Please contact Jeanne Mabusth if you have any further questions concerning the review of your application. ch l\fINUTES OF THE REGULAR ORONO CITY COUNCIL l'rU:ETIN'G HELD ON :MAY 22, 1995 POLICE CHIEF REPORT Chief Sullivan reported that the department is taking a new approach to police service for the contract cities. These cities will be included in setting goals, and monthly dialogue is planned for more effective police cooperation and effectiveness. Sullivan said there were plans for more intensive bike patrol during the summer months v.-ith more hours set aside for this patrol. Preventive measures are being taken and have beQUn alono the Luce Line Trail and in Long Lake Parks. The focus will be on times of :::, :::, ~ heavier use eveninos and weekends with patrol rotation and fluctuating times. , 0 ' - Callahan commented on a letter regarding Officer Kamitz' involvement with the K-9 Corps Training. It was Callahan's understanding that the K-9 Unit had been abolished . Chief Sullivan said the officer did this training on his own time and did not inform Sullivan of this training until its completion. Officer Kamitz is a part-time officer. Hurr referred to the past experience with the K-9 Unit and problems with dogs and officers not working out well. Hurr asked for input on whether this unit should be reinstated. Jabbour said the Council should be involved in giving and getting input on this issue. With recent cases involving narcotics, murder, and forgery, this program should not be dismissed. Callahan asked for a presentation from an administrative viewpoint for a future decision by the Council. Callahan asked Sullivan of the progress in monthly communication, officers' appearance in court, and what departmental steps were being taken to assure that all court dates are being represented. Sullivan said he will initiate a policy to address this issue. Some procedural changes have been made. Subpoenas in felony cases are now being opened and monitored, where in the past, were only delivered. Callahan asked for follow-up on this matter. Callahan asked if a scholarship was provided for a girl to attend the North Tonka Crime Prevention training camp. Sullivan said $17 5 was approved for this :funding. Sullivan informed Kelley that the department was not involved in the Interstate 3 94 patrol saturation. J -Amended Hardcover Plan K -Detail on 250-500' Setback Area Description of Request The applicants propose an 11' x 18' single story addition at the east side and a 14' x 14' entrance portico on the west side of the 70+ year residence. Review Exhibit K, a major portion of the 250-500' setback area serves as access drive for two adjacent properties and applicants' Request for Council Action continued page 2 May 17, 1995 Zoning File #2008 property and 2,767 s.f. of a vehicular access easement is excluded from lot area. Major portions of the existing blacktop area located out of the easement also serve the property to the immediate west of the subject property. The total area exclusive of the easement area is covered with either blacktop or landscape areas underlain with plastic. Although the proposed improvements area located within the 75-250' setback area, the Planning Commission did condition approval on applicant removing approximately 198 s.f. of paved area to the east side of the upper level garage. Refer to Exhibit J, the amended hardcover plan. Applicant noted difficulty with removing hardcover within the 250-500' setback area because of the steepness of the elevations and the detached garage has both an upper and lower level with access drives provided at the north and west sides. Hardcover in the 75-250' setback area has been reduced by 421 s.f. or 2.4%. Both structures meet the required setbacks of the lakeshore zoning district. The portico will be located over an existing non-structural hardcover improvement. Planning Commission members also noted that the 100' deep lakeshore yard is grassed with no structure. Planning Commission Recommendation The Planning Commission recommended unanimous approval of the hardcover variances as amended, based on the hardships set forth by applicant on Exhibit A reviewed as follows: 1. The existing dwelling was built in the 1920's prior to standards for lakeshore development. 2. The house was originally installed on property where a street was designated between the cottage and lake. The proposed improvements are designed to reverse interior home to take advantage of the lake views. 3. Hardcover is reduced in the 75-250' setback area from 29.5% to 27.1 %. 4. There will be no impact upon the views of the neighbors nor on required setbacks. 