existing under the laws of the State of Minnesota; and
WHEiRE.AS, the City Council of the City of Orono has adopted subdivision
regulations for the orderly, economic and safe development of land within the
City; and
hGIrRF.AS, the City Council has considered the application for a sub-
division plat for R. Bruce Kobs;
NOW, lliEREFORE, BE IT RESOLVED, that the City Coim cil of the City of
Orono hereby approves the plat for R. Bruce Kobs, Hennepin County, Minnesota,
subject to the following:
1. Receipt of Park Dedication Fee in the amotint of
$20000.00.
2. larger parcel to remain as one Parcel.
3. Off -shore lot will not have access to lake.
4. Title opinion addressed to the City.
This resolution will expire on liecember 1, 1977, if the aforesaid subdivision
plat has not been filed with the Hennepin County Register of Deeds. In that event, it

Subdivision (Lot Rearrangement) - Preliminary
Mr. kobs is the owner of Lots 2 and 3 of Carman's Bay Addition. Each lot now
exceeds the minimum lot area and width requirements.
Ile is now requesting approval for a lot rearrangement. The new proposal does
not increase the number of lots. It only reduces the size of one lot and
increases the other. The smaller lot would still meet the required 1/2 acre
area and 100' lot width requirements. The larger parcel is about 57,000 sq.
ft. in area and exceeds the 100' lot width. This second parcel is actually
large enough to split again at some future date. however, if this were to
occur, additional utility assessments and part fees would ha— to be collected.
The lot rearrangement projj��sed would he subject to a park dedication fee of
52,n0�1 for the two lots, 000 for Tract A and S1,000 for Tract B. Tlie current
raw land value of the two lots is $48,400.
A public hearing will have to be held for this proposal.

Work Session item only. .After reviewing this application,
the Commission felt that the conditions of this application
were similar to those at 1865 Shadywood (#238) - 2 adjacent,
substandard parcels under one oi•nership.
Work Session only. Paiil Kempf was present. after reviewing
his proposal, the Planning Cornnission requested that the
applicant submit a report from the Nlinnehaha Creek Watershed
District concerning the extent of buildup of the eraled
material. The applicant was forewarned that the only dredg-
ing that would be permitted was that portion that has eroded
through the years. The Cormission also requested that the
applicant submit a copy of the action tal.en by the U}rD at
their meeting this week regarding dock lengths. The
Commission recommended that the City Engineer supervise this
dredging.
Lou Oberhauser uid Norman Nelsen were present and requested
the Planning, Commission's view of this concept. The proposal
consists of 12 units (6 duplexes) to be constricted on
approximately 6' acres, 6 of which are in Orono and ' acre
in Wayzata. Some wetlands are involved. The proposed
location of this complex is just east of the golf course.
The Commission expressed their concern over the (tensity,
sewer availability and marsh conditions. The location of
the proposed access road and one duplex are in conflict with
our Wetlands Ordinance #12S.
The Planning Commission advised Mr. Oberhauser and NIT. Nielsen
that they would discuss this concept with the Co ncil and
report their findings at some future date.
Dunlap moved, Guthrie seconded, that the meeting be adjourned
at 10:15 p.m.

The Orono Planning Commission met on the above 13te with the
following members present: Acting Chairwoman Gloria McDonald,
Members Dick Hassel, Paul Pesek, Diane Dunlap and George
Hosfield. Also present has Zoning Administrator Hank Muhich.
Mayor Van Nest and City Administrator Dick Benson arrived
later in the meeting.
Hassel moved, Pesek seconded, that the minutes of the Planning
Commission meeting of April 4, 1977, be approved as corrected:
"Page 3 - North Star Marina (0242) - that the last sentence
in the second paragraph reads as follows: A considerable
amount of silt has washed in over the years according to
Mr. Kempf."
Motion - Ayes (5), Nays (0).
Chairwoman McDonald announced that '.his was the time and
place for a Public Hearing on the petition of R. Bruce )yobs
for a subdivision of property located at 2732 Caroline
Avenue. The Zoning Administrator presented the Notice of
Public Hearing and the Affidavit of Publication.
The applicant is requesting approval for a lot rearrange-
ment; one lot to consist of 1/2 acre and the other to
consist of 1 acre. Both lots would meet the minimum lot
size requirements.
Mr. & Mrs. Kobs were present. %hen asked what was the
reason for this rearrangement, their response was that
they felt more people would be interested in purchasing
1/2 half acre rather than 3/4 acre.
The Zoning A(!-ninistrator stated that he had informed
Mr. Kobs that if the larger lot were to be divided again,
only the lakeshore lot would have access to the lake.
Mr. Rydell, adjoining property owner, was present. lie
stated that he is aware of the proposed change and asked
what the chances v_ie for a subdivision in the future of
the larger lot. The Commission informed him that a
subdivision meeting all the requirements would be legal.
After all the public were heard, the Public Hearing has
closed at 7:S0 p.m.
Hassel moved, Pesek seconded, to reco-xcnd appmval of
the preliminary plat on the basis that the subdivision
meets all the necessary requirements and with the
understanding that if the bigger lot is divided again
only the lakeshore lot would have access. Subject to
a Park Dedication Fee. Motion - Ayes (S), Nays (0).

