WHEREAS, Gerald R. and Candace E. Rowlette, husband and wife, (hereinafter
"the. applicants") are owners of trie property Iocated at 3775 nayside Road within the City of
Urono (hcreinafter "City") and legaliy described as follo�vs:

WH�REAS, the applicau�ts have applied to the City for variances to Nlu�:icipal
7c�ri;r..g Code Section 10.22, Subdivisions 1 (B) and 2; Section IG.55, Subdiv:sion $; and
Section 10.56, Subdivision 16 (C & L) to perniit the r�construction of a deck ta the lake side
af the existing residence to be installed within the exact footprint of the existing deck located
58' f:om tl�e shoreline where a 75' setback is required resulting iii 423 s.f. of new hardcover
improvement where nu hardcover is allowed.

FINDINGS
1. This application was revie�ued as Zoning File #2063.
2. The prope�•ty ts located in the LR-lA, Single I'amily Lakeshore Residential
7oning D�sirict reqeiring 2 a�res in area. The property consist� of' 38,960
s.f.

3. The Orono Planning Coinmission reviewed this application on March 18, 1996,
and recommended approval of the proposed variances based upon the following
unique findings and hardships:
A. The deck is deteriorating and ca�u�►ot be used by �pplicants in its ��resc►lt
COriuIt101i.
B. The deck will be replaced within the same footprint as the existing deck.
C. In 1976 the applicants received variance approval for the existing deck
that was to be located 2' closer to the lake than the deck that was
constructed.
D. Hardcover within the 0-75' setback area will remain at 4.04%.
E. A landscape azea underlain with plastic located within the County right-
of-way shall be removed. This will result in the removal of
approximately 660 s.f. of hardcover.
F. In a 1988 variance application, applicants removed 146 s.f. of cement
patio within the 0-75' setback zone.
G. During heavy rainfalls the property receives major runoff from the
developed properties to the north.
4. The City Council finds that the conditions existing on this property are peculiar
to it and do not apply generally to other property in this zoning district; that
granting the variance would not adversely affect traffic conditions, light, air nor
pose a fire hazard or other danger to neighboring property; would not merely
serve as a convenience to the applicants, but is necessary to alleviate a
demonstrable hazdship or difficulty; is necessazy to preserve a substantial
property right of the applicants; and would be in keeping with the spirit and
intent of the Zoning Code and Comprehensive Plan of the City.

5, The City Council ha� considered this application including the findings and
recommendations of the Planning Commission, reports by City staff, comments
by the applicants and the effect of the proposed variance on the hcalth, s�fcty
and welfare of the community.
CONCLUSIONS, ORDER AND CONDITIONS
Based upon one or more of the above findings, the Orono City Council hereby
grants variances to Municipal Zoning Code Section 10.22, Subdivisions 1 (B) and 2; Section
10.55, Subdivision 8; and Section 10.56, Subdivision 16 (C & L) to permit the construction
of a deck within the same footprint as the existing deck and grants a 17' or 22.6% lakeshore
setback variance and hardcover variance within the 0-75' setback area of 4.04%, subject to the
following conditions:
1. Applicants shall remove landscape azea underlain with plastic at 660 s.f. in area
located within the County right-of-way as shown on Page 7 of this resolution.
2. Applicants are advised that if they plan to install a 1' high berm within the
County right-of-way that such improvement plans will require approval and a
permit from the Hennepin County Department of Transportation.
3. Authorities granted by this variance �ust be e erci ed by appl�cation forha
applicants, but are permissive only and m
building permit within one ye�r af the dvte of Council approval, or this variance
will expire on that date (March 25, 1997).
4. Violation of or non-compliance with any of the terms and conditions of this
resolution shall constitute a violation of the zoning code, shall automatically
terminate any authority granted herein, and shall be punishable as a
misdemeanor.