5. There is approximately 176' x 100' of non-hardcover area within the lakeshore yard. The grassed lawn gently slopes and receives the major portion of drainage that comes from the higher elevations to the north. The enclosed approval resolution has been drafted per the Planning Commission's recommendation. COUNCIL ACTION REQUESTED: To either deny, approve or amend the enclosed approval resolution. lsv A RESOLUTION GRANTING A VARIANCE TO MUNICIPAL ZONING CODE SECTION 10.22, SUBDIVISION 2 FILE NO. 2008 WHEREAS, Tessa Marchessault and Greg Becker (hereinafter "the applicants") are the owners of the property located at 3133 Casco Circle within the City of Orono and legally described as follows: refer to Exhibit A attached (hereinafter "the property"); and WHEREAS, the applicants have applied to the City for a variance to Municipal Zoning Code Section 10.22, Subdivision 2 to permit construction of 11' x 18' and 14' x 14' additions to the residence requiring approval of a hardcover variance of 370 s.f. or 2.1 % . The hardcover is proposed at 4,745 s.f. or 27.1 % where 29.5% exists. NOW, THEREFORE, BE IT RESOLVED by the City Council of Orono, Minnesota: FINDINGS 1. This application was reviewed as Zoning File #2008. 2. The property is located in the LR-lC Lakeshore Residential Zoning District requiring 21,780 s.f. or one-half acre in area. The property consists of 33,000 s.f. 3. The Orono Planning Commission reviewed this application on April 17, 1995 and recommended approval of the variance application as amended based upon the following unique findings and hardships: A. The existing dwelling was built in the early 1920's prior to standards for lakeshore development. Page 1 of 5 B. The house was originally installed on property where a street was located between the cottage and the lake. The proposed improvements are designed to reverse interior home to take advantage of lake views. C. Hardcover is reduced in both the 75-250' and 250-500' setback zones. D. There will be no impact on the views of the neighbors nor on required setbacks. E. There is approximately 176' x 100' of non-hardcover area within the lakeshore yard. The grassed lawn is gently sloped and receives major portions of drainage that come from the higher elevations to the north. 4. The City Council finds that the conditions existing on this property are peculiar to it and do not apply generally to other property in this zoning district; that granting the variances would not adversely affect traffic conditions, light, air nor pose a fire hazard or other danger to neighboring property; would not merely serve as a convenience to the applicant, but is necessary to alleviate a demonstrable hardship or difficulty; is necessary to preserve a substantial property right of the applicant; and would be in keeping with the spirit and intent of the Zoning Code and Comprehensive Plan of the City. 5. The City Council has considered this application including the findings and recommendations of the Planning Commission, reports by City staff, comments by the applicant and the effect of the proposed variance on the health, safety and welfare of the community. CONCLUSIONS, ORDER AND CONDITIONS Based upon one or more of the findings noted above, the Orono City Council hereby grants a variance to Municipal Zoning Code Section 10.22, Subdivision 2 to permit construction of 11' x 18' and 14' x 14' additions to the existing residence, subject to the following conditions: Page 2 of 5 1. Hardcover improvements within the 75-250' setback area shall be maintained at 4,745 s.f. or 27.1 % and in the 250-500' setback area at 5,360 s.f. or 96.4%. All hardcover improvements scheduled for removal as shown on Page 5 of this resolution shall be completed prior to the footing inspection for the new construction. 2. Authorities granted with this variance run with the property not with the applicants, but are permissive only and must be exercised by application for a building permit within one year of the date of Council approval, or this variance will expire on that date (May 22, 1996). 3. Violation of or non-compliance with any of the terms and conditions of this variance shall constitute a violation of the zoning code, shall automatically terminate any authority granted herein, and shall be punishable as a misdemeanor. 