b. The purpose of the original application was to create open water areas in
an attempt to rem�ve algae from the pond and reduce the odors that
irripacted the surrounding neighborhood.

dred�ing in.iprovement b��cause of original cor►structi�n problems resulting
from the attempt to create a 12' deep open water area in tl:e middle of tr,�
pond and with the installation of lawn area surrounding pond along the
south side on pro�zrty located at 1625 Bohns Point Road.
e. The praposed improveznznt will have no impact on the rvad improvements
completed by City in 1987 nor will it have an impact on the intent and
purpas� uf the original plan of impravement for the pond.
4. T�e (:ouncil finds that tt-ie conlitions existing c�n this property are pecu.iar to it and
do not apply generally �o other property in �his zoiung district; that granting the
variance would not adversely affect traff'ic conditians, light, air nor pose a fire
ha,ard or atlier danger to neiglZt�o.:ng ��operties, would not merely serve a� a
convenience to the apglicant, but is iiecessary to al�eviate a demonstra�le hardship
or difficulty; is necessary to preserve a substantial property right of the applicant;

5. The City Council finds that granti3ig a conditional use permit to allow= the
maintenance dredging of approximately 80 cubic ;�ards of spoils from the existinU
open water pond will not be detrimental tn the health, safety or general welfare of
the public, would not adversely affect light, air �or pase a fire hazard or other
danger to neighboring property, nor will its use depreciate sunoui;ding propem�
values and thax the propos�d level ;�f use of the property will be in keeping with
the intent and objectives of ttie Zoning Code and Cornprehensive Plan of the City.

CONC'LUSIONS, ORDER AND CONDITIONS
Based upon one ar more of the above findings, the Orono City Council hereby
grants a variance to Municipal Zoni�g Code Section 10.55, Subdivision 8 and grants a condition�.l
use p�rmit per Section 10.03, Subdi�ision 19 to peimit the dred�ing of approximately 80 cubic
yarc�s of spo.ls ana �ehri, frorr� the oper� wa►er ��n1, ;;�a�sii�u a.s N T;,�re `>' .;��+?�,::� 4'�at i�
grotected by the C►ty of Orono. Apnroval is subject to the following conditions:
1. Barilcs of' the pond where dredging shall �ake place shail he restore�� to au 8:1
slope. Appropriate aquatic and wetland vegetation sha11 be restored tivitliin the
disturbed area.
2. The spoils shall be removed from the site.
3. The �pproved or average water level of the pond shall be at 929.4.
4. Authorities granted by this resolution run with the pr�perty not with the awner, but
are permissive only and must r�e exercised by application for a land alteration
perrnit within one year of the date of Coun�il's approval, or the special conditions
of this resolution will expire �n that date (April 8, 1997).
5. Violation of or non-compliance with any of the terms and conditions of this
resolution shall constitute a violation of the Zoni:�g Code, shall automatically
terminate any autl�ority granted herein, and shall be punishable as a misdemeanor.
6. The undersignecl al�p:icant has rea�i. understood and hereby agrees to the terms �i
this resolution and on behalf of himself, his heirs, successors and assigns, hereby
agrees to the recording of this resolution in the chain ef title af the property.
