, nearby residents, and businesses. Project benefits • Align with the City of Orono's vision to preserve natural beauty, quality of life and recreational assets, and especially to preserve the great resources of Lake Minnetonka for the benefit of all regional residents.' • Improve safety and boat launch experience — not only for motorized boaters, but also for canoers, kayakers, and paddleboarders. • Increase access for residents with physical disabilities by constructing the first fully accessible ramp in the metro area. • Enhance the shore fishing experience with easier access to the lake. • Protect water quality, restore Lake Minnetonka shoreline, and improve landscaping with native plants and trees. View of new trailer parking alignment and native pollinator planting along North Shore Drive 1 City of Orono vision statement and 2040 Community Management Plan 3 92 Site history and use • 1942: The county took the title from the State of Minnesota for road purposes. • 1960s: This site was open water and marshland prior to twelve feet of fill being added, likely for staging space for road and bridge construction. Following completion of those projects, the site was used unofficially by the public to access Lake Minnetonka. 1957 aerial photo 1964 aerial photo • 1970s: The county established the North Arm Public Lake Minnetonka Access. The fill was graded, a steel seawall added, and an asphalt parking lot with 77 parking spaces and a boat launch were created. The site today looks much as it did when it was built. • 1996: In cooperation with the Minnesota Department of Natural Resources (DNR), the county added three sediment traps for water quality improvements. Prior to that work, all stormwater was running directly into the lake. The project also added new asphalt with two center islands and made some minor changes to the shoreline fishing area. Parking was reduced to 60 parking spaces. • 2003 to 2011: Minor repairs were made, including maintenance to clean sediment traps, asphalt mill and overlay, and replenished shoreline riprap. • 2012: First aquatic invasive species (AIS) prevention behavior change pilot project at a public access. • Today: North Arm is the third busiest public access on Lake Minnetonka, behind Grays Bay and Maxwell Bay. Many generations of families use this access to enjoy Lake Minnetonka. This involved developing concept options and conducting community engagement. In 2023, the Hennepin County Board of Commissioners allocated $3.5 million in Capital Improvement Project (CIP) funds to redesign and modernize the site. The county is also discussing a cost share agreement with the MN DNR, they have tentatively agreed to contribute up to $850,000 towards the construction costs. The current project design includes the following features: Infrastructure repair to preserve the function of a public boat launch • Redesigned parking lot that includes wider, longer stalls for the increased size of modern vehicles, boats, and trailers and integrates permeable paving while maintaining similar parking capacity (64 total stalls made up of 41 boat & trailer, 18 vehicle only, and 5 ADA2 accessible vehicle & trailer and vehicle only stalls) • New, wider boat launch Safety improvements • Reoriented boat launch and parking stalls to improve maneuverability and flow • Partnership with non-profit organization, Wheelchairs & Walleyes, for ADA ramp and lift • Increasing the number of ADA parking stalls to 5 (3 vehicle & trailers and 2 vehicle only) • New lighting that meets dark sky standards • Separate nonmotorized boat access for canoe, kayak, and paddleboard users • Redesigned parking stalls along North Shore Drive to eliminate boat trailer parking on a sloped hill and encroaching on roadway Shoreline fishing area improvements • Additional parking for anglers, including ADA accessible spaces • Improved access with paved sidewalks and shore fishing features such as pods with steps for better access to the lake Water quality and natural area/wildlife habitat enhancements • New stormwater management system that directs water into the ground and filters it through permeable paving instead of discharging it directly into the lake • Installation of a new hot water decontamination facility to prevent the spread of AIS • Replacement of invasive plant species, emerald ash -borer threatened ash trees, and turf grass with climate- resistant, site -appropriate tree species and native pollinator habitat • Improved privacy screening of access for neighbors 2 `ADA' refers to the Americans with Disabilities Act. ADA accessibility in the context of this proposal primarily refers to, but is not limited to, mobility challenges. 6 95 • Protection and enhancement of natural shoreline Variances requested The county's proposed redesign of the site requires several variances as described below. Each of these variances are requested to maintain the site as it is used today and to better accommodate various recreational users at this public access. 1. Hardcover within 75-foot lakeyard (Sec 6.12.9110) The current site includes hardcover within 75-feet of the lakeyard with the asphalt parking lot installed in the early 1970s. This predates the establishment of the City of Orono's current zoning rules and classifications and this property's use as a public access has been a legal nonconforming use for its residential classification (LR-1C) for the last 50 years. For this property to act as a public access, hardcover will be required within 75-feet of the lakeyard to provide ramped access into the lake. Other site hardcover within the 75-feet setback includes the picnic area, sidewalks providing lake access to people shore fishing, the ADA accessible lift, and most of the parking spaces. This project cannot be redesigned to avoid needing this variance. 2. Overall site hardcover exceeding 25% (Sec 6.12.9210) The current site is -73% hardcover. The redesign includes a slightly expanded footprint for hardcover up to -77%. While hardcover will increase, the county is proposing to greatly reduce the amount of impermeable hardcover (bituminous and concrete) on -site and replace it with permeable pavement. Impermeable hardcover will only make up 43% of the reconstructed site. Permeable pavement is expected to greatly reduce rainfall runoff and pollution by intercepting and filtering the rainfall runoff before it can reach Lake Minnetonka. This provides rainfall runoff treatment well above what's provided on -site today. Much of the hardcover expansion is to provide additional parking space along North Shore Drive so trailers are not using the hillslope to park, as is currently occurring on the grassy slope as shown above in the site improvements section. Having a solid, flat surface for both vehicles and trailers improves safety by preventing trailers from possibly extending into North Shore Drive. Foregoing the increased hardcover on the southeast side of the site would result in a reduction of trailer spaces. Addressing these challenges was the top concern with access users, residents who attended community engagement events, and law enforcement. This project cannot be redesigned to avoid needing this variance. 