A itESOLUTION APPROVING TIiE PLAT
OI+' TOX H�L�OW
FILE NO. 2020
W�12]EAS, the City of Orono is a municipal corporation organized and existing
under the laws of the State of Minnesota; and
W]EIJEI�LAS, the City Council of the City of Orono has adopted subdivision
regulations for the orderly, economic and safe development of land within the City; and
VVI�EREAS, the City Council has considered the application for a Class III
subclivision oi a 3-lot plat Uy James Bruce of Bruce Construction Company, a Minnesota
carporation, hereinafter (the subdivider); and
• WHIER]EA5, on July 10,-1995, xhe City Council approved Resolution No. 3574
approvirig the preliminary plat of 3 lots and a lot width variance for Lot 3 at 2" based on the
uni:�ue findir�gs and hardships set forth in that resolution. The subdivision has been found to
m:,et all nther standards of the LR-1A, Lakeshore Residential Zoning District, finding that each
lot is of a size and configuration that will allow its use as a single family residen.ce to be fully
dcvelaJ3ed without the n�ed of any variances; and
V6'�I�REAS, the subdivider has completed all requirements of the platting
regulations af the City, including:
1. Com�letion of all Ei�e requirements of Resolution No. 3574, the resolution that
granted preliminary approval of the 3-lot plat.
2. Dedication on the plat of drainage and utility easements.
3. Dedication on the plat of a�0' wide drainage easement over the drainageway t��at
intersects Lot 1. •
4. Dedication on the plat cf a 15' utility easement within Lot 1 that would provide
future sewer extensi�n to the properties t.o the unmediate east.

5. Dedication on the plat of a 15' utility easement that will provide private sewer
service to Lot 3. The easement is located within Lot 1 and along the shared lot
lines of Lots 1 and 2 for a distance of 101.48'.
6. The subdivider has created an amendment to the private covenants for the Stielow
Addition addressing the obligation of Lots 1 and 2, Fox Hollow to share in the
maintenance and upkeep of Oxford Road.
7. Payment to the City of the park dedication fee in the amount of $14,400.00.
8. Payment to the City for$48,450.00 for two sewer units ($24,225.00 for each unit
based on 1995 fee schedule).
9. Payment to the City for the legal review and filing of the plat easements and
covenants in the amount of $200.00.
• 10. Payment to the City for $175.00 for the final plat application.
NOVV, THEREFORE BE IT RESOI.V�ll, that the City Council of the City of
• Orono hereby approves the plat of Fox Hollow, Hennepin County, Minnesota, subject to the
following conditions:
1. The existing drive that extends through Lot 3 to the cul-de-sac within Lots 1 and
2 shall remain while existing residence structure on Lot 2 is occupied. No
construction vehicles shall be allowed to use the existing to gain access to Lots
1 and 2. All access for new construction on Lots 1 and 2 shall be from approved
driveway entrances at Oxford Road.
2. Future owners or developer shall provide detailed engineering plans and specs for
the extension of municipal sewer to Lot 3. Plans shall address the connection to
the municipal sewer line and repair of Oxford Road per Ciry Engineer's report
of May 3, 1995.

3. The existing residence structure on Lot 2 may never be used as a second
residential unit or guest house as properry does not meet the area requirements
for a guest house located within the LR-lA Lakeshore Residential zoning district.
4. The aforesaid plat shall be filed by the City of Orono with either the Hennepin
County Recorder's Office or the Registrar of Titles Office on or before March
25, 1996 together with a certified original copy of this resolution, covenants and
easements noted above.
,The approval grantPd by this resolution shall expire if the plat.has not been filed by the
date specified above. In that event it will be necessary to file a new application with the City
of Orono for subdivision review. Dated this 25th day of September, 1995.