4. The undersigned applicants have read, understood and hereby agree to the terms of this resolution and on behalf of themselves, their heirs, successors and assigns, hereby agree to the recording of this resolution in the Chain of Title of the property. Box 66 Crystal Bay, MN 55323-0066 I have once again attached the staff sketch that was attached to the Planning Commission Action Notice. You are asked to use this site plan to determine existing areas of hardcover improvements to be removed. A scale of the drawing is 1" = 16'. Areas 1 and 2 have been designated as they were discussed at the Planning Commission as possible areas for consideration of hardcover removal. I have also enclosed copies of the original hardcover inventory prepared by your building contractor and a hardcover worksheet handout. Note the 5' x 5' area to remain of the concrete block patio was agreed to. It is not clear as to the exact areas of hardcover improvements that are to be removed. The site plan has not been amended to reflect changes. In reconsideration, you may wish to remove other areas rather than the areas designated as 1 and 2. If you have any questions pertaining to the amendment of your hardcover facts, please contact my office and I will arrange to meet with you to discuss the preparation of your amended proposal. The City must be in receipt of this final hardcover inventory before we can schedule your application before the Council. The deadline for the May 22nd meeting once again is May 15th. Mr. Becker was present. Mabusth reported that this property gains access off of Casco Circle. There is an access easement along the northern boundary of the property. The use of the gravel road north of the retaining wall was not obvious. The lower portions of paved drive, and not located in the easement, serves two other properties. The upper level of the property has a pavement area with a drive which extends around to the lower level garage. It was noted that the paved area encroaches on the neighbor's property. 2 ~.:,- MINUTES OF THE ORONO PLANNING COMMISSION MEETING HELD ON APRIL 17, 1995 (#5 -#2008 Tessa Marchessault/Gregory Becker -Continued) The proposal is for a l l 'xl8' single-story addition and a 14'xl4' portico addition to be built over existing non-structural hardcover. All setbacks would be met as well as the average lakeshore setback. The issue is the excess of hardcover in the 75-250' zone. There is currently 29.5%. The proposal would reduce the hardcover to 27.3% with the removal of the concrete patio and rock area underlined with plastic located in front of the residence. Mabusth reviewed the proposed floor plan. Nolan inquired of the applicant if the sidewalk would be affected by the portico addition. Becker reported that the addition would come up to the edge of the sidewalk. Nolan, noting that the applicant needs to be sensitive to the drainage area of the property, asked about hardcover concessions at the blacktop area near the upper level garage. The applicant reported having no plans to remove any of the blacktop areas at the higher elevations because of potential erosion problems. Schroeder asked the applicant if there was any encroachment of driveway areas. The applicant responded that the neighbor's encroachment is noted on the application and there is also an easement on the property. There were no public comments. Rowlette commented on the proposed removal of 574 s.f of patio cement, noting that a partial amount of the cemented area would need to remain for egress from the patio door area. It was found that the applicant did not wish to remove all of this cemented patio area, which would result in the need to recalculate the hardcover percentages. Lindquist remarked that the actual reduction in hardcover in the patio area would be approximately 200 s.f It was suggested to the applicant that the 14'xl4'concrete block patio be made smaller. The applicant agreed to a reduction in the patio area to 5'x5'. When asked by Schroeder if the hardcover in the garage area could be removed to aid in hardcover reductions in the 250'-500' zone, the applicant commented that his only purpose was to acquire approval of the new additions and did not wish to remove any additional hardcover. Becker said he did not see any purpose and perceived negative changes in drainage for the property with the removal of the blacktop by the driveway. Nolan responded that the area in question was not necessary and acts as a means by which runoff travels downhill towards the lake. Nolan noted that if the blacktop was removed and the area properly graded, there should be no problem with water running into the garage. 3 MINUTES OF THE ORONO PLANNING CO!v1MISSION MEETING HELD ON APRIL 17, 1995 (#5 -#2008 Tessa Marchessault/Gregory Becker -Continued) Peterson commented that there is 100% hardcover in the 250'-500' zone, where 30% is allowable. The applicant commented that the areas of hardcover were done prior to his owning the property and must have been obtained through the proper channels. Rowlette responded that permits are not needed for driveways. The applicant was informed that when applications come before the commission, this is the only opportunity for the City to make changes to areas of excess hardcover. It was also noted that the purpose in the limitations of hardcover is to serve the lake. This property is located at the north end of Concordia and was approved for a second story addition above the existing building envelope for an average lakeshore setback variance, lakeshore setback variance within the 0-75' zone, and for hardcover variance. The applicant's builder advised them not to proceed with the remodel but to remove the existing structure and rebuild. The new residence structure would be located 50' from the shoreline and a 10x30' lakeside deck located at 40' from the shoreline. Mabusth noted questions associated with the elevation and floor plan. The cantilevered window would extend 2. 