A RESOLUTION �ACATING
AN UNIMPROVED POR�ION OF
NAVARRE LANE IN TIiE CITS� OF OAONO,
HENNEPIN COUNTY, MINNESOTA
FILES NO. 2107 & 2126 �
• WHEREAS, the City of Orono is a municipal corporation organized and
existing under the laws of the State of Minnesota; and
WHEREAS, on January 26, 1996 John O'Sullivan and Erwin Smith,
(hereinafter "the applicants"), filed a petition with the City of Orono requesting the vacation
of a portion of a public right-of-way known as Navarre Lane located within Hennepin
County, Minnesota, and legally described as follows:
• That part of Tract A, REGISTERED LAND SURVEY NO 1433, described as
follows:
Beginning at the most northerly corner of said Tract A; thence southeasterly along
the northeasterly line of said Tract A, 33.08 feet, to the intersection with a line
33.00 feet southeasterly of and parallel with the northwesterly line of said Tract A;
thence southwesterly and parallel with the northwesterly line of said Tract A, 279.64
feet; thence northwesterly to a point on the northwesterly line of said Tract A,
253.03 feet southwesterly of the most northerly comer of said Tract A; thence
northeasterly along the northwesterly line of said Tract A, 253.03 feet to the point
of beginning, Hennepin County, Minnesota; and
WHEREAS, after due published and posted notice a public hearing was held
by the City's Planning Commission on February 20, 1996 regarding the proposed vacations
and all interested persons were given an opportunity to be heard; and
��VHERE�iS, after due standing and consideration, the Planning Commission
recommended unanimous approval of the proposed vacation; and
VV�iEREAS, the City Council of the City of Orono finds that said vacation
as proposed is in keeping with the public interest and in consideration of the following �

1. Navarre Lane has been barricaded at the intersection with County Road 19 since the
early 1960s and has not been open to vehicular traffic.
2. The proposed vacation will not landlock any adjacent property.
� NOW, THEREFORE, BE IT RESOLVED, that the petition of John
O'Sullivan and Erwin Smith is hereby granted by the Council of the City of Orono and that
the unused portion of Navarre Lane as legally described above is hereby vacated. The
granting of the petition is subject to applicants providing drainage and ;utility easements over
the 33 feet of vacated right-of-way. The applicants shall apply to the City offices for the
legal combination of the portion of the vacated road with their commercial zoned property.
Adopted by the City Council of the City of Orono, Minnesota at a regular
• meeting held on May 13, 1996.