7 96 3. Buildings and structures within the 75-foot lake setback (6.12.6240) The variance request for buildings or structures within the 75-foot lake setback is for the construction and operation of an AIS decontamination shed and a small shade canopy for an AIS inspector to work with boaters to remove AIS from their boats and trailers. Additional features within the 75-foot lake setback include signs, fencing, light posts, parking bollards, and trash receptacles for people shore -fishing. Each of these features are shown in the county's application materials, including provided design plans. These features were placed where most appropriate for their use and where they would be most visible and accessible for public access users and for site flow. For example, the AIS inspector canopy is placed directly adjacent to the ramp for immediate access to boats backing into and out of the lake. The AIS decontamination shed is placed further upslope to provide more space for decontamination operations as well as for the collection system that will be installed to capture water use for decontamination operations. Request to vacate In the application to the Planning Commission, the county included a request to vacate the alley that bisects the site and the eastern half of Cherry Avenue with the intent of incorporating the vacated areas into the full county parcel. This was suggested as the platted but unbuilt alley and roadway section no longer served a role for future planning needs on the site and this redevelopment provided an opportunity to reflect that reality in the plat. Vacating these two easements would ensure no additional variances for the project are needed. Hennepin County still supports vacation of these easements, however vacating them is not critical for project success. City Variance Analysis In summary, each of these variances reflect the site as it is used today and are necessary for this site to operate as a recreational public access. The city's Variance Analysis memorandum, submitted to the Planning Commission as part of its November 17, 2025 meeting materials, states "the proposed variances are in harmony with the intent of the Ordinance supporting the improvements for the legally nonconforming use". The memorandum continues, "The improvements proposed to the site parking, lighting, and accessory structures support the site by improving safety, accessibility, and screening on the parcel." Since that memorandum was written, additional updates have been made to the designs to reduce impervious surface across the site and within the 75-foot lakeyard setback to further conform with the standard, as shown in the design renderings submitted with our permit application. These include removal of pavement adjacent to the picnic area and reduction in size and extent of the fishing pods. 8 97 Permitting approvals Beyond approvals we need from the City of Orono, Hennepin County and the North Arm Public Access Redesign team are working with other partner agencies to ensure the project continues to proceed while meeting local, state, and federal rules. A list of the agencies we're working with, the permits and/or approvals we're working towards, and the status of those conversations and decisions are listed in the appendix. Engagement and community feedback The county has engaged with and listened to a broad group of stakeholders and adapted the design at each step of the project development process. The following is a summary of the engagement efforts. A full description of the engagement efforts is provided in the appendix. Key feedback received in this step: • Poor pavement condition and deteriorating boat ramp • Traffic flow bottle necks • Boat launch requires challenging back turn maneuver • No access docks, only a seawall with a gravel walkway • Poor experience for shore fishing, and it was not ADA-accessible • Difficult to launch kayaks, paddleboards, and canoes. (required dragging boats across asphalt and sharing space with trucks and large boats) • Inadequate lighting for safety This feedback was incorporated into the first design. 9 98 Design: Phase I The initial design was presented at an open house at the City of Orono on October 2, 2024 After receiving feedback at this step, the county made the following changes to the design: • Parking: Maximized the number of parking spaces available, added signage to designate location for official parking for first responders. • Amenities: Added a small shelter for AIS inspectors • AIS prevention tools: Added a small AIS cleaning station in addition to the more robust AIS decontamination system planned. Design: Phase II The revised plans were presented at a second open house in Orono in January 2025 and a virtual open house in February 2025. After receiving feedback at this step, the county made the following changes to the design: • Increasing accessibility: Incorporated a donation of an ADA-compliant boat lift and ramp from the Wheelchairs and Walleyes organization. • Landscaping and stormwater management: Removed the artificial turf and included native grasses and pollinator plantings into the design. • Waste management and litter: Made the site pack -in and pack -out and added no littering signage under the bridge. Design: Phase III Revised designs were shared in summer and fall 2025. After receiving feedback at this step, the county made the following change to the design: • Removed the separate vertical access for commercial use. Feedback from residents indicated providing a separate boat launch for commercial use gave the impression that the county was interested in increasing or expanding commercial use at the site. The county was seeking to increase safety, while reducing wear and tear on the boat launch. Recreational users and their safety are the county's primary focus for the redesign of the site. 10 99 Planning Commission feedback Hennepin County's application materials were