It is our opinion that as of the 26th day of June, 1989,
at 7:00 a.m., marketable record title in fee simple to the
above -described premises located in Hennepin County, Minnesota,
was vested in Dennis F. Kumlin, a single person, subject,
however, to the following defects, encumbrances and
qualifications:
1. Real estate taxes due and payable in the year 1989 in '
the amount of $4,629.16, the first one-half of which has been
paid. Base tax amount is $4,585.91. (Property I.D. No. 6� S a �$

dated May 5, 1989, filed May 9, 1989 as Document No. 2011286.

5. Easement for sanitary sewer purposes in favor of
Metropolitan Waste Control Commission granted in instrument
dated April 10, 1975, filed May 7, 1975, as Document No.
1138926 described in Exhibit A attached hereto.
6. Easement for conservation and flowage purposes in
favor of City of Orono granted in instrument dated October 4,
1978, filed October 12, 1978, as Document No. 1298185 described
in Exhibit B attached hereto.
7. Drainage and utility easements in favor of the public
created in the plat of Foxwood over five feet adjoining lot
lines and ten feet adjoining street.
8. We have based this opinion upon a registered property
abstract covering Certificate of Title No. 577068 prepared by
Title Insurance Company of Minnesota on August 14, 1986, as
well as a condition of title prepared by the Hennepin County
Registrar of Title's office on June 26, 1989 and other records
deemed appropriate.
This opinion is specifically limited to the matters shown
by the said registered property abstract and the said condition
of title. The following are certain matters which do not
appear of record and are not covered by this opinion and may
require additional inquiry or investigation:
a. Rights of the parties in possession, if any, other
than the owners whose interests are set forth in this
opinion.
b. Facts which would be disclosed by an accurate
survey.
C. Mechanic's lien rights, if any, for labor or
materials which have been furnished to the premises
or to property connected therewith within 120 days
prior to the date of certification of the abstract.
d. Public zoning, building, subdivision, historic
preservatiin, land use and environmental laws,
ordinances and regulations.

e. All rights in p�bl.tc roads and streets upon the land.
f. Special assessments which may be a lien against the
premises (but not included in the taxes in pte agraph
number 1 hereinabove).
g. Security interests which may be a lien agac:tst any
personal property you are purchasing or in crops or
fixtures under Chapter 336, Minnesota Statutes.
h. The presence of hazardous substances, hazardous
waste, pollutants or contaminants.
i. Any information known to you in addition to the
matters set forth in this opinion.
At your request, we will be happy to assist you in making
the further investigatio►ts recommended in this opinion.
The Hennepin County Registrar of Title's office advised us
that the Owner's Duplicate Certificate of Title is at the
Government Center.
