Any Escrow shall be held in a special escrow account and shall be credited to the Owner. 2. PURPOSE OF ESCROW. • Zoning . The purpose of the Escrow is to guarantee reimbursement to the City for expenditures including but not be limited to staff time, at the rates established by the City Council , in excess of that covered by the standa rd application fees, engineering consultant and legal consultant expenses incurred by the City in reviewing and approving the Application and all other city staff admin istrative and consultant services performed in the processing of said review and approval. • Building/Zoning . The purpose of the escrow is to guarantee completion of the site plan as approved and the provision of the as-built survey as required by the Building official. • Accessory Structure . The purpose of the Escrow is to guarantee reimbursement to the City for expenditures including but not limited to staff time , at the rates established by the City Administrator, eng ineering and legal consultant expenses incurred by the City in removing an accessory building if the Owner fails to perform the obligations in Orono City Code Section 78-1432 and all other City staff administrative and consultant services perfo rmed in removing the accessory building, including land stabilization. • ISTS. The purpose of the Escrow is to guarantee reimbursement to the City for expenditures including but not be limited to staff time , at the rates established by the City Council, in excess of that covered by the standard application fees, engineering consultant and legal consultant expenses incurred by the City if Owner for any reason is unable or unwilling to honor the requ irements of Chapter 58 of the Orono City Code, and all other city staff administrative and consultant services performed in relating to the Application . The City may also reimburse itself for all engineering and legal expenses associated with the construction , removal, alteration, or repair of the ISTS if the Owner fails to do so . • Temporary Certificate of Occupancy. The purpose of the Escrow is to guarantee completion of exterior improvements (driveway, grass , etc.) that cannot be accomplished due to weather conditions . The City will monthly forward to the Owner a statement and bill for the expenditures incurred by the City for staff and consultant services. Such statements shall be due and payable within 15 days for receipt by the Owner. No statement will be sent if there are no expenses incurred in the period since the most recent statement. The City shall itemize all time, services, and materials billed to any Owner and said time, services, and materials shall be in accordance with the rules, regulations , and fees as promulgated and adopted by the City Council. 4. DISBURSEMENT FROM ESCROW ACCOUNT. In the event the Owner does not make payment the City as required under paragraph 3, the City may draw from the Escrow without further approval of the Owner to reimburse the City for eligible expenses the City has incurred . The City shall periodically notify the Owner of the draws the City has made and the nature of the expense for which the reimbursement is being made. 5. REIMBURSEMENT OF ESCROW. The Owner shall reimburse the Escrow fund for any deficits caused if the amount actually expended by, or billed to, the City exceeds the escrow fund balance . 7. NO INTEREST PAID. All accrued interest, if any, shall be paid to the City to reimburse the City for its cost in administering the Escrow account. 8. CLOSING ESCROW. Commissioner Jon Schwingler arrived at 6:39 p.m. NEW BUSINESS 1. APPROVAL OF AUGUST 21, 20 17 Leskinen m d, Lemke seconded, to approve the minutes of the on meeting as submitted. VOTE: Ayes 4, Nays 0. 2. #17-3965 GORDON JAMES ON BEHALF OF DAVID AND LYNN GUTERMUTH 2665 CASCO POINT ROAD, VARIANCES, 6:31 P.M. -6:48 P.M. Oakden stated the applicant is proposing to reconstruct a new single-family home on this site and is requesting the following variances : I . Setback variance for construction of the new retaining walls within 7 5 feet of the OHWL ; 2. Hardcover variance to exceed the 25 percent limitation by 171.25 feet; 3. Lot area and lot width variances. The applicants are working with Gordon James Construction to reconstruct their new home . Along with the retaining walls will be stairs. The applicants are proposing to bring the hardcover down to 26.3 percent, which would still exceed the City's 25 percent hardcover. Current hardcover is at 40 percent . Structural coverage meets the City 's requirements. The lot does not meet the minimum Jot size for the LR-lC zoning district. Oakden noted retaining walls are not permitted within 75 feet of the lake. The applicant is proposing to install new stairs to gain lake access and install new retaining walls to support the stairs . Stairs are permissible. The applicant is hoping to be proactive in protecting the trees, vegetation, and shoreline on the property with the retaining walls. The walls as proposed will range from one to six feet in height. Because some of the walls will exceed four feet in height, engineered design is required. Staff finds that there are practical difficulties inherent to the lot shape, size , and the drainage and erosion that have taken place in the lake yard. The applicant has provided a landscape improvement plan which appears to offer relief to the shoreline and lake yards on the property. The applicants have not provided clear practical difficulties to support a hardcover variance . Page 1 of 21 MINUTES OF THE ORONO PLANNING COMMISSION MEETING Monday, September 18, 2017 6:30 o'clock p.m. Staff recommends approval of the requested lot width, lot area, and lake yard setback variances contingent on the applicant providing plantings to screen the retaining walls from the lake view. Staff recommends denial of the hardcover variance or submittal of revised practical difficulties which meet the variance criteria and support the granting of the variance. The Planning Commission had no questions for Staff. John Van Dyke, Gordon James Construction , stated they have been working with the property owners to bring the hardcover below 30 percent. Approximately two years ago the neighbor to the south had their back yard regraded and as a result there is a lot of runoff coming onto the