I wanted to update you on a code change. Please see the attached ordinance adopted in February of this year. This
code change allows for a staff approval of a retaining wall within 5-feet of lot lines. Based on my review of your project
and this code amendment [Section 78-1405 (5.1)(c)], your project no longer requires a variance.
Please note, the comments submitted below by your neighbors the Essens will be incorporated into the conditions placed
upon the administrative zoning permit to construct the wall and conduct the grading.
If you have questions please let me know, but your project no longer requires a setback variance. Your application fee
will be refunded following the subtraction of any costs incurred to date, most likely publication fees, etc. The escrow will
continue to be held until the completion of the garage and possibly the wall project as well depending on your timing.

Melanie, Thanks for returning my call. As we discussed if Eric's variance is approved I remain concerned about
the management of water run off from the new garage and side yard in a 3 foot setback. Eric and I have talked
about my concerns and he is in agreement to do anything reasonable to satisfy the City and me. I have reviewed
the plan and if the City is going to approve the variance the plan should be modified to include two items. In
addition to the swale in the 3 foot setback as detailed in the plans, Eric will do two things. One is to put gutters
and downspouts on the garage directing the water toward the existing driveway and the street/storm sewer. The
second is to place an adequately sized catch basin behind the retaining wall where it meets the south east comer
of the new garage. Any water collected in the catch basin would be piped down to the bottom of the wall, turn
the pipe 90 degrees and discharge the water through the wall at this lower level away from the property line. To
assure the water flows toward the catch basin the soil along the property line would be properly contoured.
Also Eric has talked about installing a fence along the property line. With a 3 1/2 to 4 foot drop behind the
retaining wall a fence is a necessary safety concern. It should be designed and installed so it will not interrupt
the water run off in the swale.
I think this is a reasonable request that adds two layers of protection against runoff.
Please review this and let me know if it would be acceptable to the City engineer.

ORDINANCE NO. 139, THIRD SERIES
CITY OF ORONO
HENNEPIN COUNTY, MINNESOTA
AN ORDINANCE AMENDING
SECTIONS 78-1405 AND 78-1 OF THE ORONO ZONING CODE
REGARDING RETAINING WALL AND LANDSCAPE STRUCTURES
AS A NONENCROACHMENT
THE CITY COUNCIL OF ORONO ORDAINS:
SECTION I. Section 78-1405(a) Nonencroachments of the City of Orono Zoning
Ordinance is hereby amended by adding the following:
.. (5. I) Retaining walls, subject to the following provisions:
a. Retaining walls may be located in all required yards when all of the following
conditions are met:
1. The structure is located at least 10 (ten) feet from the edge of the traveled
roadway;
2. The structure is not located within a drainage, utility, or other easement, except
upon approval in writing for an encroachment agreement by the city; or similar
approval from another regulatory and/or utility agency;
3. The structure creates no impacts to drainage direction, rate or volume for
adjacent prope11ies.
b. Retaining walls which do not exceed 2 (two) feet in height above existing grade,
which are located within the property and at least 5 (five) feet from any property
line, and for which the amount ofimpo11ed fill associated with the structure does not
exceed 20 (twenty) cubic yards, do not require a building or land alteration pennit.
c. Retaining walls exceeding 2 (two) feet in height above existing grade or for which
the amount of imported fill associated with the structure exceeds 20 (twenty) cubic
yards or which are located less than 5 (five) feet from a property line, shall require a
land alteration pennit and upon recommendation of the building inspector may
require city council review or a conditional use pennit per the provisions of Section
78-967.
d. Retaining walls exceeding the allowed height of a fence in a given required yard
shall be located so as to meet the required accessory structure setbacks established
for that yard."
SECTION 2. Section 78-1, Definitions of the City of Orono Zoning Ordinance is hereby
amended by adding the following definition of "retaining wall":
"Retaining wall means a wall or similar structure designed and constructed to hold back and
prevent lateral movement of earth or other landscaping materials."
SECTION 3. EFFECTIVE DATE: This ordinance shall take effect immediately upon its
passage and publication.
ADOPTED this .2.1rdlay of February, 2015 on a vote of_! ayes and _L nays by the
City Council of Orono , Minnesota.

PRACTICAL DIFFICULTIES DOCUMENTATION FORM
This form is a required submittal for ALL variance applications. An application will not be considered
complete or placed on any meeting agendas until this form is complete and submitted to the City .
Minnesota State Statutes Section 462 .357 , Subdivision 6(2) requires that practical difficulties be demonstrated in
order for a variance to be granted. The difficulties must be unique to the property as variances run with the land
and not the land owner. Personal and economic situations are not considered valid practical difficulties. In order
for an application to be heard by the Planning Commission and City Council practical difficulties having merit must
be demonstrated.
HOW DO I PROVE A PRACT ICAL DIFFICULTY ?
This form has 12 points outlin ing the basis City staff uses to determine if practical difficul t ies exist and how the
variance w ill affect the surrounding community. To prove practical difficult ies , address all the relevant points
listed below and answer them as clearly as possible .
Since you are requesting the code exception , you have the burden of proving that the va riance is justified .
The information the City receives is what is used in determining a denial or approval recommendation. If you
leave something out it will not be considered.
Please address each of the twelve practical difficulties criteria as they relate to the request, if they do not apply,
write NIA in the space provided:
1. "The property owner proposes to use the property in a reasonable manner not permitted by the Zoning
Chapter ."
2. "The plight of the landowner is due to circumstances unique to his property not created by the landowner."
