VARIANCES TO
NIUNICIPAL ZONING C�DE �
SECTIONS 10.22, SUBDIVISIONS 1 AND 2;
10.55, SUBDIVIS�ON 8; AND 10.56, SUBllIVISION 16 (C) & (L)

WHEREAS, Douglas J. Olson (?�.ereinafter "the applicant") is owner of the
properly located at 2601 West Lafayette Road within the City of Or�no (hereinafter "City") and
:legally describecl as follows:
Tracts C and F, kegistered Land Survey No. 131, Heruiepin County, IVluuiesota
(hereinafter "the property"); and
• WHEREAS, t1-�e applicant has applied to the City for variances to Municipal
Zoning Code Sections 10.22, Subdivisions 1 and 2; 10.55, Subdivision 8; and 10.56,
Subdivision 16 (C) and (L) to permit the construction of additions to the existing residence and
the revision of the roof of the existing residence, such additions and revisions constituting
hardcover and str-ucture in the 0-75' lakeshore setback zone where no hardcover or structure .is
normally allowed, and constituting additional hardcover in the 75-250' zone in excess of the
25% hardcover normally allowed in that zone, and such additions and revisi�ns encroaching
past the average lakeshore setback where no encroachments are normally allo�ved.
NOW, '�HEREFORE, BE IT RESOLVED by the City Council of Or�no,
Minnesota:
FINDINGS
1. This application was reviewed as Zoning File #2164.
2. 'I'he property is l.ocated in the LR-1B, Single Family Lakeshore Residential
Zoning District. ,

3. The Orono Planning Commission reviewed th� application on August 19, 1996,
and on a vote of 5-1 recommended approval of the proposed vaziances based
upon the following findings:
A. Applicant has removed significant amounts of excessive hardcover in the
0-75' zone in conjunction with previous variance approvals on the
property. There is no remaining hardcover in the 0-75' zone which could
be easily removed.
B. Hardcover in the 0-75' zone will not change as a result of the proposed
roof pitch revisions.
C. Hardcover in 75-250' zone will be reduced from 31.0% to 30.25%, a
reduction of 217 s.f. of hardcover. Reduction in hardcover will be
accomplished by removal of an island within the center of the large
• driveway area, making that driveway appear as a loop rather than as a
cul-de-sac. The proposed reduction is adequate given the size and
configuration of the property.
D. The average lakeshore setback variance is justified by the conclusion that
existing views of the lake enjoyed by neighboring property owners will
not be encroached upon by the proposed additions or roof revisions.
E. Lot coverage on the property is currently 7.7% and with the proposed
additions will increase to 8.8%, meeting the standard 15% limitation.
F. Although the lot size is conforming with an area of approximately 1.5
acres, nearly half of the lot is in the 0-75' setback zone, resulting in
overall hardcover on the property just under 19%, meeting the DNR
maximum hardcover standard of 25% of the property area. .
G. The shape of the lot and the curve of the shoreline, as well as the fact
that lake exists on both the north and east sides of the property are
hardships that are unique to the property.

4. The City Council has considered this application including the findings and
recorrunendations of the Planning Commission, reports by City. staff, comments
by the applicant and the effect of the proposed variance on the health, safety and
welfare of the community.
5. The City Council finds that the conditions existing on this property are peculiar
to it and do not apply generally to other property in this zoning district; that
granting the variance would not adversely affect traffic conditions, light, air nor
pose a fire hazard or other danger to neighboring property; would not merely
serve as a convenience to the applicants, but is necessary to alleviate a
demonstrable hardship or difficulty; is necessary to preserve a substantial
property right of the applicant; and would be in keeping with the spirit and
intent of the Zoning Code and Comprehensive Plan of the City.
COIeTCLUSIONSj ORDER AND CONDITIONS �
� • Based upon the above findings, the Orono City Council hereby grants variances
to Municipal Zoning Code Sections 10.22, Subdivisions 1 and 2; 10.55, Subdivision 8; and
10.56, Subdivisions 16 (C) and (L) to permit the construction of room additions and revisions
to the roof structure of the existing house and additions, a portion of which are located in the
0-75' lakeshore setback zone where no hardcover or structure is normally allowed, and grants
a variance for hardcover in the 75-250' setback zone for hardcover in excess of the 25%
normally allowed, and grants a variance for average lakeshore setback encroachment where no
such encroachment is normally allowed, subject to the following conditions:
1. Hardcover in the 0-75' zone shall not exceed the existing 9.1% as shown on the
site plan and hardcover worksheet attached to this resolution as Exhibit A.
Hardcover in the 75=250' zone shall not exceed 30.25% as shown on Exhibit A.
The hardcover removaTs necessary to achieve this hardcover `level shall be
completed prior to the footing inspection for the proposed new construction.
Applicant is advised that hardcover on the properiy exceeds the normal limits,
and any future proposal to increase hardcover on the property will likely not be
� approved, but might be approved only in conjunction with the concurrent
removal of pre-existing hardcover, resulting in no net increase or a net decrease
in hardcover on the property.

2. Applicant shall adhere to the construction plans and site plan subinitted, and any
plan changes which result in a greater magnitude of variances will be subject to
further review by the City.
3. Authorities granted by this variance run with the property not with the applicant,
but are permissive only and must be exercised by application for a building
permit w.ithin one year of the date of Council approval, or this variance will
expire on that date (September 9, 1997).
4. Violation of or non-compliance with any of the terms and conditions of this
resolution shall constitute a violation of the zoning code, shall automatically
terminate any authority granted herein, and shall be punishable as a
misdemeanor.
5. The undersigned applicant has read, understood and hereby agrees to the terms
� of this resolution and on behalf of himself, his heirs, successors and assigns,
hereby agrees to the recording of this resolution in the chain of title of the
property.