submitted to the City of Orono on October 28, 2025. County staff attended a pre -submittal meeting with city planning staff at Orono City Hall to discuss application needs, review design details, and discuss Planning Commission meeting logistics. Prior to the Planning Commission meeting, City staff requested and were provided additional information on the application and design details. The plan was presented November 17, 2025 at the city's Planning Commission meeting. Based on feedback heard at the City of Orono's Planning Commission meeting in November 2025, the county has made several additional adjustments and clarifications to its approach for the redesign of the site. Trash and litter management What we heard from residents Residents expressed concerns about waste management at the site, including concerns about litter, the county's maintenance schedule, and the proposed plan to replace the dumpster with trash and recycling receptacles. Background Illegal dumping and litter are ongoing issues at the site. The county currently provides a dumpster that is routinely overflowing with household waste clearly not generated by users of the site. The dumpster is serviced twice weekly prior to and following weekends, and the county has Sentencing to Service (STS) crews patrol for litter twice a week. These management approaches have helped but have not eliminated the issues. Proposed solution The county proposes removing the dumpster as part of the redesign and implementing a pack -in pack -out approach to address the illegal dumping issue. Signage at the site would make it clear that illegal dumping and littering is not permitted. Additionally, small trash and recycling receptacles will be provided along the shore fishing area to capture waste discarded by site users. This approach, particularly the pack -in pack -out policy at the public access, aligns with management of other accesses on the lake, including Maxwell Bay in Orono. For litter management, the county will continue to use STS crews for litter clean-up. STS crews will be at the site twice a week (typically just before and after weekends) for litter removal with the option to add additional litter patrols during high use times. To provide additional accountability, the county will also add signage with a QR code and phone number to report illegal dumping or litter concerns. Complaints will be tracked and addressed within 2 business days. The county will continue to monitor how this solution works in practice and can further adjust to more intensive waste management solutions as needed, for example installing a camera or more frequent patrols. 11 100 Commercial access What we heard from residents Residents expressed concern that commercial use of the site would increase with the redesign, creating safety and parking issues for recreational users and surrounding residential streets. Background The North Arm Lake Minnetonka public access accommodates both recreational and commercial uses. Several companies use the site to deliver riprap, docks, and other building materials to homes on the lake. Over the years, commercial activity, specifically heavy equipment deployment, has accelerated the degradation of the boat ramp. As mentioned above, the county's initial redesign plan included a separate vertical access for commercial use to reduce wear and tear on the ramped boat launch, to improve safety by further separating commercial and recreational users, and to free up the ramped boat launch to lessen the time recreational users must wait. After receiving feedback from the city and community members that this approach could increase commercial use at the site, the vertical access was removed. Proposed solution The current design now has one ramped boat launch for motorized watercraft that will be shared by recreational and commercial users, similar to how it is now. The redesign is intended to improve the site experience for recreational boaters and shore fishing; however, it will not restrict or mitigate the commercial use currently happening at the site. Staging of materials for commercial transport at the access is not currently allowed and will remain that way. The county will post signs throughout the site restricting parking to one stall per user and limiting use of the launch to 20 minutes as part of the redesign and, as is current practice for enforcing parking regulations, will work with the city to enforce the restrictions. While the county's priority for the site is recreational use, an internal legalreviewof state statute governing public access sites concludes the county lacks authority to prohibit commercial use. Under \jinn Stat 8613.205, the county has the ability to pass an ordinance that could potentially regulate commercial access, but it likely couldn't outright prohibit commercial use. Additionally, any ordinance passed by the county would require adoption by Carver County because a portion of Lake Minnetonka is within Carver County, or have the Minnesota DNR agree to place the ordinance into effect by implementing a parallel administrative rule. In either of those two scenarios, the Lake Minnetonka Conservation District and the Minnesota DNR would also need to authorize the ordinance. Given these requirements, passing an ordinance would be a lengthy process and would only allow the county to regulate commercial use through setting hours, time limits, and fees related to watercraft type, size, and horsepower. A county ordinance could likely not completely prohibit commercial use. It's possible there are other regulatory avenues to explore to regulate or prohibit commercial access at other levels of government, including the City of Orono, but that would be up to those entities to determine what they legally could or couldn't do. For example, the Minnesota DNR's Gray's Bay public access is managed by the City of Minnetonka, which restricts some commercial 12 101 access through city zoning authority. If Orono were to enact any restrictions under its own authority, the county will comply with all applicable law. Landscaping and perimeter buffers What we heard from residents Residents expressed concerns about the landscaping plan removing existing vegetation and privacy screening. Background The existing tree buffer is currently comprised of voluntary trees, many of which are invasive species or ash trees. Invasive trees onsite include Common Buckthorn and Black Locust, both of which grow aggressively and outcompete most native trees and shrubs and limit habitat value. Ash trees are