513.04 RIGHTS OF SUBJECTS OF DATA
Subdivision L Type of data. The rights of individuals on whom the data is
stored or to be stored shall be as set forth in this section.
Subd. 2. Information required to be given individuaL An . individual asked to
supply private or confidential data concerning himself shall be informed of: (a) the
purpose and intended use of the requested data within the collecting state agency,
political subdivision, or statewide system; (b) whether he may refuse or is legally
required to supply the requested data; (c) any known consequence arising from his
supplying or refusing to supply private or confidential data; and (d) the identity of
other persons or entities authorized by state or federal law to receive the data. This.
requirement shall not apply when an individual is asked to supply investigative data,
pursuan' to section 13.82, subdivision S, to a law enforcement officer.
The commissioner of revenue may place the notice required under this
subdivsion in the individual income tax or orooerty tax refund instructions instead o
on those forms.
Subd. 3. Age= to dot . oy individuaL Upon request to a responsible
authority, an individual shall be u:formed whether he is the subject of stored data on
individuals, and whether it is classified as public, private or confidential. Upon his
further request, an individual who is the subject of stored private or public data on
individuals shall be shown the data without any charge to him and, if he desires, shall
6e informed of the content and meaning of that data. After an individual has been
shown the private data and informed of its meaning, the data need not be disclosed to
him for six months thereafter unless a dispute or action pursuant to this section is
pending or additional data on the individual has been collected or created. The
responsible authority shall provide copies of the private or public data upon request by
the individual subject of the data. The responsible authority may require the
requesting person to pay the actual costs of making, certifying, and compiling the
copies.
The responsible authority shall comply immediately, if possible, with any request
made pursuant to this subdivision, or within five days of the :ate of the request,
excluding Saturdays, Sundays and legal holidays, if immediate compliance is not
possible. If he cannot comply witt• the request within that time, he shall so inform the
individual, and may have an additional five days within which to comply with the
request, excluding Saturdays, Sundays and legal holidays.
Subd. 4. Procedure when data is not accurate or complete. An individuial may
contest the accuracy or completeness of public or private data concerning himself. : o
exercise this right, an individual shall notify in writing the responsible authority
describing the nature of the disagreement. The responsible authority shall within 30
days either: (a) correct the data fcand to be inaccurate or incomplete and attempt to
notify past recipients of inaccurate or incomplete data, including recipients named by
the individual; or (b) notify the individ.al :.sat he believes the data to be Correct.
Data in dispute shall be disclosed only if the inciividual's statement of disagreement is
included with the d sclosed data.

The Planning Commission will hold Public Hearings in the Council
Chambers at 1275 South Brown Road on Tuesday, February 20, 1990,
on the matter of reviewing the following land use applications:
1. 01488 John E. Rogers, of 755 Tonkawa Road, seeks a
conditional use permit for the conversion of a detached garage
into a guesthouse.
2. f1489 F. John Hardin, of lk96 Park Drive, seeks an area
variance for an addition to an accessory structure, that would be
greater than the allowed 1,000 s.f. in area.
3. #1491 Jack Rhode, of 1690 Shadywood Road, has applied for
renewal variances to construct a new residential structure
requiring approval of lakeshore and hardcover variances within
the 0-75' setback area.
4. #1492 Mark Gruss, of 3285 Carman Road, seeks a hardcover
variance within the 75' to 250' setback area for an 8' addition
to the existing residence structure.
S. 01493 Chuck Downey, of 2665 Casco Point Road, seeks a
hardcover variance for an entry porch addition to the existing
residence.
6. 91494 Francis Lightly, of 3585 Fredrick Street, seeks
hardcover and an average lakeshore setback variances for a
proposed lakeside addition to the existing residence.

Review of Application -
The applicant seeks both hardcover and average lakeshore
setback line variances for the proposed 8x29' addition to the
existing residence along the east side of the principal
structure. There is no impact on the adjacent neighbor to the
west as the addition does not encroach any closer to the Lake-
shore than the existing residence.

