HomeMy WebLinkAboutResolution 3629 ., �,r . � O 'V • O O b. - C ITY of URONO � ti '�' RESOLUTION OF THE CITY COUNCIL ��`�$'E Hpg'�'G NO. � � � � S A RESOLUTION APPROVING THE PLAT OF FRENCH CREEK WOODS FILE NO. 2022 WI�EREAS, the City of Orono is a municipal corporation organized and existing under the laws of the State of Minnesota; and WHEREAS, the City Cour�cil of the City of Orono has adopted subdivision regulations for the orderly, economic and safe development of land within the City; and WHEREAS, the City Council has considered the application for a subdivision of a four lot plat by Robert Melamed of Melamed/Lauer Partners, a Minnesota Limited Partnership (hereinafter the subdivider); and • WHEREAS, the subdivision has been found to meet all standards of the RR-]I3, R�.u�al Residential Zoning District,fmding that each lot is of a size and configuration that w.ill al:ow its use as a single family residence to b� fully developed without the need of any variances; and �VHEAEAS, the subdivider has completed all requirements of the platting regulations of the City, including: l. Completion of all the requirements of Resolution No. 3570, the resolution granting preliminary approval of the Class III subdivision. 2. Dedication on the plat of drainage and utility easements. 3. Dedication on the plat of right-of-way for a public road shown as Old Crystal Bay Road. 4. Subdivider has dedicated to the City drainage easements over all detention areas, wetlands, and drainageways within the plat providing for limitations on the use of these areas and shown on the plat as drainage easements. In addition the subdivider has dedicated to the City a Flowaae and Conservation Easement also setting forth the limitations on the use of the wetlands, drainageways and retention areas described . therein and shown on the plat as drainage easements. Subdivider has created private covenants dealing with the upkeep and maintenance of all drainage facilities and protective covenants for all lots containing wetlands not included within conservation maps of the City of Orono. The covenants shall include metes and bounds descriptions of the protected areas and a site plan locating these protected areas within each of the involved lots. 6. Subdivider has executed a Developer's Agreement providing for the installation of certain improvements as a condition of subdivision approval. Subdivider has also provided a letter of credit written to 150% of the cost of these required improvements. 7. Subdivider has created private covenants providing special buffer or conservation areas 50' along exterior lot lines, 30' in width along internal lot lines and 30' in width on each side of the shared driveways witlun French Creek Woods. Covenants would • restrict all land alterations and the removal of trees 2" or more in diameter at 4'above the ground unless the trees are dead, diseased or a hazard without first obtaining the • written consent of the City of Orono. Covenants shall include a map locating the special buffer/conservation areas as they impact each lot in the subdivision. 8. Execution of an Easement Agreement establishing the obligation of all residential property owners benefitting from the use of the City's private driveway located to the unmediate south of French Creek Woods. Lots 3 and 4, Block 1, French Creek Woods shall be served by a single shared drive. 9. Subdivider has provided written confirmation from the State Health Department that the well on Lot 1 has been abandoned. 10. Payment to the City for the legal review and filin� of the plat, easements and covenants in the amount of$200.00. 11 Payment to the City of final plat application in the amount of$175.00. NOW, THEREFORE BE IT RESOLVED, that the City Council of the City of Orono hereby approves the plat of French Creek Woods, Hennepin County,Minnesota, subject to the following conditions: � • l. No building permits will be issued by the City until all drainage facilities have been installed and approved by the City, and a satisfactory road base installed for the shared drives serving Lots 1 and 2 and Lots 3 and 4. 3. • Subdivider to dedicate a trail easement for a perpetual easement for public ingress, egress, access and trail purposes over and across an easement that encroaches Lots 1, 2 and 3, Block 1 of French Creek Woods. The easement shall include a legal description and a plan locating trail alignment within the subdivision. 4. Dedication by deed to the City of Outlot A. 5. Subdivider to create access easements over Lots 1 and 3 in favor of Lots 2 and 4. 6. The aforesaid plat shall be filed by the City of Orono with either the Hennepin • County Recorder's Office or a Registraz of Titles' Office on or before May 13, 1996 together with a certified original copy of this resolution and executed copies of the easements, deeds and covenants noted above. The appr�val granted by this resolution shall expire if the plat has not been filed by �he date specified above. In that everit it will be necessary to file a new application with the City of Orono for subdivision review. Dated this 13th day of November, 1995.