native to Minnesota but are at risk from the emerald ash -borer, which is already in the Lake Minnetonka area. Hennepin County and other local foresters recommend removal of ash trees to slow the spread of the emerald ash borer. The vegetative areas found along the perimeter of the parking lot and lakeshore should be replaced and restored with native species. Proposed solution The project's landscape design will significantly improve the site's ecological benefits by maximizing species diversity and prioritizing habitat for pollinators, birds, and other wildlife and by offering additional water quality protection. Tree selection prioritizes large stature trees to provide habitat for raptors and other birds as well as integration of flowering, fruiting, and nut - bearing trees for wildlife food sources. The restoration will include planting more trees than the number of trees removed. The trees planted will be native to Minnesota including shagbark hickory, bitternut hickory, basswood, white oak, bur oak, sugar maple, American elm (Dutch Elm Disease -resistant), serviceberry, blue beech, black cherry, tamarack, and white pine. The tree species selected for restoring this area will ensure the privacy buffer is quickly reestablished after the invasive species and ash trees are removed. The image on the following page shows what the buffer will look like once re -planted trees are established. Two additional areas will be restored with native prairie plant species with an emphasis on creating pollinator habitat. The larger area will be about 1/4 of an acre running nearly the entire length of the eastern side of the site between the vehicle/trailer parking and North Shore Drive, as shown in the rendering on page 3. The second area targeted for restoration is adjacent to the natural shoreline south of the seawall. Currently, both areas are comprised of turf grass that is regularly mowed. Restoration of these areas will reduce maintenance needs while providing valuable habitat for pollinators and an attractive flowering landscape for site users and neighbors. The county serves as the Soil and Water Conservation District (SWCD) for Hennepin County and has extensive experience restoring and maintaining natural areas across the county, including at the Lake Minnetonka access in the City of Spring Park. 13 102 The existing cattail shoreline on the western border of the site will remain untouched and the adjacent upland shoreline will be improved with a native shoreline planting. View of tree and shrub buffer following establishment Wetland impacts What we heard from residents Residents were concerned that wetland areas would be negatively impacted by the project. Background As described in the site history section, this site was once open water, then filled and eventually paved. Wetlands are protected because they provide tremendous stormwater management, flood prevention, groundwater recharge, and habitat value. Under the Wetland Conservation Act (WCA), it is the Minnehaha Creek Watershed District's (MCWD) responsibility to review the project for wetland impacts. As part of the initial WCA review for the project, MCWD used the word "wetlands" to describe the sedimentation basins that were added in 1996 and a portion of the bay that is outside of the project area. Residents were understandably concerned that there would be wetland impacts because of this project. After a site visit, MCWD determined that the sedimentation basins are not wetlands protected by the Wetland Conservation Act, and the bay is outside of the project area. The bay will continue to be protected and preserved. Proposed solution 14 103 The MCWD has since issued the project a "no loss" decision, declaring that no regulated wetlands will be impacted by this project (see appendix). Care will be taken during construction to ensure that activities do not negatively impact the cattail marsh, bay, and adjacent lake. Site lighting What we heard from residents Some residents expressed concerns that the additional lighting included in the redesign will add too much light to the site. Background There is currently only one light at the site. Proposed solution The site redesign includes three short light posts that adhere to the Starry Skies North guidance to reduce light pollution. Light poles will be shorter (20 feet tall instead of 30+ feet) with light fixtures that are adjustable for brightness and hours of use. The county proposes having the lights shut off at 10 p.m. The county will continue to monitor how this solution works in practice and can further adjust the lighting approach based on feedback from neighbors, site users and the city. User fees What we heard from residents Some residents have asked if the county could charge user fees to restrict certain types of access, such as commercial barges and boat rental companies. Background As discussed in the section on commercial access, any restrictions or regulations would require an ordinance, which would be a lengthy process to enact. The county is exploring a cost -share partnership on this project with DNR. Adding user fees for the ramp access would preclude any partnership with DNR as no state managed or co -managed accesses can charge fees. Proposed solution The county will continue to operate this public access without user fees. Road access to the site What we heard from residents Some residents expressed safety concerns regarding the entrance/exit from North Shore Drive, reporting it was a tricky site to get in and out of. Background While North Shore Drive is a county -maintained roadway, improvements to the road and entrance/exit are not part of the project scope. County Transportation staff were not aware of 15 104 any concerns raised recently or in the past. There has been 1 reported segment crash near the boat launch driveway over the last 10 years. Proposed solution Transportation staff will continue to monitor traffic and crash data and consider changes as data is evaluated. Nonmotorized boat launch What we heard from residents Residents expressed safety concerns with the siting of the nonmotorized boat launch. Proposed solution In response to concerns, the county has moved the nonmotorized boat launch from between the boat launch and fishing area to the other side of the boat launch, adjacent to the ADA boat lift, which should be a safer spot for launching nonmotorized watercraft away from Hendrickson's Channel. PERMITTING PERMIT / STATUS AGENCY PERMISSION Lake Municipal Preparing Submission. A New Municipal Dock License Minnetonka Multiple Dock application will be submitted in April. Conservation License District (LMCD) Metropolitan Work over Preliminary Approval. A permanent sanitary sewer Council Permanent easement crosses the site and an agreement between the Sanitary agencies specifies no land use changes can be made over Sewer the easement without consultation. Metropolitan Council has Easement reviewed preliminary plans and provided feedback that's been incorporated into the current design. The Council has provided approval for the project to proceed. Minnehaha Shoreline and Approval Anticipated. Designs were adjusted to address Creek Streambank comments from MCWD in their November 13, 2025 letter and Watershed Stabilization from conversations with the DNR Area Hydrologist (Ryan District Rule Toot), including reducing fishing pods' lakeward extent (MCWD) along Hendrickson's Channel and to promote additional natural shoreline. 