HomeMy WebLinkAbout1996-01-08 Resolution 3660CITY of ORONO RESOLUTION OF THE CITY COUNCIL NO. 3 660 A RESOLUTION APPROVI?�iG TfJF PLAT OF BILL KELLEYS LAND 2ND DMSION FELE NO. 2031 WHEREAS, the City of Orono is a municipal corporation organized and existing under the laws of the State of Minnesota; and WHEREAS, the City Council of the City of Orono has adopted subdivision regulations for the orderly, economic and safe development of land within the City; and WHEREAS, the City Council has cot,sidered the application for a Class II subdivision of a two lot plat by Bruce R. Kelley, (hereinafter "the subdivider"); and WHEREAS, the subdivision has been found to meet all standards of the RR-lB, Rural Residential Zoning District finding that the newly created lot and developed lot are of a size and configuration that would allow their use as a single family residence to be fully developed without the need of anv variances; and WHEREAS, the subdivider has completed all requirements of the p!atting regulations of the City, including: 1. Completion of all the requirements of Resolution No. 3630, the resolution of the City granting preliminary approval of tht, two lot plat. Dedication on the plat of drzinage and utility easeme►+•s. 3. Payment to the City of a park dedication fee in the amount of $6,776. 1. Payrient to the City for the legal review and filing of the plat and resolution in tilt! amount of S75.00 NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of Orono hereby approves the plat of Bil! Kelleys Land 2nd Division, Hermepin County, Minnesota, subject to the following conditions: Paee 1 of 2 CITYof ORONO RESOLUTION OF THE CITY COUNCIL NO. 3 660 Prior to w residential construction on Lot 2, all preliminary and alternate septic sites must be fenced off prior to all related construction activities. 2. Prior to the City issuing a Certificate of Occupancy for the new residence on Lot 2, the existing non -conforming septic system must be abandoned that currently serves the residence on Lot 1. The subdivider and future owner of Lot 1 are hereby advised that a new septic system must be installed to serve the existing residence on Lot 1 prior to occupancy. 3. The subdivider and future owner of Lot 1 is hereby advised of the minimum lot area requirements of Section 11.03, Subdivision 24 of the Subdivision Regulations of the Orono Municipal Code that would require the exclusion of all private pedestrian or vehicular easement areas om the dry buildable area of a lot. 4. The aforesaid plat shall be filed by the City of Orono with either the Hennepin County Recorder's Office or Registrar of Titles Office on or before July 8, 1996 together with a certified original copy of this resoL.ion. The approval granted by this resolution shall expire if the plat has not been filed by the date specified above. In that event, it will be necessary to file a new application with the City of Orono for subdivision review. Dated this 8th day of January, 1996. A borothy M.
