MINUTES OF THE ORONO PLANNING COMMISSION MEETING Monday, July 18, 2005 6:00 o'clock p.m. (#05-3129 Ascent Investments, Inc., Continued) Fritzler stated he would like to see the house be compliant with the setback. Kempf moved, Rahn seconded, to recommend approval of a lot width and lot area variance and denial of a side street setback variance for Application #05-3129, Ascent Investments, Inc., on behalf of Douglas and Kimberly Klint, 1345 Rest Point Lane. VOTE: Ayes 6, Nays 1, Bremer opposed. Bremer stated she is opposed because of the unique shape of the lot. 11. #05-3130 STEPHEN AND JEAN SKORO, 2428 CASCO POINT ROAD, VARIANCE, 8:13 P.M. -8:22 P.M. Stephen and Jean Skoro, Applicants, were present. Curtis stated the applicants are requesting a 250'-500' zone hardcover variance to allow 38.9 percent hardcover where 30 percent is normally allowed and 40.2 percent currently exists in order to construct a 242 square foot screen porch. Staff recommends approval of the hardcover variance in conjunction with hardcover removals should the Planning Commission deem additional removals appropriate. Mr. Skora pointed out the gravel driveway constihttes approximately 20 percent of the lot. Skoro stated the area labeled blacktop next the garage is actually gravel and that they are proposing to return that area to sod to reduce the hardcover. Skoro noted they are below the 15 percent sh·uctural coverage limit. Rahn inquired whether the gravel driveway loops around to the concrete area . Skoro stated it does . Skora indicated they have a tuck-under garage, with the strncture having been built in 1939. Rahn noted the U-shaped gravel driveway services the lower garage. Rahn stated the Planning Commission likes to see reductions in hardcover wherever possible. Skoro stated they are also removing the sandbox. Skora indicated the concrete pad nex t to the house is used quite :frequently . There were no public conm1ents regarding this application. Jurgens stated in his opinion there is room for further reductions in hardcover. Leslie concurred with Jurgens and that the driveway could be reduced in wi dth somewhat near the garage. Skoro stated the only issue he has with reducing the width of the driveway is for aesthetic reasons. Skoro indicated there is a retaining wall that is abutted by the driveway. Mrs. Skoro stated they would like to retain some area for a turnaround. Skoro stated he is willing to reduce the hardcover as much as possible. Skoro indicated there are a couple of concrete pads that could also be removed but that he is unable to commit at this time to a certain percentage. Skora stated they would like to retain some of the driveway to help accommodate his elderly parents. Kempf moved, Winkey seconded, to recommend approval of Application #05-3130, Stephen and Jean Skoro, granting of a 250'-500' zone hardcover variance to allow 38.9 percent hardcover where 40.2 percent currently exists in order to construct a 242 square foot screen porch, subject to the removal of the sandbox and a portion of the driveway located near the garage. Jurgens stated he would like the retaining wall also removed. Skoro indicated there would be considerable expense associated with removing the retaining wall. Kempf indicated he would like to leave his motion as stated. VOTE: Ayes 5, Nays 2, Jurgens and Fritzler Opposed. Fritzler stated he would like to see the retaining wall also removed. Mrs. Skoro pointed out there is a significant drop by the retaining wall. Fritzler stated he does not want to see the hardcover reappear on this lot in the future. Jurgens stated he would like to see further reductions in hardcover. A RESOLUTION GRANTING VARIANCES TO MUNICIPAL ZONING CODE SECTION 78-1288(B) FILE NO. 05-3130 WHEREAS, Stephen J. Skora and Jean K. Skora, husband and wife (hereinafter "the applicants") are the owners of the property located at 2428 Casco Point Road within the City of Orono (hereinafter the "City") and legally described as follows: Lot 24, the North Half of Lot 23, and the South Half of Lot 25, Block 2, Navarre, Hennepin County, Minnesota (hereinafter the "property"); and WHEREAS, the applicants have made application to the City of Orono for a variance to Orono Municipal Zoning Code Section 78-1288 (B) for a 250' -500' zone hardcover variance to allow 38.9% hardcover where 30% is normally allowed and 40.2% currently exists in order to construct a 242 s.f. screen porch .. NOW, THEREFORE BE IT RESOLVED by the City Council of Orono, Minnesota: FINDINGS 1. This application was reviewed as Zoning File 05-3130. 2. The property is located in the LR-IC, One Family Lakeshore Zoning District which requires a minimum lot area of 0.5 acre and a minimum lot width of 100'. 3. The Planning Commission reviewed this application at a public hearing held on July 18, 2005 and on a vote of 5 -2 recommended approval of a hardcover variance based on the following findings: a. The applicants' property has 14,000 s.f. or 0.32 acre in area and 100' of width. Page 1 of 5 b. No additional land is available for acquisition by the applicants to make the property conforming in area. c. The applicants are proposing to add a covered entry porch within the allowed setbacks. d. Due to the hardcover levels on the applicants' property any hardcover changes require variances. e. The applicants' are proposing to remove portions of driveway hardcover in conjunction with hardcover variance approvals. Additional hardcover removals bring the 75' -250' hardcover below 38.9% would reduce the functionality of the existing driveway system. 4. The City Council has considered this application including the findings and recommendation of the Planning Commission, reports by City staff, comments by the applicants and the public, and the effect of the proposed variance on the health, safety and welfare of the community. 