A RESOLUTION APPROVING
A METES AND B4UNDS
SUBDTVISION OF A LOT LINE REARI2ANGEMEN'T
OF PROPERTIES LOCATED AT
575 OXX�'ORD ROAD AND 565 LEAF STREET
FILE NO. 2021 �
WHEREAS, the City of Orono is a municipal corporation organized and existing
under the laws of the State of Minnesota; and
• WHEREAS, the Ciry Council of the City of Or�no (hereinafter "City Council")
has adopted subdivision regulations for the orderly, economic and safe development of land
within the Ciry; and
WgIEREAS, the City Council has considered the application for a subdivision of ,
� a lot line rearrangement by� James W. Bruce of James Bruce Homes and James T. Hale
(hereinafter "the subdividers ) of properties legally described as foilows:
Lot 2, Block 1, Klitzke Addition and �'""�
� Lot 6, Block 1, Stielows Addition, Hennepin Counry, Minnesota (hereinafter . the � �

WHEREAS, the subdividers have completed all requirements of the City forf�'��
metes and bounds subdivision of a lot line rearrangement for division and combination purpose�

NOW, THEREFORE, BE Td' RESOLVED, that th ty
of Orono hereby approves the metes and bounds subdivision of a lot line rearrangem�
James T. Hale and 7ames W. Bruce as shown on the Certificate of Survey by The��
Kemna, a registered land surveyor of Schoell & Madson, Inc., dated April 24,
attached to this resolution, subject to the following conditions:
1. Upon approval of this subdivision by the City Council, the owner c�. '
1, Stielows Addition must apply to the City for legal comb�
purposes with Parcel B as described in that same survey.

NOW, THEREFORE, BE TI' RESOLVED, that the City Council of the City;
of Orono hereby approves the metes and bounds subdivision of a lot line rearrangement for
James T. Hale and James W. Bruce as shown on the Certificate of Survey by Theodore D.
Kemna, a registered land surveyor of Schoell & Madson, Inc., dated April 24, 1995, and
attached to this resolution, subject to the following conditions:
1. Upon approval of this subdivision by the City Council, the owner of Lot 6, filoc�C
1, Stielows Addition must apply to the City for legal combination for tax
purposes with Parcel B as described in that same survey. �

2. Owner of Parcel A shall grant to the City a 5' drainage and utility easement aiong
the newly defined east lot line.
3. The aforesaid division shown on the attached Certificate of St�rvey shall be filed
by the City of Orono with either the Hennepin County Recorder's Office or
� � Registrar of Titles Office on or before January 10, 1996 together with a certified
original copy of this resolution. .
� 4. The approval granted by this resolution shall expire if the division has not been
, filed by the date specified above. In that event, it will be necessary to file a new
� application with the City of Orono for subdivision review.
Adopted by the City Council of Orono, Minnesota this lOth day July, 1995.
