The original plan, Exhibit D- 2, was rejected by the Planning Commission based on the number and magnitude of variances required. The original plan proposed a 32'x22' detached garage, a major addition to the lakeshore side of the principal structure and a 8'xl0' greenhouse addition to the existing detached workshop structure. A significant concern for the Planning Commission with the original proposal was that the detached garage would block emergency fire vehicles from getting to the principal structure. Applicant was advised to reduce hardcover and structural intensification. Applicant was also encouraged to attach garage addition to the existing accessory structure. Zoning File #1775 December 3, 1992 Page 3 The amended plan submitted for the Planning Commission's November meeting reflected major reductions in structural coverage and hardcover. (D-1) The lakeside two story addition was reduced from 15'x36' to 15'xl6 1/2', the greenhouse addition was reduced from 8'xl0' to 6'x8' and the garage proposed now as a 28'x22' addition to the workshop providing an open corridor for easy access to the principa 1 structure. The greenhouse and garage additions to be attached to the workshop creates an oversized accessory structure at 1,273 s.f. requiring the most restrictive of setbacks for the detached structure. The property is 15,890 s.f. in area and is allowed an oversized accessory structure at 1,000 s.f. Lot coverage was reduced from 21% to 15.8%. Hardcover within the 75-250' setback area has been reduced from 37.2% to 31.6%. Mr. Luesse's neighbor to the immediate north, the Diegres, have provided a letter approving the amended proposal. (Exhibit F) Diegres had major objections to Mr. Luesse's original improvement proposal. Hardship Statement Please review Exhibit A-1. He notes the structures within the steep lakeshore bank area have prevented erosion. He notes that the lakeside bank was not damaged during the severe storms of 1987. As for hardcover the applicant reminds us that the undeveloped property was severely sloped with drainage going directly into the lake. Throughout the years of his occupancy, he has created flat plateau areas and notes that he has never used plastic or geotechnic fabric beneath his gardens or formal plantings. Planning Commission Recommendation Although the Planning Commission appreciated the major reductions in structural and hardcover improvements, the Planning Commission's recommendation approved a 24'x22' garage addition to the workshop structure and the 15'xl6.5' two story lakeside addition and denied the 6'x8' greenhouse addition to the workshop. Approval was subject to applicant removing the grade level deck at the north side of the principal structure (204 s.f.). Applicant was to be allowed an entry structure to the existing patio doors. Review of Final Plan, Exhibit N Based on the Planning Commission's recommendation, Mr. Luesse has submitted a revised plan showing a 24'x22' addition to the workshop and the removal of the grade level deck and replacing the grade level deck with a 4'xl2' (48 s.f.) entry deck. The factual findings noted above reflect improvements shown in final plan. Note applicant still requests a 6'x8' greenhouse addition. Luesse (hereinafter "the applicant") is the owner of the property located at 3249 Casco Circle within the City of Orono (hereinafter "City") and legally described as follows: Lot 12, Spring Park, Hennepin County, Minnesota (hereinafter "the property"): and WHEREAS, the applicant has applied for the following variances to the Municipal Zoning Code to permit a 22'x28' addition to a detached accessory structure, a two story 15'xl6 1/2' addition to the lakeside of the existing residence and 6'x8' greenhouse addition to an existing accessory structure as follows: 1. Section 10.03, Subdivision 14 (D) -setback variances for oversized accessory structure. Street setback is proposed at 19' instead of the required 30' and 3' from the side lot line where 30' is required. 2. Section 10.03, Subdivision 9 (C-2) -variance to allowed area for an oversized accessory structure. The applicant proposes a 1,273 s.f. accessory structure where only a 1,000 s.f. structure is allowed. 3. Section 10.22, Subdivision 2 -hardcover variance within the 75-250' setback area is required as hardcover is proposed at 3,386 s.f. or 30.2% where only 2,800 s.f. or 25% is allowed. NOW, THEREFORE, BE IT RESOLVED by the City Council of Orono, Minnesota: FINDINGS 1. This application was reviewed as Zoning File #1775. 