200 feet of natural shoreline will be enhanced along the western edge of the site. Stormwater Approval Anticipated. Designs were revised in December - Management January to meet District -requested changes, including Rule ensuring a minimum necessary separation between the bottom of the stormwater facilities and the groundwater surface. Wetland Permit with Notice of Decision received on January 30, 2026. Protection Minnesota Wetland Conversation Act No Loss Decision - and WCA Rule determination that no regulated wetlands will be impacted by this project. Minnesota Public Water No Permit Anticipated. No issues are anticipated. 18 107 APPENDIX Community Engagement Summary Pre -project scoping and project kick-off With the deterioration of the pavement and boat launch, the county identified the need for an asset preservation project. County staff began asking access users what features were most important and how the public access could be improved. The county began considering options for modernizing the access in 2021 and completed a stormwater analysis in 2022. The county board approved a budget of $3.5 million for upgrades to the site in 2023. In 2024, a preliminary design was developed for community input. Design: Phase I This initial design was presented at an open house at the City of Orono on October 2, 2024. The county encouraged residents and partners to attend through direct mail to all North Arm Bay residents, digital message boards at the access, outreach at the access, emails to stakeholders, posts on Nextdoor, and a news release shared through community newspapers. The October 2024 open house attendees included residents who live near the access and representatives from the Lake Minnetonka Association, Minnesota DNR, Lake Minnetonka h Conservation District, Hennepin County Sheriff's Office, and the Orono City Council. Comments were also received via email following the open house. Attendees shared feedback on topics including the access design, fishing, boating, parking, signage, and waste management. The county produced a feedback summary to answer questions, explain how the access design or management addresses the feedback, and outline how the county is incorporating suggestions. Read the detailed summary of feedback received at the October open house (PDF, 1Mb_. Design: Phase II Feedback was reviewed by the design team and incorporated into updated design plans. The revised plans were presented at a second open house in Orono in January 2025 and then again at a virtual open house in February 2025. Timeline The design for the access is being developed now, and construction will take place fall 2025 through spring 2026. Construction will be done in phases and will prioritize maintaining public access during the busiest fishing and boating season. Planned improvements Realigning the boat launch so that it doesn't require a backing turn • Angling the parking to improve parking lot safety and navigation • Adding lake access for canners, kayakers, and paddleboarders Making improvements for shoreline anglers • Incorporating climate and resiliency features, including redesigning the stormwater management system and adding solar Postcards sent to neighbors in January 2025 Attendees of the January and February open houses included residents who live near the access and representatives from local businesses, nonprofit organizations, and local government. Attendees shared feedback on topics including the access and parking, commercial usage and vertical access point, landscaping and stormwater management, and waste management. Attendees had general questions about the project process and requested a map that better compares the current state of the access with the new concept. The county produced a feedback summary to answer questions, explain how the access design or management addresses the feedback, outline how the county is exploring or incorporating suggestions, and explain the project process and next steps. Design: Phase III Following these two open houses, the county incorporated community and stakeholder feedback into revised designs that were shared with partners and permitting authorities in summer and fall 2025. One of the major changes made to the initial design was the removal of a separate vertical access for commercial use. Currently, commercial and recreational users share the boat launch, which has accelerated wear and tear on the ramp. Feedback from residents indicated providing a separate boat launch for commercial use gave the impression that the county was interested in increasing or expanding commercial use at the site. The county was seeking to increase safety while reducing wear and tear on the boat launch. Recreational users and their safety are the county's primary focus for the redesign of the site. 20 109 Planning Commission Hennepin County's application materials were submitted to the City of Orono on October 28t", 2026. County staff attended a pre -submittal meeting with city planning staff at Orono City Hall to discuss application needs, review design details, and discuss Planning Commission meeting logistics. Prior to the Planning Commission meeting, City staff requested and were provided additional information on the application and design details. The plan was presented November 17, 2025 at the city's Planning Commission meeting. This proposal includes a summary of the questions raised at the commission meeting and the county's proposed solutions. The existing use as a public boat access is considered to be legally nonconforming, as it existed prior to the City's zoning regulations adopted in 1975. The parcel is bisected