A RESOLUTION VACATING
A CONSERVATION AND FLOWAGE EASEMENT
WI'I'HY1�T LOT 2, BLOCK 1, KLITZKE ADDITION
IN TH� CITY OF ORONO, HENNEPIN COUNTY, MINNESOTA
FILE NO. 2082
WHEREAS, the City of Orono is u municipal corporation organized and existing
under the laws of the State of Minnesota; and
WIEIEREAS, on October 6, ].9�5, Richard Miller Stark (hereinafter the applicant)
filed a petition with the City of Orono requestinb the vacation of a conservation and flowage
easement orginally dedicated in the plat of Stiel�w �ddition, Hennepin County, Mimlesota and
legally described as follows:
• Refer to Exhibit A attached; and
�V�ER.EA.S, after due published and posted notice, a public heariY�.g was helc3
. before the City's Planning Commission on November 20, 1995 regarding said vacati�n a�1� .all
interested persons were given an opportunity to be heard; and
WH[�REAS, after due standing and consideration, the Planning Cornmissi�n
recommended unanimous approval of the proposed vacation; and
'W���g2EAS, the City Council of the City of Orono finds that said vacation as
proposed is in keeping with the public interest and in consideration of the following findings:
1. Applicant's consultant, Jay Riggs, aii Environmental Specialist of Westwood Professional
Sezvices, Inc., has submitted a wetland delineation report dated July 31, 1995 ]ocating
a wetland area within lal:eshore yard of Lot 2, Block 1, Klitzke Addition.
' 2. The City Engineer Sh:awn Gustafs�n ui his report dated August 8, 1995 reconfirn�.ed the
findings of that wetland delineation report. The findings of the report confirm that the
wetland area protected under the oribinal conservation easement dedicated in 1978 with
the Stielow Addition v�ras inconectly designated.

3. The Flowage and Conservation Easement as it exists today serves no public purpose.
NOW, THEREF�RE BE IT RESOLVED, that the petition of Richazd Miller
Stark is hereby granted by the Council of the City of Orono and that the Flowage and
Conservation Easement legally described above is hereby vacated. The granting of the petition
is subject to the following conditions:
1. Applicant to grant a Flowage and Conservation Easement over the redefined wetland
area within Lot 2, Block 1, Klitzke Addition.
Adopted by the City Council of the City of Orono, Minnesota, at a regular �
meeting held on Deceniber 11, 1995.