2. The property is located in the LR-lC Lakeshore Residential Zoning District requiring a 1/2 acre or 21,780 s.f. in area. The property consists of approximately 15,893 s.f. 3. The Orono Planning Commission reviewed this application on October 19, 1992 and November 16, 1992 and recommended approval of the proposed variances as amended based upon the following findings: a) The proposed garage addition to the accessory structure shall not encroach further into the side yard than the existing structure at 3'. b) There is no adjacent land a vai lab le to acquire. c) The location of the garage structure in the street yard, proposed 19' from street lot line, is consistent with other detached garages within immediate Casco Circle neighborhood. d) The two story lakeside addition will be placed 5' further into average lakeshore setback area as an existing roofed second floor porch structure is located 10' beyond average lakeshore setback line. 4. The City Council finds that the conditions existing on this property are peculiar to it and do not apply generally to other property in this zoning district; that granting the variances would not adversely affect traffic conditions, light, air nor pose a fire hazard or other danger to neighboring property; would not merely serve as a convenience to the applicant, but is necessary to alleviate a demonstrable hardship or difficulty; is necessary to Page 2 of 5 preserve a substantial property right of the applicant~ and would be in keeping with the spirit and intent of the Zoning Code and Comprehensive Plan of the City. 5. The City Council has considered this application including the findings and recommendations of the Planning Commission, reports by City staff, comments by the applicant and the effect of the proposed variances on the health, safety and welfare of the community. CONCLUSIONS, ORDER AND CONDITIONS Based upon one or more of the above findings, the Orono City Council hereby grants variances to the Municipal Zoning Code Sections noted above that would permit the construction of a 28'x22' garage and 6'x8' greenhouse additions to detached accessory structure referenced as workshop and a two story 15' xl6 1/2' lakeside addition to the principal residence, subject to the following conditions: 1. Upon application for a building permit, applicant shall provide an updated survey locating all existing structures and proposed structures on property. 2. Applicant shall remove an 8 l/2'x24' grade level deck to the north side of the principal structure and replace with a 4'xl2' grade level deck. 3. All new construction shall be subject to requirements of uniform building code and fire code. 4. The new roof to be installed over workshop/garage structure shall be constructed so as not to exceed a 4 1/2 to 12 pitch. 5. Authorities granted by this variance run with the property not with the applicant, but are permissive only and must be exercised by application for a building permit within one year of the date of Council approval, or this variance will expire on that date (December 14, 1993). Violation of or non-compliance with any of the terms and conditions of this variance shall constitute a violation of the zoning code, shall automatically terminate any authority granted herein, and shall be punishable as a misdemeanor. 7. The undersigned applicant has read, understood and hereby agrees to the terms of this resolution and on behalf of himself, his heirs, successors and assigns, hereby agrees to the recording of this resolution in the chain of title of the property. Mabusth stated that is why the garage was attached, and added, is it poss i b I e to reduce the size of the garage? She added the applicant has reduced the structural coverage on the lot considerably. Luesse asked if it would be more acceptable to detach the garage. Johnson asked about combining the workshop and garage to reduce the size. Luesse stated that would not give him the needed space. He noted an existing development pattern on Casco Circle of garages not meeting the required setback. Mabus th asked what exists in the area of the proposed attached garage. Luesse stated that is where his garden was. Kelley state.d he does not have a problem with the proposed garage and greenhouse. (#9) #1777 JOHN THIESSE, 3845 BAYSIDE ROAD - VARIANCE -PUBLIC HEARING 10:45 -11:03 P.M. The Affidavit of Publication and Certificate of Mai I ing were noted. John Thiesse was present. Mabusth explained the property abuts the riparian outlot for the Bayside plat. A neighbor to the north claims encroachment of entry steps into the out lot, which staff has determined to be incorrect. The proposal reduces 75-250' hardcover from 50% to 45%. She reviewed the proposed changes: part of the existing deck on the east side wi 11 be enclosed, the remainder of the deck structure wi 11 remain open deck area, an intensification of the structure with the addition of a second story and a second story entry addition. She noted a slight encroachment of the average lakeshore setback, but stated it wi 11 not impact views of neighbors because of the curved shore I ine. Thiesse said he has tried to purchase the property adjacent to his, but it would not help the situation as the property is totally within the 0-75' zone. He added, because the out lot is unbui ldable, there wi 11 be no visual change in the area. Elevations -Garage/Workshop/Principal Structure Addition Review of Amended Proposal The amended proposal consists of a 22 X 28' addition to be attached to the west side of the existing workshop structure and an 8 X 6' greenhouse addition to be attached to the