A ItESOY�UTION APPROVING TIiE . . .� � PLA1' OF:LAK�SIDE HEIGHTS FILE NO. 1921 VVHEREAS, the City of Orono is a municipal corporation organized and existing un�er the laws of the State of Minnesota; and �T��S, the City Council of the City of Orono has adopted. subdivision regulations for.�he orderly; economic and safe development of land witb.in the City; and �:'�V��I�AS, the City.Council has considered th� ap;�li�ation for a subdivisi�r�by ; T�1ary A. Ulrich (hereinafier "the subdivider"); and • W�REAS, on May 8, 1995,:the City Council approved Resolution No. 3`5b �rantiri� preliminary approval for a plat at.1000 Loma Linda Avenue; and WHEFf�AS, the property is located within the LR-1B Single Family Lakesl�7re Reside�tial Zon�ng District requiring a minimum of one acre of contiguous dry buildabtz land �.vithin each newly created lot. Each of the proposed lots meets the required one acre dr}� contigucus land area, Lot 1 being 1.27 acres in dry buildable area uid Lot 'L being 1.10 acres in � dry buildable area; and WfiEREAS, the Orono Comprehensive Plan requires only 33' of right-of-way for County Road 151 and therefore the City will require a 33' right-of-way dedication for County Road 151. Further, 25' of right-o.f-way will be dedicated on the plat for the north haif oi Lama Linda Avenue; and WHEREAS, due to the proposed dedication of right-of.-way for Loma Linda � Avenue, the existin� house within Lot 2 will remain at its existing location 33.0' from the riaht- of-way line where a 35.0' setback would normally be required. Dedication to the City of a"flowage �and conservation easement providing for limitations on the use of the wetland described thereiri and shown on the plat as "drainage easement". 4. " Payment to the Ciry of final plat legal review �d filing fees of$200.00. . 5. Payment to the City of a park dedication fee in the amount of$3,600.00. � �NOW, TI�EREFORE, BE IT RESOLV]ED, that the City Council of the Ciry of Orono hereby approves the plat of Lakeside Heights, I3ennepin Counry, Minnesota, and_grants a variance . ' � to Section 10.2�; Subdivision 5 (B) to allow the existing residence to remain in its current locati�n , ' '�33:0'Mfrom the f�ont lot line where a 35.0'�setback is�normally required;':subject�to the followin� conditions: � . 1. "' � The existing house sewer connection shall be relocated to I,�ma Linda Avenue, and the new ho�.�se on Lot 1 shall use the existing southerly stub at County Road 151. 2. The driveway entrance for Lot 1 shall be on Loma Linda Avenue at a location to be approved by the Public Works Director. 3. While the City shall not be party to the view easement over Lot 1 in favor of Lot 2, the location and extent of said easement shall not be revised from that proposed without notification of the City. 4. The aforesaid plat shall be filed by the City of Orono with the Hennepin County Recorder's Office on or before March 25, 1996 together with a certified original copy of this resolution and executed copy of the conservation and flowage easement document. The approval granted by this resolution shall expire if the plat has not been filed by the date specified above. In that event, it will be necessary to file a new application with the City of Orono for subdivision review.
