Re: Letter of Credit for Foxwood Second Addition
Dear Denny:
Staff has asked the City Engineer to review the road
improvement plans for your plat in order to determine an amount
for your letter of credit. Mr. Cook has advised that the amount
would be $25,875.00. Please see that the letter of credit is
delivered to this office no later than May 17, 1990.
The Foxwood Second Addition plat was approved at the end of
November, 1989, and a condition of that plat approval was that a
letter of credit would be provided to the City. The City also
assisted you by seeing that the plat was filed prior to the end
of the year so that you would not be forced to pay real estate
taxes due in 1990. Unfortunately I will have little to say over
this matter if we continue to not receive cooperation on your
part.
Please contact my office at your earliest convenience to
advise if you will be unable to provide the City with the
necessary letter of credit. In any event, if I do not hear from
you or if you do not respond by the deadline date of May 17th,
the City will be required to initiate a legal proceeding that
will flag the title of each of the lots created in the
subdivision to alert future buyers to the fact that the road
construction will not be financially supported and completed by
the developer.
