Draft Resolution Proposed Survey PC Action Notice 10/22/13 PC Staff Report & Exhibits 10/17 /13 Application Summary: The O'Rourkes are currently constructing a new residence on the property, no variances were required . As part of the redevelopment they are proposing to rebuild the existing boat house. The boat house is an existing legal non-conforming structure and as part of its in-kind replacement they are proposing to eliminate the open space and the existing retaining wall which create and awkward, if not unsafe, void behind the boathouse. New retaining walls and a lake access stair are proposed which require approval of a conditional use permit {CUP) and hardcover variance with the 75 foot setback. In place of the wall and hardcover removals the applicant is proposing to fill in the void and install two separate short stairs with retaining walls on the east side of the boat house . They have proposed a landscape plan to screen the proposed walls and stairs. Including the boat house, the applicant's current plan reflects a variance to allow 703 square feet of hardcover within the 75 foot setback zone where hardcover is normally not allowed. A CUP is required prior to engaging in activities that include fill to elevate or alter the existing natural grade. The Code provides criteria against which the Planning Commission and Council should review the CUP. Planning Commission Recommendation On October 21, 2013 the Planning Commission voted 7 to Oto recommend approval of the variance and the CUP. Planning Staff Recommendation #13-3634 24 Oct 2013 Page 2 of 2 The CUP and hardcover variance requested for the retaining wall and stair work within the Oto 75 foot zone appears to be reasonable; the landscape plan provides screening of the hardcover improvements and the hardcover reductions are consistent with the City's goal to reduce hardcover near the lake. Planning Staff recommends approval of the variance and CUP in conjunction with the landscape plan. COUNCIL ACTION REQUESTED The Council should consider adopting or amending the attached approval resolution regarding the hardcover variance and CUP for improvements within the 75-foot setback. A RESOLUTION GRANTING VARIANCES FROM MUNICIPAL ZONING CODE SECTIONS 78-1279, 78-1282 & 78-1680 AND A CONDITIONAL USE PERMIT PURSUANT TO MUNICIPAL ZONING CODE SECTION 78-966 FILE NO. 13-3634 WHEREAS, James Calvin O'Rourke Revocabl.e Trust (hereinafter the "Owner'') is the owner of the property located at 3227 Casco Circle within the City of Orono (hereinafter the "City") and legally described as.: Attached as Exhibit A (hereinafter the "Property"); and WHEREAS, James Calvin O'Rourke, the trustee of the James Calvin O'Rourke Revocable Trust (hereinafter the "Applicant")· on behalf of the Owner has made application to the City of Orono for a variance to Orono Municipal Zoning Code Section 78-1680 to allow 703 square feet hardcover where no hardcover is permitted in conjunction with construction of a new, meandering lake access stair with retaining walls within 75 feet of the OWHL of Lake Minnetonka; and WHEREAS, the Applicant has made application to the City of Orono for variances from Orono Municipal Zoning Code Sections 78-1279 and 78-1282 to allow construction of a new, meandering lake access stair with retaining walls within 75 feet of the OWHL of Lake Minnetonka to replace an existing above grade minimal stair; and WHEREAS, there is an existing legal non-conforming boat house within the 75- foot setback on the Property and in accordance with Orono Municipal Code Section 78-71 the Applicant intends to reconstruct the boat house in-kind; and WHEREAS, in conjunction with the in-kind replacement the Applicant has made application to the City of Orono for a conditional use permit (hereinafter the "CUP") pursuant to Orono Municipal Zoning Gode Section 78-966 to allow grading to fill the void behind the boat house, for construction of new retaining walls and stair system and landscape plantings within the 75-foot setback on the Property; and WHEREAS, after due published notice and mailed notice in accordance with Minnesota Statutes and the Orono, Minnesota, City Code, a public hearing was held by the Page 1 of 5 Orono Planning Commission on October 21, 2013 at which times all persons desiring to be heard concerning this application were given the opportunity to speak thereon. NOW, THEREFORE BE IT RESOLVED by the City Council of Orono, Minnesota: FINDINGS 1. This application was reviewed as Zoning File number 13-3634. 2. The Property is located in the LR-1C One Family Lakeshore Residential Zoning District which requires a minimum lot area of 0.5 acre and a minimum lot width of 100'. 3. The Planning Commission reviewed this application at a public hearing held on October 21, 2013 and voted 7 for and Oona motion to approve the CUP and the hardcover variance based on the following findings of fact: a. The Property contains 49,825 square feet (1.14 acres) in area and has a defined width of 165-feetat the lake and 165-feet at the 75-foot setback. b. A new residence home on the Property is currently under construction. c. The Applicant's proposed landscape plan and stair system have been designed in a way which offers screening of the stairs with a natural-looking slope as viewed from the lake, d. With a total of 22.6% overall hardcover, the Property will conform to the 25% hardcover limitations of a Tier 1 lot. e. The Applicant's proposed stair system, walls and landscaping will not alter the essential character of the neighborhood and will result in minimal or no negative impact on adjacent properties. f. The Applicant's' project will not adversely impact views of the lake currently enjoyed by the· adjacent properties; views of the property from the lake will be improved with the new stair and landscape screening offered. g. The Applicant's request is in harmony with the purpose and intent of the ordinance. h. The Applicant has demonstrated that enforcing the provisions of the Zoning Ordinance deprives the Applicant of the reasonable use of their Property. Page 2 of 5 i. The proposed grading within the 75-foot setback area will not have an adverse impact on surrounding lands. Drainage patterns for runoff leaving the site will not be significantly altered. j. The Applicant has provided a landscape plan which will serve to screen and mitigate views of the retaining walls and. stairs from the lake in a natural manner. 