southeast of the workshop. The original 15 X 36' lakeside addition to the principal structure has been reduced to 15 X 16 1/2'. Review Exhibits C and L. Please note the proposed lakeside addition is 2 story. Luesse, 3249 Casco Circle page 3 The additions to the workshop will create an oversized accessory structure at 1,273 sq ft requiring the most restricitive of setbacks for the detached structure. The property at approximately 15,000 sq ft would have been allowed an oversized accessory structure of 1,000 sq ft. Applicant has reduced hardcover within 75 -250' from original proposal and has also reduced lot coverage (original at 21%, amended at 16.3%). The issue now is the multiple variances requried to approve additions to existing detached workshop. The foundations of all additions to the existing workshop must be compatible and meet requirements of the building code. As structure is located 3' from side line and approximately 6' from the neighboring property's detached garage, the State fire code will call for special fire wall construction where necessary. Issues for Consideration 1. What existing st r u ct u r a 1 or non -st r u ct u r a 1 improvement may be removed within the 0-75' or 75- 250' setback area. Has applicant's amended plan reflected adequate removals? 2. Once again the question. has to be raised as to future use of workshop structure. Is it heated or is heating planned. Does structure contain plumbing or is plumbing proposed. Is this structure currently insulated or proposed to be insulated? 3. Can the oversized accessory structure be trimmed back? Can the 28' depth be reduced? --minimizing street setback variance and area variance to oversized accessory structure. If garage addition is to be moved 7' to meet side setback of 10', applicant will have to remove several mature plantings. Statement of Hardship Please review Exhibit B, Mr. Luesse's written statement submitted with the amended proposal. Please note Mr. Luesse has also met with Mr. Diegre, the neighbor who voiced major concern with the proposed improvement of the workshop area. Amendment to Variance Application #1775 R. G. Luesse -3249 Casco Circle, Orono Lakeshore Zone O -75' 'V ,...,, I .:.. .... r3 1992 This lakefront has a very steep slope to the water's edge. Access to the lake requires a continuous stair to a landing at the water's edge which serves as dock storage in winter. About one-fourth of the way down the hill (hidden from neighbors' houses and lake shore) we have an open deck that is our only usable lakefront. This deck and the stair are elevated enough to permit plant growth beneath. All construction is surface supported. This avoids disturbing the soil that might trigger erosion. The entire steep slope has been treated to prevent erosion. A series of timber and/ or field stone retaining walls hold the hill in place . I continue to experiment with plantings that will grow in the shade, have aggressive root systems and serve to slow down the runoff. Our efforts have been very effective. We haven't had any visible erosion in the 38 years we've lived here. Properties immediately adjacent on both sides have each had two major mud slides during that period where large segments of their hillside slid into the water. The next properties adjacent to those have each had one mud slide in that period -washing out stairs and covering the beach area with mud. All of the properties along this frontage of the bay, except ours, have an earth shelf at the lake shore, created by the material that was cleaned up from the beach following mud slides. Because we have protected against erosion we have no usable yard area at the lake. As a result of this unusual circumstance we find that our structural solutions are essential for reasonable use of the lake shore. Buildable Zone -75' to 250' The hard cover on this area is already substantial. This circumstance has been mitigated substantially by the way the property has been graded. Starting at the top of the steep slope near the lake, the lot continues to rise another 15 feet to the street (Casco Circle). Before we built this was a continuous slope toward the southeast. By judicious grading, I have established three separate and nearly flat plateaus which are mostly lawn and plantings. This retards the fast runoff that would otherwise occur. In addition, I am a proponent of organic gardening. I haven't applied fertilizer or weed killer to my lawn and garden for years. Instead, I use composted yard and garden refuse and sphagnum peatmoss to condition the soil and hand labor to control the weeds. I do not use plastic 1 sheeting or fabric for weed control in my landscaping. I am making a concerted effort to protect the lake and to enhance the environment. In response to the Commission's concern about hard cover, I have reduced the size of the addition to our residence from 382.5 sq. ft. to 82.5 sq. ft. and reduced the greenhouse addition from 80 sq. ft. to 48 sq. ft. We have also reduced the garage from 3 stalls to 2 stalls and moved the location of the garage from