A RESOLUTION VACATING
A DRAINAGE AND UTII-ITY EASEMENT ,
WITHIN LOT 2, BLOCK 1 OF THE PLAT OF
FOXWOOD SECOND ADDITION, IN THE CITY OF OROTrTO,
HENNEPIN COUNTY, 1bIINiVESOTA
FILE NO. 1990 ,
VVHEREAS, the City of Orono is a municipal corporation orjanized and existin;
under the laws of the State of Muuiesota; and
WHEREAS, on December 22, 1994, Robert W. Carlson fiied a petition with the
City of Orono requesting the vacation of a 35' drainage and utility easement originally dedicated
in the plat of Foxwood Second Addition and legally described as follows:
� a 35' drainage and utility easement as shown on Lot 2, Block 1, Foxwood Second
• Addition, Hennepin County, Minnesota; and
WHEREAS, after due published and posted notice, pubiic hearings were held
before the City's Planning Commission on January 17, 1995 and February 22, 199�, regarding
said vacation and all interested persons were given an opportunity to be heard; and
yVHEREAS, after due standing and consideration, the Planning Commission
recommended approval of the proposed vacation; and
WHEREAS, the City Council of the City of Orono finds that said vacation as
proposed is in keeping with the public interest and in consideration of the following findings:
1. Neither the Ciry nor the MWCC intends to develop a municipal sewer line within
the 35' easement.
2. Location of the easement within the proposed building envelope of the '
undeveloped lot will present problems with the future residential development of
the site.
3. The drainage and utility easement as it exists serves no public purposes.

NOW, TI3EREFOIt�, BE IT RESOLVED, that the petition of Robert W.
Carlson is hereby granted by the Council of the City of Orono and that the drainage and utility
easement legally described above is hereby vacated. Granting of the petition is subject to the
following conditions:
1. Applicar.t to grant a drainage and utility easement to ensure 10' wide continuous
easement exists at the north and south lot lines of Lot 2, Block 1, Foxwood
Second Addition. �
2. Granting of a drainage easement to be taken over the portion of the designated
wetland located within the area of the 35' drainlge and utility easement to be
vacated.
Adopted by the City Council of the City of Orono, Minnesota at a regular meeting
• held on March 13, 1995.
