� WHEREAS, the Hennepin County Department of Environmental Management,
(hereinafter "applicant")has applied to the City of Orono (hereinafter "City") for a conditional use
pernut per Section 10.03, Subdivision 19 to permit the repair of a seawa�l at the North Arm public
access.
NOW, TI�EREFORE, BE IT RESOLVED by the City Council of Orono,
• Minnesota:
FINDINGS
1. This application was reviewed as Zoning File#1820.
2. The property is located in the LR-1C Lakeshore Residential Zoning District.
3. On May 17, 1993, the Orono Planning Commission reviewed the application as
.proposed and recommended approval of the conditional use permit based on the
following findings:
A) On January I3, 1986 the City of Orono granted a conditional use permit for
the installation of the seawall at the North Arm access.
B) Repair involves repiacement of existing wooden sections of wall adjacent to
the ramp area and replacement with steel sections. The wooden sections of
the wall are in a seriQUS state of disrepair and present a hazard for the public
who use the access.

4. Applicant has provided a grading, drai.nage and landscape plan providing for
stormwater management and improving shore fishing access in accordance with the
Americans with Disabilities Act.
5: The City Council finds that granting a conditional use permit to a11ow the repair of ,
the seawall will not be detrimental to the health, safety or general welfare of the
� public,would not adversely affect light, air nor pose a fire hazard or other danger to
neighboring properties,nor will its use depreciate surrounding property values and
that the proposed level of use of the property will be in keeping with the intent and
objectives of the Zoning Code and Comprehensive Plan of the City.
6. The City Council has considered this application inclucling the fmdings and
recommendations of the Planning Commission,reports by staff and comments of the
applicant and the affect of the proposed use on the health, safety, and welfare of the
� community.
CONCLUSIONS, ORDER AND CONDITIONS .
Based upon one or more of the findings, the Orono City Council hereby grants a
conditional use permit per Municipal Zoning Code Section 10.03, Subdivision 19 to permit the
repair of the seawall at the North Arm access subject to the following conditions:
1. Applicant shall install a treatment facility for surface water control as it relates to
sediment,debris and other pollutants that wash into Lake Minnetonka from the paved
paxking area at the North Arm access. All improvements shall be installed per
concept plan dated July 20, 1995 by the Hennepin County Department of
Environmental Management and the Minnesota Department of Natural Resources
Trails and Wate�-ways Unit, attached to this resolution.
2. A maintenance schedule shall be established by the applicant for- the three
sedimenta.tion infiltration areas. Maintenance procedure shall also include the
cleaning of geo-textile fabric within the french drain to ensure against flooding and
damage to surrounding plantings. �

3. Violation of or non-compliance with any of the terms and conditions of this
resolution shall constitute a violation of the Zoning Code, shall automatically
terminate any authority granted herein, and shall be punishable as a misdemeanor.
4. The undersigned applicant on behalf of the Hennepin County Department of
Environment Management has read, understood and hereby agrees to the terms of
�this resolution.
Adopted by the Orono City Council on this 23rd day of October, 1995.