by undeveloped, platted rights -of -way. The LR-1 C residential zoning district provides for uses such as medium -density residential development, limited agricultural activity, and other compatible uses. According to Orono's Comprehensive Plan, the property's existing land use is classified as: Park, Recreational, and Open Space. The current use of the property as a public boat landing appears to be consistent with the existing and future land use guidance within Orono's Comprehensive Plan. The County's proposed project focuses on safety, accessibility, and environmental improvements. The project scope includes the following: • Reconstruction of the parking lot area and boat launch, • Redesign of fishing areas and walking paths, • Improvement of the AIS decontamination areas and installation of a shade structure to support the inspection program, • Installation of an ADA-accessible lift for lake access, 111 • Reorientation of refuse containers to better accommodate fishing activities, • Improved stormwater management across the site, and • Removal of invasive vegetation and establishment of native plantings, including new screening along adjacent residential areas. 4. The commission recommended denial of the application, citing the following comments: • Clarify the overall site goals and how the project meets the practical difficulty standards • Address concerns regarding commercial and industrial activity on the site, including mitigation of heavy equipment use on the site • Revise the location of the nonmotorized boat launch • Provide additional detail regarding the proposed landscape plan • Clarify garbage management on site • Submit the notice of decision from MCWD, and • Respond to the comments regarding the implementation of user fees at the site. 5. Public Comment: Multiple public comments were submitted to the Planning Commission (Planning Commission Written Public Comments: Herman, Jabbour, Niccum). Many members of the public also attended and spoke at the Planning Commission Meeting. Overall, there were questions about the use of the property, garbage, screening, access, landscaping, and the overall management of the site. One new comment from the public was received on March 18, 2026; the comment is attached as an Exhibit V for the Council's consideration. 6. Staff Recommendation: Staff is asking the Council to provide direction to draft a resolution to bring forward at a future council meeting. Staff recommends conditional approval of the application, conditioned on the following: 1. For the reasons set forth below, the County has not met the approval criteria stated in the City's zoning ordinance for variances or conditional use permits. This is because the Boat Landing is not a legal nonconforming use, at least not to the extent that the County claims. For this reason and the additional reasons set forth below, the City Council should therefore deny the County's application. To the extent it approves those applications, the City Council should impose rigorous conditions that require the County to eliminate the nuisance conditions and extensive unlawful commercial/industrial uses currently present at the Boat Landing site. I. THE NORTH ARM BOAT LANDING IS NOT A LEGAL NONCONFORMING USE. The County is not eligible for the variances and conditional use permit it requests from the City because a boat landing is a not a permitted use in an LR-1C zoning district. The report of the City planning staff states that the "existing use as a public boat access is considered to be legally nonconforming, as it existed prior to the City's zoning regulations adopted in 1975." 1 Staff Report I One of the undersigned attorneys, Bruce D. Malkerson, was Orono's City Attorney from 1973 until 1984 during which time the City first adopted the zoning ordinance provisions at issue here. 116 Mayor and City Council Members City of Orono May 19, 2026 Page 12 dated March 13, 2026, p. 1. Implicit in this statement is an assumption that the Boat Landing's purported status as a legal nonconforming use allows the County to satisfy the approval criteria for variances and conditional use permits stated in the City's zoning ordinance. The statement that the Boat Landing is a legal nonconforming use is incorrect, or at the very least incomplete. The Boat Landing is only a nonconforming use to the extent of its use prior to 1975. However, the intensity of the use of the North Arm Boat Landing has expanded dramatically since 1975. Prior to 1975, the Boat Landing was used exclusively for the launching of personal watercraft by a limited number of local residents. Now, the number of personal watercraft users has expanded dramatically from the number using the Boat Landing in 1975. More importantly, the Boat Landing is now used extensively by industrial and commercial users, many of which use the Boat Landing for purposes which are entirely unrelated to boating or even Lake access. For example, construction companies use the Boat Landing to stage construction vehicles and materials. Commercial haulers also use the Boat Landing for storage and staging of semi -truck trailers. There was voluminous evidence of this submitted by Mr. Jabbour and other concerned Orono residents at the public hearing conducted by the City Planning Commission and at the public meetings on the County's application conducted by the City Council. Such uses were not present at the site in 1975 or before. Accordingly, they are not legal nonconforming uses of the site now. The City's zoning ordinance makes it clear that expansion of legal nonconforming uses is not allowed in the City. The ordinance clearly states that "[a]ny structure or use lawfully existing upon the effective date of the ordinance from which this section is derived shall not be enlarged, expanded, extended or altered in any manner which increases its nonconformity....". City Code, § 6.12.310(a)(2); see also City Code, § 6.12.310(b)(8) ("Expansion of nonconforming uses. Nonconforming uses may not be expanded or enlarged. ,). 2 These provisions are consistent with the treatment of legal nonconforming uses in Minnesota's municipal zoning statute. See Minn. Stat. § 462.357, subd. le(a) (2025) (nonconforming uses may be continued but not expanded). The County has unlawfully expanded use of the Boat Landing since the City adopted its zoning ordinance in 1975. The Boat Landing is therefore not a legal nonconforming use, at least not to the extent that commercial and industrial users occupy the Boat Landing. As set forth below, these unlawful uses of the Boat Landing disqualify it from receiving the variance and conditional use permit approvals sought by the County. The City Council should therefore deny the County's applications or, at the very least, impose rigorous conditions as allowed by the governing statute and ordinance provisions. 