4. The City Council has considered this application including the findings and recommendation of the Planning Commission, reports by City staff, comments by the Applicants and the public, and the effect of the proposed variance and CUP on the health, safety and welfare ofthe community. 5. The City Council finds that the conditions existing on this Property are peculiar to it and do not apply generally to other property in this zoning district; that granting the variance and CUP would not adversely affect traffic conditions, light, air nor pose a fire hazard or other danger to neighboring property; would not merely serve as a convenience to the.Applicants, but is necessary to alleviate a practical difficulty; is necessary to preserve a substantial property right of the Applicants; and would be in keeping with the spirit and intent of the Zoning Code and Comprehensive.Plan of the City. CONCLUSIONS, ORDER AND CONDITIONS Based upon one or more of the above findings, the Orono City Council hereby grants a variance to Orono Municipal Zoning Code Section 78-1680 to allow 703 square feet hardcover where no hardcover is permitted in conjunction with construction of a new, meandering lake access stair with retaining walls within 75 feet of the OWHL of Lake Minnetonka; variances from Orono Municipal Zoning Code Sections 78-1279 and 78-1282 to allow construction of a new, meandering lake access stair with retaining walls within 75 feet of the OWHL of Lake Minnetonka to replace an existing above grade minimal stair; and a CUP pursuant to Orono Municipal Zoning Code Section 78-966 to allow grading to fill the void behind the rebuilt boat house, for construction of new retaining walls and stair system and landscape plantings within the 75-foot setback; subject to the following conditions: • Council approval is based on the survey, boat house plan and landscape plan submitted by the Applicant and annotated by City staff, attached to this Resolution as Exhibits B, C & D. Any amendments to the approved survey/site plan which are not in conformity with City codes will require further Planning Commission and City Council review. Page 3 of 5 2. Proposed hardcover levels are conforming to the Tier 1 standards; no hardcover variances are granted. Structural coverage limitations will also be met. 3. Authorities granted by this resolution run with the Property not with the Applicant, but are permissive only and must be exercised by obtaining a permit for the walls and stairs and commencing construction of said project within one year of the date of Council approval, or the variance and CUP will expire on that date (October 28, 2014). 4. Violation of or non-compliance with any of the terrns and conditions of this resolution shall constitute a violation of the zoning code, shall automatically terminate any authority granted herein, and shall be punishable as a misdemeanor. 5. The undersigned Applicant has read, understands and hereby agrees to the terms of this resolution and on behalf of the Applicant and the Applicant's heirs, successors and assigns, hereby agrees to the recording of this resolution in the. chain of title of the Property. As part of the redevelopment of the property the applicant is proposing to rebuild the existing boat house. The boat house is an existing legal non-conforming structure. The State Statute and City Code [Sec. 78-71(c){2)] define parameters by which such structures can be remodeled or replaced. As part of the in-kind replacement of the boat house the applicant is proposing to eliminate open space between the boat house and a retaining wall which creates awkward, if not unsafe, void. They could choose to leave the lake access system as is or rebuild it in-kind. However, they intend to re-grade area behind the boat house to eliminate the void; remove the sidewalk system and additional hardcover up to the lake. In place of the removals they propose to install two separate short stairs with retaining walls on the east side of the boat house. They have proposed a landscape plan to screen the proposed walls and stairs. Including the boat house, the applicant's current plan reflects a variance to allow 703 square feet of hardcover within the 75 foot setback zone where hardcover is normally not allowed (with a few exceptions). The proposed stair system meanders and takes advantage of the slope; including the non-hardcover transition area the proposed stair results in slightly less hardcover than would result from a straight shot stair from the top. The walls proposed within the 75 foot setback are included in the overall hardcover calculation. Retailing walls outside of the 75 foot setback will be excluded from the calculation. Conditional Use Permit Analysis City Code Section 78-966{a)(2) indicates that landowners must obtain a CUP from the City prior to engaging in activities that include fill to elevate or alter the existing natural grade. By code, conditionally permitted uses must be reviewed using the criteria found in Section 78- 916. With regard to this application, items 2, 6, 7, 9, 10 and 13 are generally applicable. Re: Item 2. The proposed grading, retaining walls and lakeshore access stair are residential in nature and are compliant with the zoning code. Re: Items 6 & 7. These criteria essentially ask whether the proposed walls and stairs are appropriate and in character with the surrounding land and neighborhood. Staff believes the proposed stairs and walls within the 75-foot setback area will have no impact on surrounding lands. Drainage patterns for runoff leaving the site are not significantly altered. The resulting grade around the boat house will be more gradual than existing and similar to the other properties in the neighborhood. Re: Item 9. This standard requires that the grading activity must not substantially impair the use and enjoyment of the property in the area or have an adverse impact on the property values in the area when compared to the impairment or impact of generally permitted uses. The proposed use of the property for construction of a residence, retaining walls and lake access stair will not be changing as a result of the proposed activity, so there should be no change in the use and enjoyment of adjacent properties. Re: Item 10. This requirement discusses the need to mitigate undesirable views. The applicant has provided a landscape plan which will serve to screen and mitigate views of the retaining walls and stairs from the lake. Re: Item 13. This standard requires that the grading be designed to take into account the natural, scenic, and historic features of the area and to minimize environmental impact. Practical Difficulties Statement The applicant Documentation should be asked for testimony regarding Practical Difficulties. Practical Difficulties Analysis In considering applications for variance, the Planning Commission shall consider the effect of the proposed variance upon the health, safety and welfare of the community, existing and anticipated traffic conditions, light and air, danger of fire, risk to the public safety, and the effect on values of property in the surrounding area. The Planning Commission shall consider recommending approval for variances from the literal provisions of the Zoning Code in instances where their strict enforcement would cause practical difficulties because of circumstances unique to the individual property under consideration, and shall recommend approval only when it is demonstrated that such actions will be in keeping with the spirit and intent of the Orono Zoning Code. Staff Comments The CUP and hardcover variance requested for the retaining wall and stair work within the O to 75 foot zone appears to be reasonable; the landscape plan provides screening of the hardcover improvements and the hardcover reductions are consistent with the City's goal to reduce hardcover near the lake. Issues for Consideration l. Does the Planning Commission find the proposed walls, stairs and landscaping within the 75-foot setback area provide the minimal lake access necessary as well as provide a native/natural appearance? 2. It is the purpose of this section to regulate nonconforming structures and uses , and to specify those requirements , circumstances and conditions under which nonconforming structures and uses will be operated and maintained. The Zoning Code establishes zoning districts and specific uses which are permitted within each district. It is necessary and consistent with the establishment of these districts that nonconforming structures and uses not be permitted to continue without restriction . (2) Effective date. Any structure or use lawfully existing upon the effective date of this section shall not be , enlarged , expanded, extended , or altered in any manner which increases its nonconformity , but may be continued at the size and in the manner of operation existing upon such date except as hereinafter specified or, subsequently amended . Any land or buildings which were actually and legally devoted to a nonconforming use on January 1, 1975 , and which were thereafter specifically allowed to continue said nonconforming use under the terms of a conditional use permit issued by the city council , shall be allowed to continue under the terms of said conditional use permit. (3) Safety repairs . Nothing in the Zoning Code shall prevent the placing of a structure in safe condition when said structure is declared unsafe by the building official. (b) Nonconforming uses . (1) Change to conforming use . When any lawful nonconforming use of any structure or land in any district has been changed to a conforming use, it shall not thereafter be changed to any nonconforming use . (2) Change to new nonconforming use. An existing nonconforming use may not be changed to another nonconforming use. (3) Relocation of nonconforming use . a . No nonconforming use shall be moved to another lot or to any other part of the parcel of land upon which the same was conducted at the time of this section's adoption unless such movement shall bring the nonconformance into compliance with the requirements of this section . b. Nonconforming non-structural hardcover may be relocated , including full replacement , to any other part of the parcel of land upon which the same was conducted at the time of this section's adoption , provided that: 1. The hardcover is nonconforming only by reason of the percentage of land devoted to the use or the square footage of the use . 2. The relocation does not physically enlarge the size of the nonconforming use . 3. The relocation does not substantially change the character of the nonconforming use. 4. The relocation does not create a new nonconformity with respect to size or placement by relocating to a different hardcover zone as such zones are defined in section 78-1288 5 . The relocation complies with all applicable setback requirements for the district in which it is located . 