the south side of the lot to the north side where it will be attached to the workshop. This provides for direct access from the street and reduces the amount of hard cover on the unimproved right-of-way. It also has the added advantage of not obstructing fire access to the house should the need arise. Workshop In my original application I proposed a second story addition to the workshop. At the request of my immediate neighbor to the north (Mr. Diegre), I have removed that from my application. Attached is a letter from Mr. Diegre stating that he has no objections to my amended application including the new roof for the workshop providing the pitch does not exceed 41/2 to 12. I have provided drawings of the proposed new roof at 4 1/2 -12 pitch to Mr. Diegre and enclose same with this application. I have also enclosed drawings of the other improvements proposed as well as letters of approval from other adjacent neighbors. We request that you approve our application as amended herein. Mr. Luesse never continued with the application as he perceived a problem with having an approval resolution filed in the chain of title that would place limits on future development of the substandard property. The current application involves a request to install a 32'x22' detached garage. Major structural improvements of the existing accessory structure, an 8'xl0' greenhouse addition to the accessory structure, and a 36'xl5' upper level year round enclosed porch addition to the lakeside of the existing residence. The porch addition will extend 5' beyond the existing roofed deck. All proposed improvements require setback variances. The principal structure addition requires an average lakeshore setback and side setback variance; the existing accessory structure approval of an existing side setback variance and the proposed detached garage at 704 Zoning File #1775 October 15, 1992 Page 3 s.f. in area, side and street setback variances. The proposed improvements on the property result in a 10.3% increase in structural coverage of the property (lot coverage variance 12.4%). Hardcover in the 75-250' setback area has been increased 10.9% (final hardcover at 37.2%). Mr. Luesse had originally proposed a second story over the existing detached garage but because of his neighbor's opposition to the improvement he has amended the proposal to now just include a new roof to match the roof of the proposed detached garage. Note the turnaround and extended drive are located within the unimproved right-of-way of Casco Circle. Public Works Director must approve the expanded use within the unimproved right-of-way. It is typical that the City asks for a hold-harmless agreement for such private improvements located within right-of-ways. It should also be noted for the record that existing improvements within unimproved public right-of-way shall never deter the proposed upgrading of the roadway. Issues for Consideration 1. What existing structural improvements can be reduced or removed within the 0-75' or 75-250' setback area? 2. What non-structural hardcover improvements can be removed or reduced? Mr. Luesse's addendum notes that no landscape areas are underlain with plastic. What other non-structural improvements can be considered for removal and accomplish a reduction in the 75-250' setback? Variance Application #1775 R. G. Luesse -3249 Casco Circle, Orono I would like to offer the following comments in support of the variance application before you. House We purchased this property and built our homestead nearly 40 years ago before the current ordinance limitations. The sideyard setbacks were 5 ft. and garages were still being built with no setback from the street. Half-acre zoning and hard cover limits didn't exist. We bought a standard lot on which we built the size house we could afford at the time. Our house has a very small footprint (864 sq. ft.). We utilize the full walkout for bedrooms and bath which provided 3 small bedrooms for a family with 4 children. We made this work by utilizing the concrete block building that came with the lot for all our storage. One might expect that with the children gone we would need less space. Not so. Our extended family now involves 4 families, 8 grandchildren and 3 great grandchildren. We now need more elbow room than when we were a single unit. In addition Mrs. Luesse and I both have more time to pursue our hobbies. Mrs. Luesse is an accomplished basket maker and quilt designer. A handmade quilt in a frame for quilting requires a room approximately 15 feet square. Our new all-weather porch will serve that purpose well. Workshop Except for construction of the original cabinetry for the house the concrete building has been used mostly for storage and garden supplies. With retirement near, I expect to pursue my woodworking hobby in winter and gardening in summer. I have a vintage wood sailboat to restore that was custom designed and built by Joseph Pringle in St. Paul early in this century. I have the original gaff rigging including top sail. I also have a wood and canvas guide