A RESOLUTION VACATING A PORTION OF
AN UNIMPROVED STREET WITHIN THE
PLAT OF BAYSIDE ADDITION TO LAKE MINNETONKA,
HENNEPIN COUNTY, MINNESOTA
FILE NO. 2122
� . WHEREAS, the City of Orono is a municipal corporation organized and
existing under the laws of the State of Minnesota; and
' WHEREAS, on February 29, 1996 Karen S. Skoog and Tamera A.
Christensen, (hereinafter "the applicants"), filed a petition with the City of Orono requesting
the vacation of a portion of an unimproved public right-of-way originally dedicated in the
plat of Bayside Addition to Lake Minnetonka, Hennepin Counry, Minnesota, and legally
described as follows:
• - As that part of Hill Street which lies between the southerly extensions of the east
and west lines of Lot 9, Block 2, "Bayside Addition to Lake Minnetonka", Hennepin
County, Minnesota; and
WHEREAS, after due published and posted notice, a public hearing was held
by the City's Planning Commission on April 15, 1996 regarding said vacation and all
interested persons were given an opportunity to be heard; and
WHEREAS, after due standing and consideration, the Planning Commission
recommended unanimous approval of the proposed vacation; and �
WHEREAS, the City Council of the City of Orono fmds that said vacation
as proposed is in keeping with the public interest and in consideration of the following
findings:
1. The unimproved right-of-way contains no municipal sewer or other utilities.
2. The 40 foot right-of-way has never been developed as a public street.

3. The unimproved 40 foot right of way has been found to serve no future public
purpose.
NOW, THEREFORE, BE IT RESOLVED, that the petition of Karen S.
Skoog and Tamera A. Christensen is hereby granted by the Council of the City of Orono
and that the portion of the unimproved street legally described above is hereby vacated.
The granting of the petition is subject to Philip and Karen S. Skoog granting a drainage &
utility easement over the southerly 10 feet of vacated Hill Street and applying for the legal
combination of the vacated right-of-way with their homestead parcel, Lots 9 and 10, Block
2, "Bayside Ac�dition to Lake Minnetonka".
Adopted by the City Council of the City of Orono, Minnesota at a �regular
meeting held on May 13, 1996.
