WH�REAS, the Orono Planning Commission reviewed i.his comprehensive
application at their February 20, 1996 and March 18, 1996 meetings and recommended
unanimous approval of the development plans per the commercial site plan prepared by CI
Construction, Inc. dated 3/6/96, most revised date 3/12/96, for O'Sullivans Development
Convenience Store/Restaurant Facility, based on the following unique findings and hardships: �

servicing cars within 1'/z minute and there will be a full-time attendant on duty.
5. Per Section 10.61, SuUd. 10, required off-street parking is approved as follows:
A. Restaurant = 1 stall per each 80 s.f. of public floor area.
2,160 s.f. of public floor area = 80 = 27 spaces.

6. Dester Kile, agent of the Baptist Churcli located to the northwest of the subject
property, submitted a letter dated Pebruary 13, 1996 agreeing to grant the
applicants an easement for stormwater retention purposes on the church property

10. Applicants' develooment of the proposed site plan is dependent upon the final
' vacation of Navarre Lane. Applicants originally asked for the partial vacation
of 33' adjacent ±o the northwest side lot line. The City has agreed to vacate a
more expanded portion of the right-of-way and a"s' a condition of approving the
vacation, the City shall be provided with additional starmwater retention within
the stormwater pond to be located on the churcl� property and vacated portions
of the right-of-way.
11. The green areas as shown on the above referenced site plan snall consist of
grass wherever feasible and adjacent to roadways, a bark i�ulch shall be placed
on existing ground defined by landscape timber. Plantings shall consist of
junipers and potentilla, low-growing sl�rubs so as not to hinder sighting at
intersection

� 17. 1he structural excess of 5.2% is consistent with the type of structural coverage �
on all of the developed properties v��ithin the Navarre area.
18. As already noted above, only a small portion of this 1%z acre parcel is located
within the shoreland area of the City. The property is not subject to hardco��er
controls.
19. All surface iunoff will be directed to a retention pond for treatment before
entering the wetlands and eventually the lake.
. 20. Few prbperties within the Navarre commercial area can provide water retention
and treatment of runoff for the total area of property.

24. The Council finds that the conditions existing on this property are peculiar to
it and do not apply generally to other property in this zoning district; that
� granting tlie variance would not adversely affect traffic conditions, light, air nor
pose a fire hazard or other danger to neighboring properties, would not merely
serve as a convenience to the' applicant, but is necessary to alleviate a
demonstrable hardship or difficulty; is necessary to preserve a sut�stantial
property right of the applicant; and would be in keeping with the spirit and
intent of the Zoning Code and Comprehensive Plan of the City.
25. The City Council finds that granting conditional use perniits to allow the motor
fuel station and Class I restaurant will not Ue detrimental to the health, safety
or general welfare of the public, would n�t adversely affect light, air nor pose
a fire hazard or other danger to neighboring property, nor will its use depreciate
surrounding property values and that the proposed level of use of the property
will be in keeping with `the intent and objectives of the Zoning Code and
Comprehensive Plan of the City.

3. A 7' easement for trail purposes shall be granted by applicant over south lot line
that runs along Shoreline Drive.
4. The parkin� lot shall be paved with concrete curb and gutter, driving lanes with
parking lot shall have a 9-ton pavement section for trucks. A geotechnical
• evaivation of the so�l shall be done in conjunction with the pavement design.

may relate to potential traftic problems or safety concerns for the public who
travel the County road.
9. Authorities granted by this resolution run with the property not with the owners,
but are permissive only and must be exercised by application for a building
permit within one year of the date of Council's approval, or the special
conditions of this resolution will expire on that date (March 25, 1997).
10. Violatiori of or non-compliance with any of the terms and conditions of this
resolution shall constitute a violation of the Zoning Code, shall automatically
terminate any authority granted herein, ancl shall be punishable as a
misdemeanor.
11. The undersigned applicants have read, understood and hereby agree to the terms