5' into the lakeshore setback. The roofed entry at approximately the same depth also encroaches into the lakeshore setback area. Mabusth said the additions are part of the principal structure and must meet the 50' setback. Improvements will involve two additions. The 11 'x18' addition at the east side and a 14'x14' entrance portico on the west side. CITY of ORONO Municipal Offices Post Office Box 66 Crystal Bay, Minnesota 55323-0066 HARDCOVER ORDINANCE-In 1975, the Orono City Council adopted an ordinance limiting the percentage of lot area that can be covered with impervious surface ("hardcover") such as roofs, driveways, sidewalks, etc. on properties located within 1,000 feet of a lake. Studies have shown that sediments, oils, and debris carried into the lake from highly urbanized areas have a detrimental impact on the quality of water in the lake. The intent of Orono's ordinance is to ensure that rainfall run-off will be cleansed by filtering through grassed or vegetated yard areas before entering the lake. Type of data. The rights of individual on whom the data is stored or to be stored shall be as set forth in this section. Subd. 2. Information required to be given individual. An individual asked to supply private or confidential data concerning himself shall be informed of: (a) the purpose and intended use of the requested data within the collecting state agency, political subdivision, or statewide system; (b) whether he may refuse or is legally required to supply the requested data; (c) any known consequence arising from his supplying or refusing to supply private or confidential data; and ( d) the identity of other persons or entities authorized by state or federal law to receive the data. This requirement shall not apply when an individual is asked to supply investigative data, pursuant to section 13. 82, subdivision 5, to a law enforcement officer. The commissioner of revenue may place the notice required under this subdivision in the individual income tax or property tax refund instructions instead of on those forms. Subd. 3. Access to data by individual. Upon request to a responsible authority, an individual shall be informed whether he is the subject of stored data on individuals, and whether it is classified as public, private or confidential. Upon his further request, an individual who is the subject of stored private or public data on individuals shall be shown the data without any charge to him and, if he desires, shall be informed of the content and meaning of that data. After an individual has been shown the private data and informed of its meaning, the data need not be disclosed to him for six months thereafter unless a dispute or action pursuant to this section is pending or additional data on the individual has been collected or created. The responsible authority shall provide copies of the private or public data upon request by the individual subject of the data. The responsible authority may require the requesting person to pay the actual costs of making, certifying, and compiling the copies. The responsible authority shall comply immediately, if possible, with any request made pursuant to this subdivision, or within five days of the date of the request, excluding Saturdays, Sundays and legal holidays, if immediate compliance is not possible. If he cannot comply with the request within that time, he shall so inform the individual, and may have an additional five days within which to comply with the request, excluding Saturdays, Sundays and legal holidays. Subd. 4. Procedure when data is not accurate or complete. An individual may contest the accuracy or completeness of public or private data concerning himself. To exercise this right, an individual shall notify in writing the responsible authority describing the nature of the disagreement. The responsible authority shall within 30 days either: (a) correct the data found to be inaccurate or incomplete and attempt to notify past recipients of inaccurate or incomplete data, including recipients named by the individual; or (b) notify the individual that he believes the data to be correct. Data in dispute shall be disclosed only if the individual's statement of disagreement is included with the disclosed data. The determination of the responsible authority may be appealed pursuant to the provisions of the administrative procedure act relating to contested cases. 11