Gutemuth' s property. Van Dyke indicated they will lose one of the large maple trees due to erosion and they have experienced a lot of silt buildup behind the boathouse. The property owners previously had been able to walk down the slope to the lake but that is no longer the case due to erosion. Van Dyke stated they worked hard to try to get under the 25 percent hardcover limit, but because of some of the existing conditions, they are not able to do that. Thiesse asked if there is any natural way of maintaining the slope and reducing the erosion without the retaining walls. Van Dyke stated in his opinion it would be pretty difficult to do and that a retaining wall system appears to make the most sense . Leskinen asked if a reduction in hardcover could be made somewhere else on the property to eliminate the 1 71 .25 feet. Van Dyke indicated they could look at that and that the property owners' desire was to at least maintain the path around the house , landscaping and deck . Van Dyke noted the stairs have added to the hardcover on the ot. Thiesse asked if the wall between this property and the neighboring property to the south will stay. Van Dyke stated they are not planning on touching it. Schoenzeit asked why the house could not be moved closer to the street to reduce some of the driveway hardcover. Van Dyke stated they probably could relocate the house slightly, but since they are on the lake, they would like to take advantage of the view. Chair Thiesse opened the public hearing at 6:43 p .m. Will Hack, Gordon James Construction, stated they are dealing with a situation that did not exist when the Gutermuths purchased the property in 2008. Hack stated he appreciates the questions about the hardscape and that a lot of effort has gone into positioning the house for effective spacing from the street. In addition , the driveway has been narrowed down as much as possible to reduce hardcover but still allow cars to enter the property and be set back from the street. Across Casco Circe , Hack noted some of the Page 2 of 21 MINUTES OF THE ORONO PLANNING COMMISSION MEETING Monday, September 18, 2017 6:30 o'clock p.m. cars sit in an easement area and that the proposed driveway for this property allows those cars to be moved out of that area. Hack stated the homeowners have indicated when they first purchased the property there was not a need for stairs and that erosion has resulted in the need for the steps in order to access the lake as well as help stop the erosion. Hack noted the stairs are an integral part of the solution. Hack stated as it relates to the photographs that were submitted, it is difficult to capture the funnel effect coming from the neighboring property. Hack noted there is a swale that comes out of the neighboring property onto this property. Hack noted the picture on the screen depicts the silt being deposited at the back of the boathouse, which did not exist until a couple of years ago. Hack pointed out the funnel in the back yard. Hack noted that funnel has caused a tremendous amount of erosion in a short period of time and that they are attempting to alleviate that water and erosion. Hack stated the stairs are part of the integration of the erosion control and to provide a degree of safety for someone walking down the hill . Chair Thiesse closed the public hearing at 6:45 p.m . Thiesse stated in his view the applicants have demonstrated a practical difficulty with the erosion and that the retaining walls are to fix the existing conditions. Thiesse noted there are currently stairs down to the lake and that they are replacing those. Lemke stated in his view the proposal makes sense and that there are some circumstances with the property that were not caused by the owners and they are attempting to address them. Lemke noted the owners are also reducing the existing hardcover substantially. Leskinen indicated she does not have a problem with the lot area and lot width variances and that she can somewhat see the need for the retaining walls but that she would like to see the hardcover reduced somewhere else on the property. Thiesse stated some of the easiest places to reduce hardcover are in the driveway and sidewalks. Thiesse stated reducing the driveway might meet the City's requirements but at some point could cause the driveway to be less functional. Leskinen noted the hardcover is coming down substantially from what exists currently. Schoenzeit stated as a package it works . Schwingler indicated he is in agreement. Lemke moved, Schoenzeit seconded, to recommend approval of Application No. 17-3965, Gordon James on behalf of David and Lynn Gutermuth, 2665 Casco Point Road, granting of lot area, lot width, hardcover, and setback variances. They are requesting lot area and lot width variances which would allow them to reconstruct a new home on a lot that does not meet the minimum ·-requirements of the LR-lC zoning district. They are requesting a variance to add retaining walls within the 75 foot lake yard setback to address concerns with water and drainage . Along with the retaining walls they will adding stairs for access and additional planting throughout the yard . The current site currently has 40% hardcover. The Gutermuths and Gordon James worked to design a home that would not exceed 20% structural coverage. They are requesting a hardcover var iance at this time to permit hardcover 171.25 square feet over the maximum allowed (25%) to accommodate the home and other site improvements. Therefore the applicant is requesting a setback 'ti\)· variance. With the walls the applicant is hoping to be .