A RESOLUTION APPROVING TI�E PLAT
OF ROSCH ADDITION
FII.E NO.2051
WfiEREAS, the City of Orono is a municipal corporation organized and existing
under the laws of the State of Minnesota; and
WI�EREAS, the City Council of the City of Orono has adopted subdivision �
regulations for the orderly, economic and safe development of land within the City; and
WHEREAS, the City Council has considered the application for a Class III �
Subdivision of a four lot plat by Michael J. Hilbelink hereinafter(the subdivider); and
WHEREAS, the subdivision has been found to meet all standards of the RR-1B,
• Rural Residential Zoning District,finding that each lot is of a size and configuration that will allow
its use as a single family residence to be fully developed without the need of any variances; and
WHEREAS, the subdivider has completed all requirements of the platting
regulations of the City, including:
1. Completion of all the requirements of Resolution No. 3601.
2. Dedication on the plat of rights-of-way for public roads shown as Watertown Road
and Old Crystal Bay Road.
3. Creation of a new private road shown on the plat as Outlot A to be known henceforth
as Copper View Drive.
4. Concurrent with the creation of this private road the subdivider has dedicated to the
City a road and utility easement granting to the City permanent access, improvement
and utility easements over said outlot; the subdivider has created non-exclusive
ingress,egress,drainage and utility easements over said outlot in favor of a11 abutting
and/or benefitting lots including a declaration of certain maintenance covenants
� where in each of the abutting andlor benefitting lot owners' covenants and agrees to
permanently maintain and pay the cost of maintenance for said private road.

5. Subdivider has also included within that same declaration of maintenance covenant
a covenant whereby each of the benefitting four lot owners will permanently
maintain and pay the cost of maintenance for drainageways and drainage ponds
within said subdivision.
6. � Dedication to the City of a draina.ge easement providing for limitations on the use of
wetlands, drainageways and retention ponds described therein and shown on the plat
as drainage easements. Subdivider has chosen to include Type 1 wetlands not
designated on the City's Conservation Map within the drainage easements shown on
the plat and protected under this drainage easement.
7. Subdivider has executed a developer's agreement and posted a letter of credit written
to 150%of the cost of required improvements. Required improvements shall include
• all grading/drainage unprovements and road improvements as shown on plans and
specs by Mark S. Gronberg, a registered professional engineer, Job#95-233, sheet
1 of 1 dated 9/29/95.
8. Payment to the City of park dedication fee in the amount of$8,072.25. Fee has been
adjusted to exclude 9,803 s.f. of bike trail easement.
9. Payment to the City for the legal review and filing of the plat, easements and
covenants in the amount of$200.00. �
10. Payment to the City of final plat application in the amount of$175.00.
NOW, THEREFORE BE IT RESOLVED, that the City Council of the City of
Orono hereby approves the plat of Rosch Addition, Hennepin County, Minnesota, subject to the
following conditions:
1. Prior to the City issuing a building pernut for new construction on Lot 4, the ditch
along the north side of Watertown Road is to be excavated and trees cleazed in the
right-of-way to improve drainage and site d.istance at curb cut. �
� 2. Well within Lot 4,Block 1 is to be sealed off as regulated per State standards if well
� is not served a new residential construction.

3. The aforesaid plat shall be filed by the City of Orono with either the Hennepin
County Recorder's Office or a Registrar of Titles' Office on or before April 23, 1996
together with a certified original copy of this resolution and executed copies of the
covenants and easements noted above.
•The approval granted by this resolution shall expire if the plat has not been f led by
the date specified above. In that event it will be necessary to file a new application with the City of
Orono for subdivision review. Dated this 23rd day of October, 1995.
