Meinhardt (hereinafter "the applicant") is the owner •of the property located at 3585 Sixth Avenue North within t11e City cf Orono (hereinafter "the City") and legally described as follows: That part of the west 208 feet of the southeast quarter of Section 29, To��wnship 118 North, Range 23 West of the fifth principal meridian lying southerly of the centerline of County Road No. 6 as per Dacurnent No. 4190220; Hennepin County, Minnesota (hereinafter "the property"); and • WHEREAS, the applicant has applied to the City for a variance to Ordinance No. 144, Second Series, Section 5 that would allow the City to issue a building permit for the construction of a 26' x 26' addition to the rear'of his residence on a property located u�itl�in Area 4 of a study area of the Highway 12 corridor. The ordinance would �rohibit the City from issuing a building permit until the ordinance expires on July 22, 1996 or the ordinance is repealed earlier if the Council det�rmines that the study has been completed. NOW, THEREFORE, BE IT RESOLVED by the City Cc�uncil of Orono, Minnesota: FINDINGS 1. This application was reviewed as Zoning File #2123. 2. The property is located in the RR-1B Single Family Rural Residenr_ial Zonin� District requiring two acres in area. The property consists of three-pltis acres. ;. The proposed 26' x 26' addition to be constructed at the rear of the residence will require no setback variances or any other variances to the Zoning Code. � Page 1 of 2 � °� � � o 0 b. - . The proposed i.mprovement has been found to be compatible with zoning and official control amendments being considered by the City. , 6. The proposed improvement does not adversely impact the health, safety or welfare of the citizens. 7. The proposed improvement meets the requirements of the Orono City Code and State Law. CONCLUSIONS, ORDER AND CONDITIONS • Based upon one ar more of the above findings, the Orono City Council hereby grants a variance to Ordinance No. 144, Second Series, Section 5 to perniit the construction of a 26' a 26' addition to the rear of the residence located at 3585 Sixth Avenue North.