{)XU proactive in protecting the trees, vegetation, and shoreline on the property. The walls as proposed range from 1 to 6 feet in height, engineered design is required. Site pictures are included in the packet to illustrate the existing drainage and slope issues on the site. Hardcover Variance (78-1700) This property is located in the Tier 1 of the Stormwater Overlay District which permits a maximum of 25% hardcover on the lot. The applicant is proposing 26.33% hardcover which is 171.25 square feet over the allowed amount. Lot Area and Width Variance (78-350) Zoning Code Section 78-72 provides options for the redevelopment of lots which do not meet the minimum area or width requirements for the respective zoning district. Substandard properties within the Shoreland Overlay District, like the subject lot, are able to be redeveloped without variances if specific standards are met; such as: 1. All setback requirements can be met. wJ 2. A Type 1 sewage treatment system consistent with Minnesota Rules, chapter 7080, can be ~ installed or the lot is connected to a public sewer; and 3. The impervious surface coverage meets all hardcover location and square footage restrictions of this chapter and the total square footage of hardcover does not exceed 25 percent of the entire lot area. 4 . All other zoning district standards can be met . The applicant's request for the lake yard setback and hardcover variances result in the property's inability to conform to numbers 1, 31\ and 4 above. Therefore, lot area and width variances are also required in order to redevelop the property . • Included in packet is the ananlyss for the practical difficulties . Minnesota State Statutes Section 462 .357, Subdivision 6(2) requires that practical difficulties be demonstrated in order for a variance to be granted. We are hoping to demolish our existing home and rebuild a new home on this site . Our current hardcover percentage is 40.88%. If we were allowed to move forward with this project our new hardcover percentage would be 26.33%. While this is significantly lower than our current hardcover we recognize that this is still exceeding the standard 25% allowed in the city code. We have designed a house and site plan that would keep us at or below 25% hardcover if we did not need to rectify current erosion issues to our property. About 2 years ago the neighbor adjacent to us on the south, 2677 Casco Point Rd, had significant re­ grading done to the lakeside portion of their yard. This project was approved by the city. The result of this regrading is that we now have much more significant storm water runoff spilling into our property from their property . This run-off has eroded the root system of at least one of our trees at the base of the hill. This run-off has also caused a great amount of silt build-up at the base of our hill as well. Some of this silt has and will continue to spill into the lake. Additionally, because of the erosion it is no longer safe to walk down the hill. Due to this issue, we would request a variance for the purpose of eliminating the erosion and protecting our land and the lake quality. The best method for achieving this result is a retaining wall system and added steps that accompany the retaining wall system. This adds 2 hardships for us -a greatly increased expense and extra hardcover that we would have preferred to avoid . We are asking for a variance approval at a much greater cost to us in order to ensure better water quality and to rectify the issues caused by the landscaping previously done at 2677 Casco Point Road . The purpose of the Escrow is to guarantee reimbursement to the City for expenditures including but not be limited to staff time, at the rates established by the City Council, in excess of that covered by the standard application fees, engineering consultant and legal consultant expenses incurred by the City in reviewing and approving the Application and all other city staff administrative and consultant services performed in the processing of said review and approval. • Building/Zoning. The purpose of the escrow is to guarantee completion of the site plan as approved and the provision of the as-built survey as required by the Building official. • Accessory Structure. The purpose of the Escrow is to guarantee reimbursement to the City for expenditures including but not limited to staff time, at the rates established by the City Administrator, engineering and legal consultant expenses incurred by the City in removing an accessory building if the Owner fails to perform the obligations in Orono City Code Section 78-1432 and all other City staff administrative and consultant services performed in removing the accessory building, including land stabilization. • ISTS . The purpose of the Escrow is to guarantee reimbursement to the City for expenditures including but not be limited to staff time, at the rates established by the City Council, in excess of that covered by the standard application fees, engineering consultant and legal consultant expenses incurred by the City if Owner for any reason is unable or unwilling to honor the requirements of Chapter 58 of the Orono City Code, and all other city staff administrative and consultant services performed in relating to the Application. The City may also reimburse itself for all engineering and legal expenses associated with the construction, removal, alteration, or repair of the ISTS if the Owner fails to do so. • Temporary Certificate of Occupancy. The purpose of the Escrow is to guarantee completion of exterior improvements (driveway, grass, etc.) that cannot be accomplished due to weather conditions. Variance Application -January 2017 Page 9 3. MONTHLY BILLING. The City will monthly forward to the Owner a statement and bill for the expenditures incurred by the City for staff and consultant services. Such statements shall be due and payable within 15 days for receipt by the Owner. No statement will be sent if there are no expenses incurred in the period since the most recent statement. The City shall itemize all time, services, and materials billed to any Owner and said time, services, and materials shall be in accordance with the rules, regulations, and fees as promulgated and adopted by the City Council. 4 . DISBURSEMENT FROM ESCROW ACCOUNT. In the event the Owner does not make payment the City as required under paragraph 3, the City may draw from the Escrow without further approval of the Owner to reimburse the City for eligible expenses the City has incurred . The City shall periodically notify the Owner of the draws the City has made and the nature of the expense for which the reimbursement is being made . 5. REIMBURSEMENT OF ESCROW . The Owner shall reimburse the Escrow fund for any deficits caused if the amount actually expended by, or billed to, the City exceeds the escrow fund balance. 7. NO INTEREST PAID. All accrued interest, if any, shall be paid to the City to reimburse the City for its cost in administering the Escrow account. 8. CLOSING ESCROW.
