Section 10.03, Subdivision 15 - "Non -encroachments", a] lows a maximum fence height of 3-1/2' (42") in the street yard of a lakeshore lotwhich does not abut a major thoroughfare. On Casco Point Road in the LR-IC Zone, no fence higher than 42" is allowed within 30' of the road right-of-way. 2. Section 5.36 - "Kennels", regulates commercial and residential kennels and kennel structures. Specific pertinent code requirements include: A. The definition of kennel structure includes fenced - in yard areas that contain less than 600 s.f. per dog. R. A residential kennel license is required if a kennel structure is located in a "side or rear yard" and is less than 30' away from any property line. Zoning File #1534 May 16, 1990 Page 2 Discussion As of this writing, the applicant has not submitted all of the necessary supporting information requested for this application. staff requested a property survey and site pla•, and the applicant also noted in his letter of request tha he would be providing photographs. Only a sketch has been submitted. The fenced area would appear to be 23' x 35' or 805 s.f., and being from 2'-4' from the side lot line and 13' from the strut. Absent a survey, it is impossible to verify that this fence is even on the property. Eased on the sketch, this enclosure for 2 dogs would require a kennel license. Staff Recoa ndation Absent the requested survey on which to base a review of the variance application, staff cannot make a reasonable recommendation and would request that. this request be tabled until such time that the necessary information is provided. His placement for this chain link enclosure is adjacent to his garage, at the street side of hi-, lot. This area histortrally (for the 20+ years we have lived here) is covered with underbrush and has looked rather ratty. Mr. Amundson has greatly improved the appearance and now seeks to put this; otherwise unuseable portion of his yard to good use. I will take this opportunity to grant my concurrence with his wishes, to state that there will be no adverse impact on our property, and to point out that the area is away from the more 'If-ved in' areas of our -:ard. ORONO PLANNING COMMISSION MEETING HELD MAY 21, 1990 ZONING FILE #1529-THIESSE CONTINUED Johnson asked what purpose Outlot A, located northeast of Mr. Thiesse's property, serves. Gaffron explained that Outlot A provides lake access for two Bayside Landing lots and that it cannot be developed. Bellows commented that Outlot A gives visual and realistic relief to Mr. Thiesse's site. She stated that since Outlot A is unbuildable, and that condition runs to the land, it provides a unique condition for approving a variance for Mr. Thiesse. It was moved by Bellows, seconded by Moos, to recommend approval of the side setback, street setback, and hardcover variance for construction of an attached 2-car garage as set forth in the application without a turn -around. Gaffron questioned whether the Planning Commission would approve a turn -around apron in the County right-of-way if the County approves. It was the consensus of the Planning Commission that they would approve a turnaround it the right-of-way. Motion, Ayes-6, Nays-0. Motion passed. #1534 ROLLAND AMUNDSON 3135 CASCO CIRCLE VARIANCE PUBLIC HEARING 9:43 P.M. TO 9:50 P.M. Mr. Amundson was present. The Affidavit of Publication and Certificate of Mailing were duly noted. Gaffron briefly explained Mr. Amundson's proposal, noting that a sketch had been submitted in lieu of a suivey. Mr. Amundson showed the Planning Commission photographs of the area where he is proposing to place the dog kennel. Kelley asked Mr. Amundson to explain the hardship for his variance request. Mr. Amundson replied that he needs to ,lace the kennel clt-aer than 30' to the road. Bellows asked Mr. Amundson whether he had investigated the option of using an "invisible fence" which would be an effective and viable alternative. Mr. Amundson stated that the fence will be invisible from the street and will have no impact on the neighbors. Mr. Amundson said that the survey would cost more than the fencing. Kelley asked Mr. Amundson if it would be possible to reduce the size of the kennel. Mr. Amundson replied that it is necessary to have the kennel large enough so the dog can reach the road. He said that otherwise the dog would not detect anyone trespassing on -:,e property. Kelley polled the Planning Commission for their opinion regarding approval of the kennel. Kelley indicated that he is opposed to approving the variance. Johnson, Hanson, Moos and Bellows indicated that they would look upon the request more favorably if a survey were submitted. Johnson stated that Mr. Amundson should be required to subm-t a survey. He said that it is a requirement and though it may be a financial hardship, it is required of everyone that applies for a variance. Kelley asked Mr. Amundson whether he would like the Planning Commission to table this matter. Mr. Amundson stated that he would have a survey prepared for th.• Planning Commission to review. A site inspection reveals that applicant has constructed only a minimal dog pen immediately adjacent to the attached garage and the fenced area appears to be more than 30' from the right-of-way. Therefore, it appears that r:o variance is required. Staff time expended on this application is 1.0 hour at $27.50. In addition, the cost of publication of public hearing notice was $2.50. Therefore, the total expenditure on this application is $30.00. The application fee submitted was $175.00, leaving a balance of $145.00 to be refunded.
