A RESOLUTION GRANTING PRELIMINARY
APPROVAL OF A CLASS II SUBDIVISION
OF LOT 2,BLOCK 1,BILL KELLEY'S LAND ,
-FILE NO.2031
VVI�REAS,Bruce R. Kelley(hereinafter the "subdivider") on May 26, 1995, filed
a formal subdivision application with the City for approval of a two lot residential plat of property
legally described as: �
Lot 2, Block 1, Bill Kelley's Land, Hennepin County, Minnesota (hereinafter
"the property"); and -
WI�REAS, after due published and mailed notice in accordance with Minnesota.
Statutes 462.358 et. seq. and the City of Orono's Zoning and Subdivision Codes, the Orono
� Planning Commission held public hearings on June 19, 1995 and October 16, 1995, at which
time all persons desiring to be heard concerning this application were given the opportunity to
speak thereon; and ,
WHEREAS, at their regular meeting held on November 13, 1995, the Orono
City Council considered the subdivision application of the subdivider noting the following
findings of fact: �
1. The property is located within the RR-1B Single Family Rural Residential
Zoning District requiring a minimum of two acres of contiguous dry buildable
� land within each newly created lot.
, 2. The property contains a total of approximately 6 dry acres. There are no
designated wetlands within the property.
3. The proposed plat consists of two residential lots each meeting the minimum
requirement of iwo acres of dry buildable area.
4. Both lots have 'c?een found to have adequate and suitable soils for on-site septic
treatment facilities. �

' S. The City Engineer, in his report of June 7, 1995, has approved the continued use
of the existing drive located within proposed Lot 2 as a shared drive to serve
both lots or proposed Lot 1 may be served at a single curb cut located to the
extreme east side of the lot. •
6. The plat of Bill Kelley's Land was approved by the City in December of 1977.
� The City did not ask for an internal road. Each lot met the required lot width
� along the public road and had been approved with individual curb cuts to each
building site.
7. Both Lots 1 and 2 have adequate lot width along Watertown Road and Willow
Road to provide individual curb cuts or access to property.
8. The existing structure on proposed Lot 1 shall be demolished and a new
• residence constructed. The existing septic system located within Lot 1 is non-
conforming and shall be abandoned and a new system installed per septic testing
. and design information submitted by applicant's consultant and as approved by
the Orono staff.
NOW, THEREFORE, BE IT RESOLVED, that based upon one or more of
the findings noted above, the City Council of the City of Orono hereby approves the
preliminary plat application of Bruce R. Kelley per plat drawings by Bruce R. Kelley, a
professional engineer and land surveyor, Registration Number 5713, dated May 26, 1995, most
revised date September 11, 1995, subject to the following conditions:
1. Dedication of drainage and utility easements 5' along interior lot lines and 10'
along the perimeter boundaries and adjacent to road rights-of-way.
2. Prior to residential construction on Lot 1, all preliminary and alternate septic
sites must be fenced off prior to any construction activities.
3. Prior to the City issuing a Certificate of Occupancy for the new residence on
Lot 1, the existing non-conforming septic system must be abandoned.

4. The subdivider and future owner of Lot 2 are hereby advised that a new septic
system must be, installed to serve the existing residence on Lot 2 prior to
occupancy.
5. Subdivider and future owner of Lot 2 is advised of the minimum lot area
.requirements of Section 11.03, Subdivision 24 of the Subdivision Regulations of
the City that would require the exclusion of all private pedestrian or vehicular
easement areas from the dry buildable lot azea of a property.
The following list of final submittals must be submitted to the Zoning Administrator two
weeks prior to the regularly scheduled Council meeting on the second and fourth Mondays of
each month. Required submittals are as follows: ,
1. Record plat drawings in the form of two (2) mylar copies and one (1) copy
• reduced to� 1" = 200'. Drawing to include:
� A. Lot lines platted per preliminary survey by Bruce R. Kelley, dated May
26, 1995, most revised date September 11, 1995.
B. Dedication of "drainage and utility easements" as noted in Item 1 above. �
C. Naming of plat.
2. Legai documents required:
A. Title opinion addressed to the City. All owners, mortgage holders or
others with property interest indicated therein shall sign the plat and a11
other documents affected by such interest.
B. The applicant must provide certified copies of all recorded easements
currently affecting the property.

3. Fees to be paid: Total due: 75.00*
A. Legal review and filing fees for subdivision only = $75.00
� * Upon Council's formal approval of the two lot plat, the subdivision shall be
. referred to the City Assessor to determine the value of the two acre lot. The
' park dedication fee shall be 8% of the fair market value of the undeveloped
two acre lot.
Adopted by the City Council of the City of Orono, Minnesota at a regular
meeting held this 13th day of November, 1995.
