WHEItEAS, the City of Orono is a rnunicipal corporation organized and existing
under the laws of the State of 1Vlinnesota; and
WI�EREAS, on November 16, 1995, Rodney A. Crawford and Ann C. Crawford
(hereinafter �the "applicants") filed a petition with the City of Orono requesting the vacation of
� a portion of an unimproved dedicated road right-of-way adjacent to their property originally
dedicated in the plat of Bergquist and �1Vicklund°s Park, Hennepin County, Minnesota in 1888
and legally described as follows:
• that part of Lake 5treet as dedicated to the public in the plat of Bergquist and
Wicklund's Pazk, Hennepin County, Minnesota �whi�h lies between the extensions across
it of the westerly line of Lot 1, Block 1, Tristana Cc�ve, and the southerly port�on of
the easterly line of said Lot 1; and
WHEREAS, after due published and posted notice, a pu�lic hearing was held
before the City's Planning Commission on January 16, 199G regarding saici vacation and all
interested persons were given an apportunity to be heard; and
WHEREAS, after due standing and consideration, the Planning �onunission
recommended unanimuus approval of the proposed vacation; and
W73EIt�AS, the City Council of the �ity of Orono finds that said vacation as
proposed is in keeping with the public interest and in consideration of the following findings:
1. Major portinns of platted Lake Street are now located below the Ordina.ry High
Water Level at 929.4 of Lake Minnetonka.
2. The location of the right-of-way as it e�ists today could never serve for public
road purposes because of steep topographies and preximity to lakeshore.

3. The dedicated road ri�ht-of-way as it exists today serves no other public
' , purpose.
NOW, THEREFORE, BE 1T It�SOLVED, that the petition of Rodney A.
Crawford and Ann C. Crawford is hereby granted by the Council of the City of Orono and that
the portion of unimproved Lake Street legally described above is hereby vacated. The granting
of the petition is subject to the following condition:
1. Applicant to grant a 20' wide access and utility easement over the existing sewer
� line within the unimproved right-of-way of Lake Street.
Adopted by the City Council of the City of Orono, Minnesota at a regular
meeting held on January 22, 199G.