2 The City's zoning ordinance requires that "[a]ll nonconforming uses actually and legally existing on December 1, 1974, shall be issued a conditional use permit upon application not later than January 1, 1976. Such conditional use permit shall allow the continuation of the nonconforming use to the same extent and degree as then existing on December 1, 1974." See City Code, § 6.12.4130. There is nothing in the record that suggests that the County applied for and received a conditional use permit from the City prior to January 1, 1976 as the City's ordinance requires. 4897-4594-8249, v. 2 117 Mayor and City Council Members City of Orono May 19, 2026 Page 13 II. THE COUNTY HAS NOT ESTABLISHED PRACTICAL DIFFICULTIES SUFFICIENT TO SUPPORT THE GRANTING OF ZONING VARIANCES. The County is applying for three zoning variances, the first to allow site hard cover in excess of the 25% maximum allowed by the City's zoning ordinance; the second to allow hard cover within the 75-foot lakeshore setback; and the third to allow structures within the 75-foot lakeshore setbacks. The County has not established that it is entitled to these variances, and the City Council should not approve them. To the extent it does, it should impose rigorous conditions as allowed by the governing statute and ordinance provisions. The applicant for a variance must propose "to use the property in a reasonable manner." City Code, § 6.12.530(a)(1); Minn. Stat. § 462.357, subd. 6(2) (2025). Here, the County proposes to continue use of the Boat Landing as it has in the past, with no efforts to restrict use of the Boat Landing by commercial and industrial companies and vehicles which have no right to use the site. The City may not permit as a variance any use that is "not permitted under this chapter for property in the zone where the affected person's land is located." City Code, § 6.12.530(a)(6); Minn. Stat. § 462.357, subd. 6(2) (2025) and In re Stadsvold, 754 N.W.2d 323, 329 (Minn. 2008) (holding that "use variances" are prohibited by law). As noted, boat landings are not permitted uses in LR-IC zoning districts. To the extent that the Boat Landing is a legal nonconforming use, this is only the case "to the same extent and degree as then existing on December 1, 1974." As noted above, there has been a dramatic expansion of the use of the Boat Landing since that date. Most significantly, the Boat Landing is now used by commercial and industrial users (often for purposes which have nothing to do with boating or Lake access). This is not permitted by the City's zoning ordinance. Therefore, the County is not eligible for a variance under the approval standard established by the City's zoning ordinance or the state municipal zoning statute. If the County will do nothing to restrict activity at the Boat Landing to the activities existing in 1975, then it is neither proposing to "use the property in a reasonable manner" nor proposing to use the property for a use permitted by the City's zoning ordinance. For this reason, it is not eligible for the requested zoning variances, and the City Council should deny the County's applications. III. THE COUNTY HAS NOT MADE A SHOWING THAT IT IS ENTITLED TO A CONDITIONAL USE PERMIT. The County is requesting a conditional use permit to install a seawall within a shoreland area. The City may only grant a conditional use permit upon "a showing by the applicant that the standards and criteria stated in the ordinance will be satisfied." Minn. Stat. § 462.3595, subd. 1 (2025). The County has not made such a showing here, and the City Council should not approve its application. 4897-4594-8249, v. 2 118 Mayor and City Council Members City of Orono May 19, 2026 Page 14 To the extent it does, it should impose rigorous conditions as allowed by the governing statute and ordinance provisions. The provision of the City's zoning ordinance relating to conditional use permits requires that a proposed conditional use be "[c]ompliant with the zoning code." City Code, § 6.12.4090(a)(2). As noted above, boat landings are not permitted uses in LR-1C zoning districts. To the extent that the Boat Landing is a legal nonconforming use, this is only the case "to the same extent and degree as then existing on December 1, 1974." As noted above, there has been a dramatic expansion of the use of the Boat Landing since that date. Most significantly, the Boat Landing is now used by commercial and industrial users (often for purposes which have nothing to do with boating or Lake access). This is not permitted by the City's zoning ordinance. Therefore, the County is not eligible for conditional use permit under the approval standards established by the City's zoning ordinance. The provision of the City's zoning ordinance relating to conditional use permits also requires that a proposed conditional use be "[a]dequately served by police, fire, roads, and stormwater management." City Code, § 6.12.4090(a)(3). Here, the County refuses to police its own boat landing site, which has resulted in extensive use of the Boat Landing by commercial and industrial users. The City's police department does not have the capacity to adequately police the site, nor should it be expected to (given that the Boat Landing is owned by the County, which has its own law enforcement services). The absence of adequate policing of the site has resulted in chronic nuisance conditions which include, but are not limited to, overflowing garbage receptacles and obstructions to residents attempting to use the Boat Landing to launch their personal watercraft, notwithstanding that the City's zoning ordinance clearly states that a proposed conditional use may not "create a nuisance." City Code, § 6.12.4090(a)(11). Here the County has allowed nuisance conditions to fester at the Boat Landing which are caused by the absence of adequate police services to prohibit unauthorized use of the Boat Landing by commercial and industrial users. The County has not satisfied the requirements for approval of a conditional use permit, and the City Council therefore should not approve its application. To the extent it does, it should impose rigorous conditions as allowed by the governing statute and ordinance provisions. IV. IF THE CITY GRANTS THE REQUESTED VARIANCES AND