6 . No relocation , in whole or part, is made within 75 feet of the ordinary high water level of any lake or tributary . (4) Decrease in nonconforming use . A lawful nonconforming use of a structure or parcel of land may be changed to decrease the nonconformity of use . Once the nonconforming use of such structure or parcel of land has been so changed, said use shall not thereafter be altered to so as to increase the nonconformity from its decreased state. (5) Discontinuation of nonconforming use. Whenever a lawful nonconforming use of a structure or land is discontinued and remains discontinued for a period of 12 months, any future use of said structure or land shall be in conformity with the provisions of the Zoning Code. (6) Normal maintenance. Normal maintenance of a building or other structure containing or related to a lawful nonconforming use is permitted, including incidental alterations which do not physically extend or intensify the nonconforming use. (7) Alterations to lawful nonconforming units. Alterations may be made to a conforming building containing lawful nonconforming units, provided they will not increase the number of units or the nonconformity. (8) Expansion of nonconforming uses. Nonconforming uses may not be expanded or enlarged. However, a lawful nonconforming gun club may apply to the city council to modify its hours of operation or to expand its operations within the existing defined parameters of the property. (c) Nonconforming structures. (1) Involuntary damage or destruction. Whenever a lawful nonconforming structure shall have been damaged by fire, flood, explosion, earthquake, war, riot, or act of God, it may be reconstructed and used as before if within 12 months after such calamity the property owner applies for a building permit to replace the structure. If no permit is applied for within the time period then the whole structure shall be demolished, and any construction thereafter shall be in full compliance and accordance with the provisions of the Zoning Code. (2) Remodeling and reconstruction. This subsection is intended to apply to the voluntary and intentional removal of all or portions of a lawful nonconforming structure. Whenever a lawful nonconforming structure shall be destroyed by means other than fire, flood, explosion, earthquake, war, riot, or act of God, to any extent then such structure may be restored only if a building permit is applied for within 180 days of the commencement of the destruction. If no permit is applied for in the 180 days then the structure shall be built in full compliance and accordance with the provisions of the Zoning Code. (3) Expansion of nonconforming structures. No expansion of nonconforming structures shall be permitted except as specifically listed and allowed herein: a. Expansion of nonconforming single family residence structures. Lawful, nonconforming single family residential structures may be expanded, provided: 1. That the expansion does not increase the nonconformity, and complies with all height, setback, hardcover and lot coverage requirements of the district in which it is located. 2. That if the structure is nonconforming only with respect to substandard lot area or width for the district in which it is located, the expansion shall meet all height, setback, hardcover and lot coverage requirements of the district in which it is located. 3. That in cases where the lot line setback of a structure is less than 50 percent of the required setback for that zoning district, the city will require at a minimum that applicant shall make up the discrepancy by enlarging the opposite required yard depth to result in an aggregate yard depth equivalent to the combined required yard. b. Expansion of residential accessory structures. Lawful, nonconforming residential accessory buildings may be expanded provided: 1. That the expansion does not increase the nonconformity of the accessory building, and complies with all height, setback, and hardcover and lot coverage requirements of the district in which it is located. 2. That if the accessory structure is nonconforming only with respect to substandard lot area or width for the district in which it is located, the expansion shall meet all height, setback, hardcover and lot coverage requirements of the district in which it is located. 3. That in cases where an accessory structure encroaches upon the lot line setback, the city will require at a minimum that the existing accessory structure shall be modified so that it becomes completely conforming with respect to setbacks. (4) Relocation. No nonconforming structure shall be moved to another lot or to any other part of the parcel of land upon which the same was constructed at the time of this section's adoption unless such movement shall bring the nonconformance into compliance with the requirements of the Zoning Code. (5) Prior permit. Any proposed structure which will, under this section, become nonconforming but for which a building permit has been lawfully granted not more than six months prior to the effective date of this section, may be completed in accordance with the approved plans; provided construction is started within six months of the effective date of this section, and continues to completion within two years. Such structure shall thereafter be a legally existing nonconforming structure. Sec. 78-350. Area, height, lot width and yard requirements. (a) Height. No structure or building in the LR-1C district shall exceed 2 1/2 stories and shall not exceed 30 feet in height except as provided in section 78-1366. (b) Lots. (a) It is unlawful for any person to perform or have performed the following land alteration activities without a conditional use permit