A RESOLUTION GI2�INTING
� A VARIANCE TO
� MUNICIPAL ZONING CODE
SECTION 10.24; S�JBDIVISION`'S (B)

WHEREAS, Robert S. Edmunds and Debra K. Edmunds (hereinafter "the
applicants ) are owners of the property loeated at 1030 Tonkawa.F.��d within the City� of
��
Orono (hereinafter "City") and legally described as follows:
Tract C, Registered Land Survey No. 617, Hennepin Couilty, Minnesota (her.einafter "the
property"); and
• WHEREAS, the applicants have applied to the City for a variance to Municipal
Zoning Code Section 10.24, Subdivision 5 (B).to perinit construction of a new residen:.e on
a lot that measures 101' at both the Ordina.ry High Water Level<(hereinafter OHWL) of Lalce
Minnetonka and at the 75' setback from flie OHWL where 140' in width is required.
NOW, THERE�'ORE, BE IT RESOLVED by ti�e City Council of Orono,
Minnesota:
�'�NDINGS
1. This application was reviewed as Zoning File #210U.
2. The property is located in the LR-1B, Lakesliore Residential Zoning Distt7ct
requiring 1 acre in area. The property consists of 1.56 acres.
' ;. The Orono Planning Commission reviewed this application on January •16, 1996,
and recommended approval of the variance based upon the following unique
findings and hardships:

A. Registered Land Survey No. 617 was filed at the County on November
30, 1956 prior to the current standards for the development of residential
property within the LR-1B Zoning District.
B. There is no additional land adjacent to the property to combine with the
parcel to create a confornung lot.
C. The new residence will meet all other required standards of the LR-1B
Zoning District and other pertinent sections of the zoning code.
D. The final approved grading plan has co�rmed that the adjacent
residences will not be impacted by runoff from the proposed residential
construction.
• E. The City has received no verbal or written objections to the proposed
, residential construction from the adj acent property owners.
F. The width of the property is consistent with the widfli of the adjacent
properties in the surrounding neighborhood.
4. The City Council has considered this application including the findings and
recommendations of the Planning Commission, reports by City staff, comments
by the applicants and the effect of the proposed variance on the health, safety
and welfare of�the community. �
5. The City Council finds that the conditions existing on this property are peculiar
to it and do not apply generally to other property in this zoning district; that
granting the variance would not adversely affect traffic conditions, light, air nor
. pose a fire hazard or other danger to neighboring property; would not merely
serve as a convenience to the applicants, but is necessary to alleviate a
� demonstrable hardship or difficulty; is necessary to preserve a substantial
property right of the applicants; and would be in keeping with the spirit and
intent of the Zoning Code and Comprehensive Plan of the City.

CONCLUSIONS, ORDER AND CONDITIONS
� Based upon one or more of the above findings, the Orono City Council hereby
grants a variance to Municipal Zoning Code Section 10.24, Subdivision 5 (B) to permit the
construction of new residence struciure at the property located at 1030 Tonkawa Road, subject
to the following conditions:
l. All grading and drainage improvements shall be completed as shown on the
approved grading plan, a detail of which has been included as page 6 of this
resolution. It shall be the responsibility of the City Engineer to inspect all final
grading to ensure that the final grades and other improvements confortn to
specifications and elevations in the grading plan. Applicants plans confirm that
there will be no need to install retaining walls in excess of a 4' height.
� 2. Authorities granted by this variance run with the property not with the
applicants, but are permissive only and must be exercised by application for a
building permit within one year of the date of Council approval, or this variance
will expire on that date (February 12, 1997).
3. Violation of or non-compliance with any of the terms and conditions of this
resolution shall constitute a violation of the zoning code, shall automatically
terminate any authority granted herein, and shall be punishable as a
misdemeanor.
4. The undersigned applicants have read, understood and hereby agree to the terms
of this resolution and on behalf of themselves, their heirs, successors and
assigns, hereby agree to the recording of this resolution in the chain of title of
the property. .
