A RESOLUTION GRANTING VARIANCES
TO MUNICIPAL ZONING CODE
SECTIONS 10.22, SUBDIVISION 2 AND
SECTION 10.56, SUBDIVISION 16 (L) 2
FILE NO. 02-2844
'WHEREAS, Bruce Hedblom and Carol Cline-Hedblom, (hereinafter "the
applicants") are owners of the property located at 2601 Casco Point Road within the City of Orono
(hereinafter "the City") and legally described as follows :
Exhibit A, Hennepin County, Minnesota (hereinafter "the property"); and
WHEREAS, the applicants have applied for variances to Municipal Zoning Code
Sections 10.22, Subdivision 2 and Section 10.56, Subdivision 16 (L) (2) to permit hardcover in the
75-250' lakeshore setback of5,555 s.f. (37 .5%) where 5,826 s.f. (39.3%) exists and 25% is allowed
for construction of a 19' X 28' residential addition to replace an existing three-season porch and
connects the house to the garage; and
\VHEREAS, after due published notice and mailed notice in accordance with
Minnesota Statutes and the City of Orono Zoning and Planning Codes, the Orono Planning
Commission held a public hea1ing on October 21, 2002, at which time all persons desiring to be
heard concerning this application were given the opportunity to speak thereon.
NOW, THEREFORE, BE IT RESOLVED by the City Council of Orono,
Minnesota:
FINDINGS
1. This application was reviewed as Zoning File #02-2844.
2. The property is located in the LR-1 C, Single Family Lakeshore Residential Zoning
District where 1/2 acre is the minimum lot size and 100 feet is the minimum lot
width.

3. The Planning Commission reviewed the application for variances and recommended
approval by a vote of 7 to O based on the following findings and hardships:
A. The property has been developed as a single-family residential property since
1973.
B. The property is connected to sanitary sewer.
C. The lot is consistent with other properties in the locality.
D. The addition partially replaces an existing porch connection between the
house and garage. The building expansion will only include an area that is
surrounded on three sides by the existing structure.
E. No encroachment into the side yard setback will be required. The addition is
17' from the property line.
4. The City Council finds that the conditions existing on this property are peculiar to it
and do not apply generally to other property in this zoning district; that granting the
variances will not adversely affect traffic conditions, light, air, nor pose a fire hazard
or other danger to neighboring property; would not merely serve as a convenience to
the applicants, but is necessary to alleviate a demonstrable hardship or difficulty; is
necessary to preserve a substantial property right of the applicants; and would be in
keeping with the spirit and intent of the Zoning Code and Comprehensive Plan of the
City.
5. The City Council has considered this application including the findings and
recommendations of the Planning Commission, reports by City Staff, comments by
the applicants and the effect of the proposed variance on the health, safety and
welfare of the community.

CONCLUSIONS, ORDER, AND CONDITIONS
Based upon one or more of the above findings, the Orono City Council hereby grants
variances to Municipal Zoning Code Section 10.22, Subdivision 2 and Section 10.56, Subdivision
16 (L) (2) to permit hardcover in the 75-250' lakeshore setback of 5,555 s.f. (37.5%) where 5,826 s.f.
(39.3%) exists and 25% is allowed for construction of a 19' X 28' residential addition to replace an
existing three-season porch and connects the house to the garage, per the site plan attached to this
resolution as Exhibit B, subject to the following conditions:
1. All landscape plastic and driveway removals, as shown on the site plan attached as
Exhibit B, shall be completed by May 30, 2003. Such removals shall be completed
simultaneously with the finished landscaping work.
2. To reduce the impact of drainage from the new addition gutters shall be installed that
will direct water from the south side of the house towards the lake and not directly at
the neighbor.
3. Authorities granted by the variances run with the property not with the applicants, but
are permissive only and must be exercised by application for a building permit within
one year of the date of Council approval, or these variances will expire on that date
(October 28, 2003).
4. Violation of or non-compliance with any of the terms and conditions of the variances
shall constitute a violation of the zoning code, shall automatically terminate any
authority granted herein, and shall be punishable as a misdemeanor.
5. The undersigned owners have read, understand and hereby agree to the terms of this
resolution and on behalf of themselves, their heirs, successors and assigns, hereby
agree to the recording of this resolution in the Chain of Title of the property.
