HomeMy WebLinkAboutResolution 3624 �.�..:4�,♦. . . - . � . . , � O� O O � CITY of ORONO b` ^ A- � � �� �'�' RESOLUTION OF THE CITY COUNCIL ��kESHOg'� NO. e3 �' � � A RESOLUTION GRANTING V.ARIANCES TO MUNICIPA]L ZOI�tING CODE SECTIONS 1Q.55, SUBDIVISION 8, SECTION 10.22, SUBDIVISION 2,AND SECTION 10.56, SUBDIVISION 16 (J & L), GRANTING A CONDITIONAL USE PERNIIT PER SECTION 10.03, SUBDIVISION 19 FILE NO. 2056 WHEREAS,Michael and Barbara V+Tigley (hereinafter the "applicants") are owners of the property located at 1035 Tonkawa Road within the City of Orono (hereinafter "City") and legally described as follows: , Lot 3,Block 1,Carlwood,Hennepin County,Minuesota(hereinafter the "property"); and • WHER�AS, the applicants have applied to the City for variances to Municipal Zoni.ng Code Section 10.55, Subdivision 8, 10.56, Subdivision 16 (�, and 10.22, Subdivision 2 to allow grading for the purpose of constructing retaining walls within 75' of the lake where grading is normally prohibited, and variances to Sections 10.22, Subdivision 2 and 10.56, Subdivision 16 (L) to allow hardcover associated with such walls within 75' of the lake where no hardcover is normally allowed, and for a conditional use permit per Section 10.03, Subdivision 19 for land alteration near the lakeshore. NOW, THEREFORE, BE IT RESOLVED by the City Council of Orono, Minnesota: FINDINGS 1. This application was reviewed as Zoning File#2056. 2. The property is located in the LR-1B Single Famiiy Lakeshore Residential Zoning District. 3, The Orono Plaruvng Commission reviewed this application on August 21, 1995 and again after revisions by the applicant on October 16, 1995, and recommended � approval of the variances as noted above, based upon the following findings: • Page 1 of 5 � , � � ,r . ; � � O� • O ; O �b. � CITY o� ORONO � � ��� ��'�' RESOWTION OF THE CITY COUNCIL �k'ESH�� NO. e� � � � a. Planning Commission finds no justification for the initially proposed boulder walls at the base of the lakeshore bank, and finds no justification for the proposed excavation of the lakeshore bank to remove poison ivy. b. Planning Commission finds that construction of a boulder retaining wall at the top of the lakeshore bank will help to prevent surficial erosion from the ' yard azea near the house in the 0-75' zone without significant impact to the lakeshore bank nor to the existing trees and shrubs. c. Planning Commission fmds that the proposed plantings on the slope of the lakeshore bank are acceptable only in the context of no grading or excavation ' of the slope. � d. Planning Commission finds that the existing mulched area lined with � landscape fabric does not benefit from said fabric which constitutes hardcover, and therefore the fabric should be removed. e. Planning Commission fmds that the only hardcover appropriate for the 0-75' lakeshore setback zone on this property is the 4' x 40' existing stairway and the approximately 961ineal feet of nominally 2' wide boulder wall proposed at the top of the lakeshore bank. These noted items of hazdcover constitute approximately 352 s.f. or 3.7% in the 0-75' zone. 4. The City Council has considered this application including the fmdings and recommendations of the Planning Commission, reports by City staff, comments by the applicant and the effect of the proposed variance on the health, safety and welfare of the community. 5. The City Council fmds that granting the variances and conditional use pernut per the revised proposal will not be detrimental to the health, safety or general welfaze of the public,would not adversely affect light, air nor pose a fire hazard or other danger to neighboring property,nor will its use depreciate surrounding property values and that the proposed level of use of the property will be in keeping with the intent and objectives of the Zoning Code and Comprehensive Plan of the City. • Page 2 of 5 ., .,• .; � . � � � � O O �b. � CITY of ORONO � � . �� G'�' RESOLUTION OF THE CITY COUNCIL L�kESH�g'� NO. e� F � � CONCLUSIONS, ORDER AND CONDITIONS � � Based uponthe above findings,the Orono City Council hereby grants variances to Municipal Zoning Code Section 10.55, Subdivision 8, 10.56, Subdivision 16 (�, and 10.22, Subdivision 2 to allow grading for the purpose of constructing retaining walls within 75' of the lake where grading is nonnally prohibited, and variances to Sections 10.22, Subdivision 2 and 10.56, Subdivision 16 (L) to allow hardcover associated with such walls within 75' of the lake where no l�ardcover is nornially allowed, and grants a conditional use perniit per Section 10.03, Subdivision 19 for land alteration near the lakeshore, subject to the following conditions: 1. Boulder walls shall not be constructed at the base of the slope. 2. No excavation shall be allowed other than that necessary to accommodate boulder walls at the top of the lakeshore bank. • 3. Applicants shall remove the fabric mulch liner in the 0-75' setback zone prior to construction of the boulder walls. The only hardcover allowed in the 0-75'zone shall . be the existing 4'x 40'stairway and approximately 961ineal feet of nominally 2'wide boulder wall as shown on the approved site plan attached as Exhibit A. The applicants are advised that no additional hardcover is allowed in the 0-75' lakeshore setback zone. . 4. Applicants and their contractor shall adhere to "Best Management Practices for Protecting Water Quality in Urban Areas" during the process of boulder wall construction. 5. Authorities granted by this variance run with the property not with the applicants,but • are permissive only and must be exercised by application for a building permit within one�year of the date of Council's approval, or the special conditions of this resolution will expire on that date (October 23, 1996). 6.
