A RESOLUTION VACATING
AN UNIMPROVED ALLEY WITHIN THE PLAT OF
OTTOVILLE ON LAKE MINNETONKA
II�T THE CITY OF ORONO,
HEI�i\'EPIN COUNTY, MINNESOTA

WHEREAS, the City of Orono is a municipal corporation organized and existing
under the laws of the State of Minnesota; and
WHEREAS, on October 31, 199�, Steven A. Gardiner (hereinafter the
"app?icar:t") �ilea a petition ��ith the City of �rono requestin� the vacation of an unimproved
public right-of-way adjacent to his preperty originally dedicated in the plat of Ottoville on Lake
Minnetonl:a, Hennepin County, I��innesota in 1887 and legally described as follo�vs:
that part of alley adjacent to Lots 2 and 3 dedicated in the plat of
Ottoville on Lake Minnetonlca lying southerly of the westerly extension
of north line of said Lot 2 and northerly af the northwesterly right-of-
way line �f County Road 84 (AKA Bayside Road) according to the
recorded plat thereof, Hennepin County, Minnesota; and
VVHEREAS, after due published and posted notice, public hearings �vere held
before the City's Planning Commission on November 20, 1995 and January 16, 1996 regarding
said vacation and all interested persons were given an opportunity to be heard; and
`VHEREAS, after due standing and consideration, the Planning Commission
recommended unanimous approval of the proposed vacation; and
V4'HEREAS, the City Council of the City of Orono finds that said vacation as
proposed is in keeping with the public interest and in consideration of the follo�ving findings:
1. The ri�ht-of-��vay as it exists today will not serve for public road use based on
the pattern of residential development and access to adjacent properties.
?. The unimproved right-of-way contains r.o mur.icipal sewer nor other utilities.

3. The dedicated road right-of-way as it exists today serves no other public
purpose.
NOW, THEREFORE, BE IT RESOLVED, that the petition of Steven A.
Gardiner is hereby granted by the Council of the City of Orono and that the unimproved alley
legally described above is hereby vacated. Trie granting �f tt;e petition is subject to the
following conditions:
l. Applicant shall apply for the legal combination of the vacated alley with Lots
1, 2, 3 and 4, Ottoville on Lake Minnetonka.
2. Applicant is hereby advised that the City will not consider an improvement plan
for this property until Hennepin County has completed the vacation and res�lved
the final dispersal of the vacated alley.
Adopted by the City Council of the City of Orono, Minnesota at a regular
meeting held on February 12, 1996.
