HomeMy WebLinkAboutResolution 3583 � °� � o o � �b. - CITY of ORONO � ti '�' RESOLUTION OF THE CITY COUNCIL ���kE HOg'�G NO. � 5 � � � S A RESOLUTION VACATING A DRALtiTAGE AND UTILITY EASEMENT WITHIN LOTS 2 AND 3, BLOCK 1 OF THE PLAT OF MAPLE PLACE IN THE CITY OF ORONO, HEN�EPIN COUNTY, MYNNESOTA . FILE NO. 2025 WHEREAS,.the City of Orono is a municipal corporation organized and existing under the laws of the State of Minuesota; and WHEREAS, on May 22, 1995, Michael R. Plank filed a petition with the City of Orono requesting the vacation of a 10' wide drainage and ut'ility easement originally dedicated in the plat of Maple Place and legally described as follows: � Drainage and utility easements as dedicated in the plat of Maple Place lying 5' on each side of the common lot line between Lots 2 and 3, Block 1, Maple Place which bears North 62 degrees 24 minutes West for a distance of 441.99 feet, EXCEPT for that part lying within 5 feet on each side of the common lot line between Lots 1 and 2, said Block 1, Hennepin County, Mi.nnesota; and WHEREAS, after due published and posted notice, a public hearing was held before the City's Planning Commission on July 17, 1995 regarding said vacation and all interested persons were given an opportunity to be heard; and WHEREAS, after due standing and consideration, the Planning Commission recommend unanimous approval of the proposed vacation; and � WHEREAS, the City Council of the City of Orono finds that said vacation as proposed is in keeping with the public interest and in consideration of the followin� findings: 1. The drainage and utility easements as shown and dedicated in the original plat of Maple Place will no longer be located adjacent to a lot line as division line has been relocated on property. • Page 1 of 2 . _ . � O� • O . NOW, THEREFORE BE IT RESOLVED, that the petition of Michael R. Plank is hereby granted by the Council of the City of Orono and that the drainage and utility easement legally described above is hereby vacated. Granting of the petition is subject to applicant granting drainage and utility easements along newly defined lot division line within the plat of Maple Place Second Addition.