we are not going to remove 100' of dock.
Mayor Van Nest moved, Welsh seconded, to table
the request for North Star Marina until the
regular meeting of May 9, 1977 to allow time
for staff to contact Mr. Herb Senft, PhD
candidate, Aquatic Echology, preparing his thesis
on Phytoplankton; Dr. Herbert Wright, Environmental-
ist and Limnologist, University of Minnesota;
Dr. Joseph Shapiro, Limnological Geology, U of M;
Dr. Olaf Pfannkuch, Hydro Geology (Ground Water),
U of M for their comments on this particular
matter and also to review dredging requirements
and to determine if the existing water level is
adequate for riparian land owners, and, what would
be the detrimental effects of dredging on Lake
Minnetonka. This review will also address itself
to riprapping, grading, and dredging requirements

Mr. Bruce Kobs, 2732 Caroline Avenue, is the Bruce Kobs
owner of Lots 2 i 3 of Carman's Bay Addition.
Each lot now exceeds the minimum lot area and
width requirements.
He is now requesting approval for a lot rearrange-
ment. The new proposal does not increase the
number of lots. It only reduces the size of
one lot and increases the other. The smaller
lot would still meet the required 1/2 acre area
and 100' lot width requirements. The larger
parcel is about 57,000 sq. ft. in area and exceeds
the 100' lot width. This second parcel is
actually large enough to split again at some
future date. However, if this were to occur,
additional utility assessments and park fees would
have to be collected.
The lot rearrangement proposed would be subject
to a park dedication fee of $2,000 for the two
lots, $1,000 for Tract A and $1,000 for Tract B.
The current raw land value of the two lots is
$48,000.
A public hearing will have to be held for this

mylar and hardshell. Final plat meets all the require-
ments. Commission again reminded Mr. Kobs that any
future division of the larger lot would result in only
one lakeshore lot.

The Planning Commission took action on the following
work session item:
Randy Fredrickson was present. lie is requesting approval
for an addition to his existing home. Al Olson stated
that work had been started on this project and that a
stop work order had been placed. Mr. Fredrickson submitted
a letter of approval from neighbors (4stafson and Terp.
When asked about the statu, of his septic system, Mr.
Fredrickson responded that it .as functioning properly,
but he had no idea what kind of system it was.
Guthrie moved, Hosfield seconded, to recommend approval
on the basis that no other land is available, written
letter of approval from neighbors which was presented
by the applicant, addition would not require any setback
variances. Motion - Ayes (S), Nays (0).
Because this was approved as a work session item, surround-
ing property owners will be notified of the Council meeting.
Sandy Ritter, owner's architect, was present to discuss
proposal with the Planning Commission. lie was advised of
materials and information required for proper analysis of
the proposal, and he indicated that it would be impossible
to have this to the City in time to hold tl-- June 6, 1977,
public hearing which has therefore been postponed. lie did
indicate that the lots would be scld as building sites only;
that they would be sold `ee simple with common association
ownership of open space; roads are to be private; wetlands
and open space are to have corise nation easements deeded to
the City. Separate plats will he filed for each city.

Association, Walter's Port Lagoon, dated May 9,

Council Meeting - May 9, 1977
Approved dredging of lagoon and channel with
instructions to provide protection against
spoils seeping into lake proper through the
mouth of channel. Also approved metal seawall
for east shoreline of channel and lagoon and riprap
of north shoreline of lagoon. Deferred action on
shoreline protection as proposed for west wall
because several members of association did not
agree with proposal as submitted. Council also
concerned with proposed west wall protection
because of necessity for use of City right of
ways for anchoring seawall. Conflicts with
City regulations for use of public lands for
private improvements and benefit.
The City Council directed the City Engineer
continue reviewing proposal and report back with
most logical solution.

On April 12, 1977, I met with Mr. & Mrs. Arthur
S. Ellis, Mr. Dick DeIregery, and Mr. H.R. Hartman
to discuss the subject dredging and riprap/seawall
application for the west side of the lagoon.
During the discussion, thLte basic proposals were
offered for the improvement and maintenance of

1977, we discussed our concerns relative t�
this proposal. Mr. Hartman haG -ince had ph
