A RESOLUTION VACATING .
AN U1v1IMPROVED ALLEY WITHIN THE PLAT OF
HILLSIDE PARK
IN THE �ITY OF ORONO,
HENNEPIN COUNTY, MINNESOTA
FILE NO. 2120
WHEREAS, the City of Orono is a municipal corporation organized and existing
under the laws of the State of Minnesota; and
WHEREAS, on February 23, 1996, Loren Brueggemann (hereinafter the
"applicant") filed a petition with the City of Orono requesting the vacation of an unimproved
public right-of-way adjacent to his property and originally dedicated in the plat of Hillside Park,
I�ennepin County, Minnesota in 1912 and legally described as follows:
• that part of the east-west alley as platted in "Hillside Park", according to
the recorded plat thereof, Hennepin County, Minnesota, which lies
southerly and adjacent to Lot 12, Block 1, said "Hillside 1'ark", Hennepin
County, Minnesota; and
WHEREAS, after due published and posted notice, a public hearing was held
by the City's Planning Commission on March 18, 1996, regarding said vacation and all
interested persons were given an opportunity to be heard; and
WHEREAS, after due standing and consideration, the Planning Commission
recommended unanimous approval of the proposed vacation; and
WHEREAS, the City Council of the City of Orono finds that said vacation as
proposed is in keeping with the public interest and in consideration of the following findings:
1. The majority of the 10' alley is located within the lake bed of Lake Minnetonka
below the Ordinary High Vdater Level of 929.4. The entire western purtion of
the alley is located within the lake bed restricting land access to the limited
eastem portion of the alley from Westlake Street.

2. There is an existing, accessible lake access on Stubbs Bay that is maintained by
the City.
;. The condition of the alley would restrict all reasonable public use.
4. The unimproved right-of-way contains no municipal sewer nor other utilities.
NOW, THEREFORE, BE IT RESOLVED, that the petition of Loren
Brueggemann is hereby granted by tlie Council of the City of Orono and that the unimproved
alley legally described above is hereby vacated. The granting of the petition is subject to
applicant applying for the legal combination of the vacated alley with Lots 10, 11 and 12,
Block 1, "Hillside Park", according to the recorded plat thereof, Hennepin County, Minnesota.
� Adopted by the CiTy Council of the City of Orono, Minnesota at a regular
meeting held on April 8, 1996.
