A RESOLUTION AI'PROVING A CLASS II
�UBDIVISION OF PROPERTIFS LEGALLY
COMBINED FOR TAX PURPOSES LOCATED AT
� . 3700 NOItTHERN AVElVUE

. WI�EREAS,Elaine A. Slechta, on March 23, 1995, filed a subdivision�pplicatiou
with the City for approval of a Class II subdivision of parcels legally combined for tax p�Tposes and
legally described as:
Tract "B" and "C" R.L.S.No. 763 and the South 2/3 of the West 3/4 of Lot 9 i�i Block 10,
Townsite of Langdon Park. Containing 2 acres,more or less, Hennepin County;Ivli�iesn,t�
(hereinafter "the property"); and
• WHEREAS, after due puY�lished and mailed notice in accordance with Minnesota
Statutes 462.358 et. seq. and the City of Orono's Zoning and Platting Codes, the Orono Planning
Commission held a public hearing on Marcli 18, 1996, at which time a11 pez5ons desiring to be heard
concerning this application were given tlie oppoi-tunity to speak thereon; and
'WHEREAS,at their re;ular meeting held on Apri18, 1996;the Orono City Ceunci:
considered this subdivision application of Flaine A. Slechta, noting the.follo�ving findin�s of fac�:
1. The property is located within the LR-1C Single Family Lakeshore Residential
Zoning District requiring a minimum of 21,780 s.f. or 1/2 acre of dry land witnin
each lot.
. 2. The property contains a total of approximately 4+ acres. 1/3 �cre of which is
designated wetland.
3. Each of the three parcels exceeds the minimum lot area and lot width requiren�ent.
" 4. The properties are served by municipal water and sewer.
5. All three parcels have been assessed for a water unit.

6. Two of the three parcels have been assessed for sewer.
7. The homestead or developed parcel shall continue to achieve access via the existing
driveway at Northern Avenue. Tracts B and C shall be allowed access via single
curb cuts to each property.
. NOW,THEREFORE,BE IT RESOLVED,that based upon either one or more of
the findings noted above,the City Council of the City of Orono hereby approves the preliminary plat
for Elaine A. Slechta for the property owned by Leo J. Slechta located at 3700 Northern Avenue per
the survey dated 2/13/96 by Frank R. Cardarelle, a licensed land surveyor, subject to the following
conditions:
1. The proposed division has been classified as a Class II division and shall be
completed as a simple plat. �
• � 2. The City conceptually approves the revacation of Northern Avenue subject to
applicant rededicating road right-of-way as required by City.
3. Designated wetland located within the three properties shall be defined by a wetland
delineator. App:icant to provide copies of report and findings to the City staff for
their review.
4. Basement elevations for new construction shall not be below 951 elevation in order
to allow for adequate clearance below footing and grade of the sewer service pipe.
5. Erosion control shall be maintained during construction in order to protect the
designated wetland. A 26' setback must be maintained for all construction activities
involving filling and grading. All structures must also meef the 26' setback.
6. The future developer of Tract B or C shall submit an additional sewer payment of
$350.
The following list of final submittals must be submitted to the Zoning Admitustrator two
weeks prior to the regulazly scheduled Council meeting on the second and fourth Mondays of the
month:

l. Record plat drawings in the form of two (2)mylar copies and one (1) copy reduced
to 1" =200'. Drawing to include:
A. Lot lines platted per preliminary survey by Franl: R. Cardarelle dated
February 27, 1996.
� B. Dedication and designation of designated wetland as drainage easements over
the wetland within the homestead parcel and Tracts B and C.
C. Dedication of clrainage and utility easements 10' along all perimeter property
lines and 5' each side of internal property lines to be omitted adjacent to
designated wetland.
D. Dedication of 25' of right-of-way to be shown as Northern Avenue.
• 2. Legal documents required:
A. Title opinion addressed to the City. All owners, mortgage holders or others
with property interest indicated therein shall sign the plat and all other
dncuments affected by such interest.
B. The applicant must provide certified copies of all recorded easements
currentiy affecting the property.
C. Signed and executed Flowage and Conservation Easement over the
design�ted wetland within the plat. (Applicant to obtain copy of easement
from City.)
