'.jf��... � . � . � O� ;• O O b� - C ITY of ORONO � � ���_ �G'�' RESOLUTION OF THE CITY COUNCIL . �kESH�4 NO. � � o �D -•; A RESOLUTION APPROVING TFI� PLAT OF BENNETT HILL FILE NO. 2078 WHEREAS, the City of Orono is a muiuc��al corporation organized and existing ' under the laws of the State of Mir.nesota; and ' WHEREAS, the City Council of the City of Orono has adopted subdiv?sion regulations for the orderly, economic and safe development of land within the City; an� WHEREAS,the City Council has considered the application for a subdivision of a two lot plat by Frank B. Bennett and Martha M. Bennett, husband and wife, (hereinafter "the subdi�iders"); and • WHEREAS, the subdivision has been found to meet al.l staudards of the LR-1B Lakeshore Residential and LR-lA Lakeshore Residential Zoning Districts fmc?ing that each lct•is of a size and configuration that would allow its use as a single family residence to t�e fully developed without the need of any variances; and N WHEREAS, the subdividers have completed all requirements of the platting regulations of the City, including: 1. Completion of all the requirements of Resolution No. 3661. 2. Dedication on the plat of drainage and utility easements. 3. Dedication to flie City of a drainage easement providing fcr limitations on the use of retention a�ea and drainageway described therein and as shown on the plat as "Draina;e easement". 4. Payment to the City of a park dedication fee in the ainount of$12,$U0. 5. Payment to the City for the legal review and filing of the plat, easements and covenants in the amount of$200.00. • '>. Page 1 of 3 . � °� - - � o 0 b. - CITY of ORONO � � �� : G'�' RESOLUTION OF THE CITY COUNCII - ��kESHOg'� NO. e`� � O � � NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of Orono hereby approves the plat of Bennett Hill, Hennepin County, Minnesota, subject to the follo��ing conditions: 1. Access to Lot 1 shall be via an existing curb cut at County Road 135. Access to Lot 2 shall be via an existing private driveway at the southeast corner of Lot 2. • The subdivision regulations of the Municipal Code limits the use of the driveway in Lot 2 to two residential units. 2. Septic sites must be staked and protected prior to any new residential construction 'Y"' on either Lots 1 or 2. 3. All building envelopes shall be defined by the required setbacks defined within the LR-1B or LR-lA zoning districts. • 4. The aforesaid plat shall be filed by the City of Orono with either the Hennepin County Recorder's Office or Registrar of Titles Office on or before September 25, 1996 together with a certified original copy of this resolution and executed copies of the easement noted above. The approval granted by this resolution shall expire if the plat has not been filed by the date specified above.