5. The City Council finds that the conditions existing on this property are peculiar to it and do not apply generally to other property in this zoning district; that granting the variance would not adversely affect traffic conditions, light, air nor pose a fire hazard or other danger to neighboring property; would not merely serve as a convenience to the applicants, but is necessary to alleviate a demonstrable hardship or difficulty; is necessary to preserve a substantial property right of the applicants; and would be in keeping with the spirit and intent of the Zoning Code and Comprehensive Plan of the City. CONCLUSIONS, ORDER AND CONDITIONS Based upon one or more of the above findings, the Orono City Council hereby grants a variance to Orono Municipal Zoning Code Section 78-1288 Subdivision B to allow 38.9% hardcover where 30% is normally allowed in order to construct a 242 s.f. screen porch, subject to the following conditions: 1. Council approval is based on the site plan submitted by the applicants and annotated by City staff, attached to this Resolution as Exhibit A. Any Page 2 of 5 amendments to the site plan which are not in conformity with City codes will require further Planning Commission and City Council review. 2. Hardcover in the 250' -500' zone shall not increase above the level of 5,435 s.f. or 38.9%. Hardcover in the 500' -1000' zone shall be limited to 12 s.f. or 35% per the proposed plan and hardcover allowance summary as depicted on Exhibit A. Applicants are advised that any future requests to increase hardcover or change the nature of existing/approved hardcover shall require City approval, and increases in hardcover will not likely be approved without concurrent reduction in existing hardcover. 3. Applicants shall remove all plastic or fabric liner material from the decorative landscape beds on the property to ensure their permeability as non-hardcover surfaces. 4. Required removals of structure and hardcover shall be completed by the footing inspection for the screen porch. 5. Authorities granted by this resolution run with the property not with the applicants, but are permissive only and must be exercised by obtaining a building permit for the new construction within one year of the date of Council approval, or the variance will expire on that date (August 8, 2006). 6. Violation of or non-compliance with any of the terms and conditions of this resolution shall constitute a violation of the zoning code, shall automatically terminate any authority granted herein, and shall be punishable as a misdemeanor. 7. The undersigned applicants have read, understand and hereby agree to the terms of this resolution and on behalf of the applicants and the applicants' heirs, successors and assigns, hereby agree to the recording of this resolution in the chain of title of the property. In order to construct the screen porch addition the hardcover variance review must be conducted. There is approximately 3,000 s.f. of driveway and parking areas on the property, and approximately 200 s.f of concrete sidewalk. Additionally, the applicants have approximately 500 s.f. of decorative stone walls on the property. In order to account for the additional hardcover of the screen porch, the applicants are proposing to remove a 395 s.f. portion of the driveway to account for the 242 s.f. screen porch addition. 2 Hardship Statement FILE #05-3130 12 July 2005 Page 3 of 3 Applicant has completed the Hardship Documentation Form attached as Exhibit B, and should be asked for additional testimony regarding the application. Hardship Analysis /11 considering applications for variance, the Pla1111i11g Commission shall consider the effect of the proposed variance upon the health, safety and welfare of the community, existing and anticipated traffic co11ditio11s, light and air, danger of fire, risk to the public safety, and the effect 011 values of property in the surrounding area. The Pla1111i11g Commission shall consider recommending approval for variances from the literal provisions of the Zoning Code in instances where their strict enforcement would cause undue hardship because of circumstances unique to the individual property under co11sideratio11, and shall recommend approval only when it is demonstrated that such actions will be in keeping with the spirit and intent of the Orono Zoning Code. Staff finds that while the applicants are proposing a net decrease of 163 s.f. hardcover, due to the existing level of hardcover additional removals may be warranted. Minnesota State Statue Section 394.27, Subdivision 7 requires that a hardship be demonstrated in order for a variance to be granted. The hardship must be unique to the property as variances run with the land and not the land owner. Personal and economic situations are not considered valid hardships. In order for an application to be heard by the Planning Commission and City Council a hardship having merit must be demonstrated. HOW DO I PROVE A HARDSHIP? This form has 12 points outlining the basis City staff uses to determine if a hardship exists and how the variance will affect the surrounding community. To prove a hardship, address all the relevant points listed below and answer them as clearly as possible. Since you are requesting the code exception, you have the burden of proving that the variance is justified. The information the City receives is what is used in determining a denial or approval recommendation. If you leave something out it will not be considered. The addition can be seen by one neighbor (Janet Roberts) and she has expeessed approvalof the project. 4. "Economic considerations alone shall not constitute an undue hardship if reasonable use for the property exists under the terms of the Zoning Chapter."
