APPROVAL OF�A REPLAT OF�
LOTS 2 Ai'�TD 3, MAPLE PLACE

.�I�REAS, Michael R. Plank, l�Iay 22, 1995, filed a formal subdivision �
application with the City for approval of a lot line rearrangement of residential property Iegally
� described as: �
Lots 2 and 3, Block 1, and Outlot A, Maple Place (hereinafter "the groperry"); and
WT�EREAS, after due published and mailed notice in accard�nce with Muinesota
Statutes 462.358 et. seq. and the City of Orono's Zoning and Platting Codec, the Oron.o
Planning Conunission held a public hearing on June 19, 1995 at which time a11 persons clesirin�
( � to be heard concerning this application were given the opportunity to speak thereon; and

. ��]E�EREAS, at their regular meeting hel3 on. July 1�,'1y95, the Orono City
Council considered the subdivision applicatian of a replat of a lot line reazrangernent, no±xng tne '
following fmdings of fact: � �
1. The property is located �vithin the ItR-lA, Single Famil_y Rura1 Residential
Zoning District requiring a minunum af 5 acres of dry Iands, 2 acres of which
must be contiguous within each newly created lot.
2. The properry contains a tota.l of approximately I9.34 acres of which 3.61 a.cres
is wetland. Each proposed lot exceeds the 5 acre mir.inum let area requi�ement:
Lot 1 �
Total area = 13.18 acres, 10.63 dry contiguous acres
. Lot 2
Total area = 6.16 acres, 5.1 dry contiguous acres �
3. In 1988, Lot 2 was tested f�r a princi�al and an altemate septic site'at the time
� of new construction. Both sites have been apgroved by the City. As proposed
Lot 1 has over 10 dry acres, septic testing has not been required.

4. There is 10 acres of dry contiguous lands available for future subdivision of Lot
1 based on current code standards.
NOW, THEREFORE, BE YT RESOLVED, that based upon one or more of the
findings noted above, the City Council of the City of Orono hereby approves the preliminary
plat of a lot line rearrangement of Lots 2 and 3, Maple Place, per the survey dated January 13,
1993 by Ivlark S. Gronberg of Coffin and Gronberg, Inc., subject to the following conditions:
1. Subdivider and future owners are placed on notice that at some time in the future
if Lot 1 is further subdivided that issues of legal access and the required upgrade
of the existing driveway to a private road will be subject to the City standards in
effect at the time of the future subdivision. �
2. Granting of a road and utility easement over Outlot A to the City.
�' 3. Dedication of .95 acres of additional protected wetlands located within proposed
� ... Lot 1. . '
4. Outlot A to be retained in joint or common ownership with Lot 1 and that
subdivider shall be responsible for creating easements and covenants in favor of
Lot 2 over Outlot A. Covenants shall govern Lot 2's responsibility for the share
in maintenance and upkeep of roadway while Lot 2 is served by single access
driveway and at the time of the future division.
The following list of final submittals must be submitted to the Zoning Administrator two
weeks prior to the regularly scheduled Council meeting on the second and fourth Mondays of
the month:
l. Record plat drawings in the form of two (2) mylar copies and one (1) copy
. reduced to 1" = 200'. Drawing to include:
A. Lot lines platted per preliminary survey by Mark S. Gronberg of Coffin
and Gronberg, Inc. dated January 13, 1993.
B. Dedication of "drainage and utility easements" 5' wide on each side of the
� newly defined internal property line.

C. Dedication of new wetland area located within proposed Lot 1 to be
designated as drainage easements on the plat.
D. Designation of a road outlot shown as Outlot A on the prelimi.nary plat
referenced above.
2. � Legal documents required:
A. Title opi.nion addressed to the City. All owners, mortgage holders or
others with property interest indicated therein shall sign the plat and all
other documents affected by such interest.
B. The applicant must provide certified copies of all recorded easements
currently affecting the properry.
''` C. Signed and executed Conservation and Flowage Easement over the newly

- defined wetland designated as a drainage easement within Lot 1 (copies
, of the City's Conservation and Flowage Easement may be obtained at the
Ciry offices).
D. Signed and executed road and utility easement over the private road outlot
. (copies may be obtained at the City o�ces).
E. Subdivider may wish to include easements/covenant in favor of Lot 2
involving use of Outlot A, road outlot, and need to maintain current
driveway as set forth in Condition #4 above.
3. Fees to be paid: Total due: 200.00 for the legal review and filing fees of
� subdivision and additional required documents.
