Recitals
1. Owners have filed Zoning Application# /S -37~/ formally requesting the City to
review plans for a -A

2. Owners request the City to review said plans which requires City approval and may require
consulting legal and/or engineering review.
3. The City is willing to commence its review of the application and incur costs associated with said
review only if the Owners establish an escrow to ensure reimbursement to the City of its costs.
NOW THEREFORE, THE PARTIES AGREE AS FOLLOWS:
1. DEPOSIT OF ESCROW FUNDS. Contemporaneously with the execution of this Escrow
Agreement, the Owners shall deposit $ dS-ttJ 4'1,,1 with the City. All accrued interest, if any, shall be paid to the
City to reimburse the City for its cost in administering the escrow account.
2. PURPOSE OF ESCROW. The purpose of the escrow is to guarantee reimbursement to the City
for all out-of-pocket costs the City has incurred (including planning, engineering, or legal consultant review) or will
incur in meeting with the Owners, revieVjing the plans, and preparing agenda packet material for City Council
review of application # IS -37~ . Eligible expenses shall be consistent with expenses the Owners
would be responsible for under a land use application.
3. MONTHLY BILLING. As the City receives consultant bills for incurred costs, the City will in turn
send a bill to the Owners. Owners shall be responsible for payment to the City within 30 days of the Owners'
receipt of bill.
4. DISBURSEMENT FROM ESCROW ACCOUNT. In the event that the Owners do not make
payment to the City within the timeframe outlined in #3 above, shall cease all reviews until the Owners pay all
expenses invoiced pursuant to #3. The City may draw from the escrow account without further approval of the
Owners to reimburse the City for eligible expenses the City has incurred.
5. CLOSING ESCROW. The Balance on deposit in the escrow, if any, shall be returned to the
Owners when all requirements related to the project are complete. City Staff shall review the terms of this escrow
agreement two times per year to determine whether the requirements of the project have been successfully
completed and whether it is appropriate to return the funds. Owner may also request the release of the funds,
and such funds shall be released upon City Staff receiving the appropriate verification that all requirements of the
project have been successfully completed.
6. CERTIFY UNPAID CHARGES. If the project is abandoned by Owners, or if the eligible expenses
incurred by the City exceed the amount in escrow, the City shall have the right to certify the unpaid balance to th~
subject property pursuant to Minn. Stat. §§ 415.01 and 366.012. \)

AGREEMENT AND SWORN STATEMENT
The work for which this permit is issued shall be performed according to
the approved plans and specifications, applicable City approvals, and the
State Building Code. This permit is for only the work described and does
not grant permission for additional or related work which requires separate
permits. All provisions oflaws and ordinances governing this type of work
shall be compied with whether or not specified herein. This permit will
expire and become null and void if construction authorized is not
commenced within 180 days of the date of issuance, or if construction is
suspended for a period of 180 days at any time after work has commenced.

This is ju lie snyder ,2677 casco point road.
We have submitted a new escrow check for $2500 so we would not have to wait for the city to refund our previous one
and hold up the project. What do we need to do to get the original $2500 escrow check back. I believe you said it is just a
formality but want to be sure that if I need to do anything I get it done .

I received the updated survey yesterday for the project at 2677 Casco Pt Rd. Based on the recent change to our
retaining wall requirements and the extent of your project I do not believe a variance will be required. A building permit
is still required, however, but there will be no 2 month approval delay for council review and approval. I have attached
the code change as well as the building permit application for your use. The $700 variance application fee can be applied
toward your advanced plan review fee and building permit fee (any balance can be refunded).
Please complete the attached building permit application and have the property owner sign the attached escrow
agreement. The project escrow is the same ($2500). Please submit the completed sheets and provide with the
remaining information requested in my April 27th letter (neighbor acknowledgement & permission, engineered design, etc)
for our review to begin.

SUBJECT: Zoning Application #15-3741
The City of Orono is required to notify you within fifteen (15) business days as to the status of your
application for variances for property located at 2677 Casco Point Road. Below is a list of items the
City of Orono is requesting to complete our review:
1) Certificate of Survey. Two (2) original scaled copies of the certificate of survey, as well as a
reduced (11'x17' or smaller), or digital copy which meets the City's survey standards (enclosed) and
specifically indicating the following:
a) the existing structures and/or improvements on the property and within the scope of project area
on neighboring property,
b) all existing hardcover on the property and within the scope of project area on neighboring
property,
c) Existing topographic contours extending 50' past the property boundaries.
2) Retaining Wall Plans. Please submit plans for the proposed retaining walls. Retaining walls 4 feet
in height or greater or tiered walls separated by less than twice the height of the lower wall must be
accompanied by a plan signed by a professional engineer.
3) Hardcover Calculations. All proposed hardcover shall be calculated on the hardcover worksheets
that are enclosed; the hardcover within the scope of project area on neighboring property should also
be calculated on a separate sheet. The hardcover calculations must be completed by your surveyor.
4) Escrow Agreement. The property owner must sign the enclosed escrow agreement. Please
complete the enclosed escrow agreement and submit.
5) Neighbor Acknowledgment and Permission. Please provide a signed statement from the
neighbor regarding their acknowledgment of the extent of the work proposed as well as grants their
permission to work within their property boundaries.
6) Practical Difficulties Documentation Form.
7) Certified Property Owners list. Certified list of property owners within 150' feet of the subject
property, labels and plat map must be submitted. The list, labels and map may be obtained from
Hennepin County Department of Finance, Government Center, A-603 300 South 6th Street,
Minneapolis, telephone 612.348.5910.