The impact on the view windows of the residence to the east is
negligible based on the curvature of the shoreline location of
house in relation to shoreline, and the angle of the view windows
on the lakeshore side. Please review the floor plan submitted
with the application (Exhibit H). Applicant claims the need for
additional bedroom space for growing family. The floor plans
show only an expansion of that bedroom areas. The applicant at
this time does not have an elevation to show but confirms that it
will be a single story of 8'x20'. As of this writing, staff has
heard nothing from the adjacent neighbors, review Exhibit E, the
most effected neighbor has reviewed the proposed improvement.
in applicant's addendum, he notes the need for additional
space because of an increase of family. The applicant has not
cited hardships as City recognizes needs. Planning Commission
members may ask has the applicant explored all options for
expansion. is an upward expansion more feasible for a property
less than 1/2 acre in area. Applicant should be asked to
respond.
Confirmation of hardcover has been difficult as staff is
working with an old survey with discrepancies in measurements
based on a 30' scale. The shoreline elevation has not been
designated and, as a result, staff cannot confirm measurement
from a 929.4 elevation. The house at the east end does not
measure 29.3' but instead measures 341. The roof design shown on
Exhibit J, site plan by Walsh Bishop and Assoc. suggests even a
larger structure but this specific plan designates the overhang
and roof design of the existing structure. Staff has attempted
to make the necessary corrections. Hardcover is now shown within
the 0-75' setback area (Exhibit I) and adjustments have been made
in the 75-250' setback area hardcover calculations. if the
Planning Commission feels comfortable in acting on the
information submitted for the review, the following options of
action are available.
Denial. If denied, please refer to the necessary findings
within the variance sections of your code (Section 10.08);
or
Approval. To approve the average lakeshore setback
encroachment of 8' and addition of 232 s.f. or 2.7• within
the 75-250' setback area; or
Table. To provide additional time for applicant to explore
all options in the improvement of this structure and if
Plannirg Commission feels it necessary, to ask for an
updated survey.

I an respectfully requestinq a variance to the hardcover rule
regardinq my residence at 3285 Carman Wed. The home presently
has two bedrooms upstairs. This was more than adequate when my
wife and T were childless. Now that we have a four year old son
and a 12 month old daughter, the four of us simply don't fit in
two bedrooms. This proposed eight foot addition would give us
three bedrooms on the main floor.
The home was built in 1962 and presently is at 40% of hardcover.
This addition would raise that to 42.8%. The adjoininq property
owners are aware of thin and have no objections.

Zoning Administrator Mabusth provided a brief review of this
renewal application.
There were no comments from the public regarding this matter

It was moved by Planning Commissioner Cohen, seconded by
Planning Commissioner Hanson, to recommend approval of the
renewal variances for Jack Rhode, 1690 Shadywood Road, due to the
reduction in hardcover within the 0-75' setback zone. Motion,
Ayes-5, Nays-0, Motion passed.

The Affidavit of Publication and Certificate of Mailing were
duly noted.
Mr. Gruss was present for this matter.
Mabusth explained that Mr. Gruss is seeking approval of an
average lakeshore setback and hardcover variance in order to
construct an addition.
Planning Coma+issioner Bellows suggested that the applicant
add another level rather than what is proposed.
Mr. Gruss said that he has spent approximately $6,000 to
have an architect review that possibility. He said that a second
level would add more square footage than he needs and would not
conform to the characteristic of the neighborhood.
Kelley asked whether 232 s.f. of hardcover could be removed
elsewhere?
Mabusth suggested that it may benefit Mr. Gruss to provide a
new survey. She said that the survey used for this application
does not show the 929.4 elevation as well as some other
discrepancies.
Bellows questioned whether the City would issue a building
permit based on the existing survey?
Mabusth repiied that she would not feel comfortable issuing
a building permit based on that information.

Bellows suggested that as long as an updated survey is
needed for the building permit, this item be tabled to allow for
Planning Commission review. Bellows also indicated that she had
difficulty accepting the hardship.

PUBLIC HEARING 8:07 P.M. TO 8:15 P.M.
The Affidavit of Publication and Certificate of Mailing were
duly noted.
Mr. Downey was present for this public hearing.
Mabusth explained that Mr. Downey is seeking approval of a
hardcover variance within the 75-250' setback area for the
addition of a 19' x 6' entryway. Mabusth noted that hardcover
has increased since variance approval was given in 1982. Mabusth
said that staff observed a second story deck which was not shown
on the 1982 survey and no record of a permit for that structure
exists.
Mr. Downey Said that the deck was added at the same time the
garage was constructed. It was his understanding that the deck
was covered under the permit for the garage.
Mabusth said that the 1982 resolution approved 45% hardcover
for the garage addition.
Kelley said that Mr. Downey is in violation of that
resolution.
Mr. Downey said that he did not understand staff's hardcover
calculations of the home.
Kelley said that a review of the existing hardcover should
be done before this proceeds any further.
Mabusth asked *_he Planning Commission to provide direction
for Mr. Downey.

The Planning Commission has advised that they are unable to continue
the review of your variance application until a revised updated survey is
submitted confirming all existing improvements on the property since the
original survey of January 27, 1975. You may also wish to have your
surveyor provide updated hardcover facts for comparison with staff's
approximate calculations, absent a complete survey of all improvements.
It would appear that the Planning Commission had no major concern with
the average lakeshore setback -ariance requested, as it appeared to have
little impact on your neighbor to the south. Applicant may wish to provide
more information as to why a plan for an upward expansion was not as
feasible as the ground level expansion. This issue was raised by a member
of the Planning Commission.