canoe from Shell Lake, Wisconsin which is also nearly 80 years old. For these restorations, I'll need a sizable work space. Greenhouse My summers are fully occupied with gardening. With chemically treated food becoming a serious threat to health, I try to grow a variety of fruits and vegetables myself. Some things need the benefit of early sprouting to enable 1 them to mature in Minnesota -thus, the proposed small greenhouse addition to the workshop. In the flower garden we grow some things for summer color, some things to dry for winter color indoors. Others we grow to dry the stems for basket making. The greenhouse will provide needed space for growing and for drying flowers. Garage I have recently purchased a new car and at today's prices that investment merits maximum protection. We have a second car which I drive to the bus and must rely upon to start in cold weather. We would like a third stall for storage of our wooden sailboat on trailer, lawnmower, snowblower, bicycles, lawn furniture, and wheelbarrow. I have located the garage for optimum function. Our present parking area 3 feet from the north property line, becomes impossible in heavy snow years. My neighbor's garage is about two feet from the property line. When he and I both try to store snow in the narrow space between, it is unworkable. In the proposed location, I will be able to blow snow to both sides of the drive with space to store snow all winter. This location will also permit a workable back around so we can approach the street driving forward instead of backing out onto the street. Design Our house is of Japanese style post and beam construction, a low pitched roof, with a vaulted ceiling of natural cedar. The exterior is mostly picture windows and vertical siding. The design of all new construction will follow the expression established by the house, such as the low pitched roof, vertical siding and Japanese style details. The newly constructed fence along the north property line is an example of the quality and style we expect to continue. Survey The application calls for a survey and hard cover calculation. I have provided an as built survey for the existing buildings on my lot. I have also provided a detailed drawing, to scale, of all the hard cover elements on the lot, plus the location of buildings on adjacent properties. All of the property line iron markers are in place in accordance with the survey and visible for confirmation. The properties on either side have changed ownership twice since we built on this lot and in each case their surveys have confirmed the property markers as established to the satisfaction of VA Appraiser, FHA underwriters and Mortgage bankers. To provide another survey would only duplicate what is aready known. Such an expenditure would be better spent to enhance the quality of the proposed improvements. 2 Lakeshore Zone O -75' This lakefront has a very steep slope to the water's edge. Access to the lake requires a continuous stair to a landing at the water's edge which serves as dock storage in winter. About one-fourth of the way down the hill (hidden from neighbors' houses and lake shore) we have an open deck that is our only usable lakefront. This deck and the stair are elevated enough to permit plant growth beneath. The entire steep slope has been treated to prevent erosion. A series of timber and/ or field stone retaining walls hold the hill in place. I continue to experiment with plantings that will grow in the shade, have aggressive root systems and serve to slow down the runoff. Our efforts have been very effective. We haven't had any visible erosion in the 38 years we've lived here. Properties immediately adjacent on both sides have each had two major mud slides during that period where large segments of their hillside slid into the water. The next properties adjacent to those have each had one mud slide in that period -washing out stairs and covering the beach area with mud. Hardcover The hard cover on the buildable zone (75 to 250') already exceeds the ordinance limit. This circumstance has been mitigated substantially by the way the property has been graded. Starting at the top of the steep slope near the lake, the lot continues to rise another 15 feet to the street (Casco Circle). Before we built this was a continuous slope toward the southeast. By judicious grading, I have established three separate and nearly flat plateaus which are mostly lawn and plantings. This retards the fast runoff that would otherwise occur. In addition, I am a proponent of organic gardening. I haven't applied fertilizer or weed killer to my lawn and garden for years. Instead, I use composted yard and garden refuse and sphagnum peatmoss to condition the soil and hand labor to control the weeds. I do not use plastic sheeting or fabric for weed control in my landscaping. I am making a concerted effort to protect the lake and to enhance the environment. Conclusion As we celebrate our 45th wedding anniversary this year, we are trying to prepare the property to serve us in our retirement years.