issued by the council: (1) Remove, fill, use for fill, dredge, store or excavate rock, sand, gravel, dirt or similar earth material within the limits of the city. (2) Fill or reclaim any land by depositing such material or by grading of existing land to elevate or alter the existing natural grade. (3) Build, alter or repair any seawall or retaining wall, or otherwise change the grade or shore of lakeshore property. (b) All land alterations involving filling and grading shall be performed only with clean fill as defined in section 78-1. Granting of such permits is subject to other regulations and prohibitions of this Code and other applicable statutes or ordinances of other governmental bodies. Sec. 78-967. -Exception. (a) The requirements of section 78-966 are not intended to govern the following land alteration activities: ( 1) Normal and customary grading in the area of an existing or a newly constructed building, or the grading of the driveway serving such building. (2) Any earth movement under 500 cubic yards which does not adversely impact the existing drainage. (3) Grading, filling or excavating of ten cubic yards or less within the shore setback zone of all lakes enumerated in article IX of this chapter. Sec. 78-1680. -Hardcover restriction zones. Within 75 feet of the ordinary high water level (OHWL) of any lake or tributary, and within any bluff or shore impact zone, no hardcover shall be placed, located or constructed, except for driveways, stairways, lifts, landings and lockboxes as regulated by the shore/and overlay district. Sec. 78-1700. -Specific tier regulations. Per the official stormwater quality overlay district map, each property in the stormwater quality protection overlay district is assigned to a protection tier based on its relative distance to receiving waters. This protection tier dictates the specific protection measures that must be implemented. (1) Tier 1 parcels. Hardcover shall not exceed 25 percent of the gross lot area. (2) Tier 2 parcels. Hardcover shall not exceed 30 percent of the gross lot area. (3) Tier 3 parcels. Hardcover shall not exceed 35 percent of the gross lot area. ( 4) Tier 4 parcels. Hardcover shall not exceed 50 percent of the gross lot area. (5) Tier 5 parcels. Hardcover shall not exceed 85 percent of the gross lot area. No variances are required for the residence. Curtis stated as part of the redevelopment , the applicant is proposing to rebuild the existing boathouse. The boathouse is an existing legal nonconforming structure . As part of its in kind replacement, the applicant is proposing to eliminate the open space and retaining wall which created an unsafe void behind the boathouse . New retaining walls and lake access stairs are proposed, which retaining walls and access stairs . The plan as shown within the 75-foot setback requires a conditional use permit and hardcover variance. The applicant is also proposing a landscape plan to screen the walls and the stairs. Including the boathouse, the applicant's current plan reflects a variance to allow 703 square feet of hardcover within the 75-foot setback zone where hardcover is normally not allowed. A conditional use permit is required prior to engaging in the activities, which include fill to elevate or alter the natural grade. With regard to this application, several of the criteria are applicable. The conditional use permit and hardcover variance requested within 75 feet of the lake appears to be reasonable. The landscape plan provides screening of the hardcover improvements and the hardcover reductions are consistent with the City's goal to reduce hardcover near the lake. The reductions result from removal of a retaining wall and a large concrete sidewalk that extends room the existing home almost to the lake. Planning Staff recommends approval of the conditional use permit and hardcover variance for the work within the 0-75 foot zone including the walls, grading, and stairs. Leskinen asked whether there is a sidewalk from the new home being proposed. Curtis indicated there is not but that there is a retaining wall that wraps around which stops at the 75-foot setback. There is also grading proposed in that area. Chair Leskinen opened the public hearing at 8: 14 p .m. There were no public comments regarding this application. Chair Leskinen closed the public hearing at 8:14 p.m. Leskinen stated she did visit the site and in her view the proposal will be an improvement. Leskinen stated she does not have any issues with the application and that the request is reasonable. Thiesse and McGrann indicated they are in agreement with Chair Leskinen. Am I reading it wrong, missing a sheet, etc? It makes it more difficult for me to specifically identify how much hardcover each feature accounts for ... This standard requires that the grading activity must not substantially impair the use and enjoyment of the property in the area or have an adverse impact on the property values in the area when compared to the impairment or impact of generally permitted uses. The proposed use of the property for construction of a residence, retaining walls and lake access stair will not be changing as a result of the proposed activity, so there should be no change in the use and enjoyment of adjacent properties. Re: Item 10. This requirement discusses the need to mitigate undesirable views. The applicant has provided a landscape plan which will serve to screen and mitigate views of the retaining walls and stairs from the lake. Re: Item 13. This standard requires that the grading be designed to take into account the natural, scenic, and historic features of the area and to minimize environmental impact. The proposed grading on this lot is minimal and as a result will have minimal if any environmental impacts.