CONDITIONAL USE PERMITS, THE CITY SHOULD IMPOSE RIGOROUS CONDITIONS UPON THE COUNTY. The County has not satisfied the approval requirements for its requested variances or its requested conditional use permit. For this reason, the City Council should deny the County's applications outright. Should it choose to grant the County's applications, the City Council should at the very least impose rigorous conditions to ensure that the County properly supervises and maintains the site. 4897-4594-8249, v. 2 119 Mayor and City Council Members City of Orono May 19, 2026 Page 15 Imposition of conditions is allowed by the governing provisions of both Minnesota's state municipal zoning statute and the City's own zoning ordinance. The City may impose conditions on the granting of a variance. City Code, § 6.12.530(b); Minn. Stat. § 462.357, subd. 6(2) (2025). When granting a conditional use permit, the City may grant it "subject to such conditions as the council may prescribe." City Code, § 6.12.4090(b). The City may also elect to grant a conditional use permit "in modified form" different from what is requested by the applicant. City Code, § 6.12.4090(b). Moreover, when granting conditional use permit within a shoreland area, the City's zoning ordinance permits the City to make "[s]pecial provisions for the locations, design and use of structures, ... watercraft launching and docking area, and vehicle parking areas." City Code, § 6.12.6150(2)(c). In other words, the City is allowed to place conditions on the County's use of the Boat Landing if it chooses to grant the County's application for variances and for a conditional use permit. Mr. Jabbour requests that the City deny these applications outright. However, if the City Council chooses to approve them, then Mr. Jabbour requests that the approval be subject to the following conditions: 1. That the County keep the Boat Landing free of nuisance conditions, including but not limited to, accumulation of excessive uncontained refuse at the site and blockage of boat ramps and parking lot driving aisles by commercial or industrial vehicles; 2. That the County restrict use of the Boat Landing and the Boat Landing parking area to parties launching and using personal watercraft; 3. That the County prohibit use or occupation of the Boat Landing parking area by commercial or industrial vehicles or watercraft; 4. That the County employ its own law enforcement personnel and resources as necessary to ensure compliance with conditions 1, 2 or 3, above; and 5. That, if a violation of conditions 1, 2, 3 or 4 continues following 30-days written notice to the County by the City, the County shall forfeit its right to continue use and operation of the site as a boat landing until such time as the violations are corrected. These conditions are eminently reasonable and, if implemented and enforced, will prevent future occurrence of the unauthorized use and nuisance conditions that the County has allowed to fester at the Boat Landing over the years. 4897-4594-8249, v. 2 120 Mayor and City Council Members City of Orono May 19, 2026 Page 16 V. SUMMARY AND CONCLUSION. The Boat Landing may be a legal nonconforming use, but it is only a nonconforming use to the extent it was used prior to 1975. The County is not allowed to expand use of the Boat Landing beyond how it was used in 1975, and the City may not allow such expansion through the approval of zoning variances and conditional use permit requested by the County. Background: The design work for Hackberry Park is a continuation of the park planning completed in 2023. Improving this park has been a city focus for over a decade. In 2016, the city entered into a life estate agreement to gain possession of 140 Hackberry Hill, which was a residential parcel in the middle of the park. The city took possession of the parcel in 2023 and subsequently completed the demolition of the structures on the parcel. At the May 27, 2025, meeting, the City Council approved funding for the design phase of Hackberry Park improvements, but directed staff to conduct community engagement on the site layout prior to proceeding to the detailed design. Community engagement took place in the summer of 2025. The community engagement efforts largely confirmed the stakeholder feedback received during the master planning process of 2023, which focused on keeping green space while providing safer parking and youth sport playing options. The priorities going into the design were to address items that were not up to city standards: field equipment, parking and safety, dead and dying trees, as well as the drainage of the park. The proposed improvements include: keeping both ball fields, keeping the sledding hill, keeping and/or planting trees, keeping picnic tables, safe parking, a multi -use field, pollinator plantings, stormwater improvements, better signage, a restroom/shelter area, and making the park more ADA accessible. The committee developed an updated layout, using feedback, which was presented to the council at the August 25, 2025, meeting. Since then, staff and our consultant, with input from the rest of the design team, have been working through the detailed design process and initiated the necessary permits for other agencies. Bids were received for the Hackberry Park Rehabilitation project on June 4th. 3. Scope: The main project scope includes drainage improvements, infrastructure replacements, reconstruction of the playing fields, safe parking enhancements, and the addition of ADA- accessible paths and support facilities. As requested, we have prepared a scope of services and estimated fee for construction services. Scope of Services We propose to complete the following Hackberry Park tasks: 1. Construction Assistance.................................................................................$95,000 The tasks associated with Construction Assistance will include: • Preconstruction meeting: in -person project kick-off meeting with desired city representation and Bolton & Menk staff to review project, schedule, gather contractor information and establish communication protocol for the project. • Survey assistance (as requested or required) • Permitting assistance ( as required) • Site inspection (half-time for 14 weeks) • Bi-weekly project meetings (on -site) • Shop drawing & pay application review and approval • Miscellaneous project tasks • Project punchlist and closeout Fee Estimate Based on the scope of services described above, we propose a total not -to -exceed fee of $95,000 to be billed on an hourly basis.
