ORONO CITY COUNCIL MEETING MONDAY, APRIL 14, 2003 6. #02-2859 Blake & Mary Bichanich, 332 Westlake Street-Variances-Continued precedents and found none . . Gaffron stated that they have the same issue with ½-acre lots in the 1-acre zone. If setbacks are too small, then drainage issues arise. Sansevere stated that they have to work with the rules in place, or change them, but there is no hardship. White agreed. Gaffron stated they could provide Council with a review of lakeshore lots in the 2-acre zone and get the percentages that would meet the conditions under review, so that Council could consider whether a code change might be appropriate. Murphy stated the planned house would be significantly larger than the neighboring homes. The precedent would be that every time lots get combined, people would build to a 20' setback with 4' encroachments. Moorse stated that Orono has tried to maintain space between houses as part of its character. He suggested keeping some green space between houses, especially in an area where the houses are typically close together. Murphy moved, and White seconded, to approve the requested variances for lot area of 1.34 acres where 2 acres are required, and lot width of 100.28' where 200' is required with the condition that the existing shed in the 0-75' zone be removed, and to deny the requested side yard setback variance, requiring a setback of 30'. (35.34%) hardcover in the 250-500' setback zone where 1,963.5 s.f. (30%) is allowed. Vote: Ayes 5, Nays 0. 9. #02-2863 Richard Kail, 3753 Casco Avenue--Variances White stated he removed it from the Consent Agenda because he wondered if the house could be moved further south to reduce structural coverage. Bottenberg stated that it could not. Structural coverage is a total site figure, so he'd be over the allowed coverage no matter where the house is positioned on the lot. White stated that the lot was the worst one on Casco Point. He stated there are City- owned lots adjacent to the Kail's that are used for dumping garbage. White suggested allowing the Kail's to buy one of the lots and clean it up, increasing their lot size to allow a larger structure on the site. He also stated that the alley next to the lot would never be used as a road, but the Kail's couldn't count it in their lot size, giving them a disadvantage .. Kail stated that he could not reduce the size of his house without totally redesigning it. The alley is his only hardship. Mayor Peterson stated that he has a substandard lot with a larger house. Kail responded that his house is 1,999 s.f. without the garage. The garage brings the house to 2,856 s.f. Murphy stated that the best solution would be to sell him the adjacent lot to the south. Bottenberg stated that the Planning Commission discussed the alley, and decided that the City would not be likely to vacate it. Barrett added that Kail therefore requires a variance. 4 ORONO CITY COUNCIL MEETING MONDAY, FEBRUARY 10, 2003 9. #02-2863 Richard Kail, 3753 Casco Avenue-Variances-Continued White stated that the lot slopes with a steep drop-off, and therefore the house can't shift around at all. Kail stated that he paid $98,000 in cash for the lot and on his current budget will need to build the house himself. Sansevere asked if Kail knew the variance would be denied and was okay with that, since the item had been put on the Consent Agenda. Bottenberg stated that he did. She suggested he redesign the house to get it under 15% lot coverage and remove the need for a variance. Kail brought her a design without the porch roof, but the hardcover remained at 17.7% Sansevere asked Bottenberg if she could find a hardship for the applicant. She stated she could not, and neither could the Planning Commission. They want to be consistent in requiring new construction to be under 15% lot coverage. White stated that the vacant lot could not be developed because it is wetland, but if sold to the Kail' s, it would be cleaned up and give him the necessary lot size to keep his house as designed. Gappa stated the lots were tax forfeited years ago. Bottenberg stated that the Planning Commission only discussed vacating the alley, but not the lots. Gappa stated they could consider keeping easements in the alleyway. Nygard asked if adjacent land owners had first right of refusal when the City sells property. Gappa stated the alley was not of future value and the City could retain easements, but he hated to give up a lot because of the potential use for stormwater management. Bottenberg stated that if they vacated the alley, he would be at 15. 3 % lot coverage, without the porch as a structure, or 66 s.f. over the allowed. Gappa stated Kail would likely only get half the alley, and his neighbor would get the other half. Bottenberg stated that with half the alley, he would be over his coverage by 254 s.f. Kail suggested he could reduce the garage from a 3-stall to a 2-stall. Bottenberg stated that with that reduction in the garage and half the alley, he would be within 15%. She stated that the alley couldn't be vacated until it went before the Planning Commission at . the March meeting. 5 ORONO CITY COUNCIL MEETING MONDAY, FEBRUARY 10, 2003 9. #02-2863 Richard Kail, 3753 Casco Avenue-Variances-Continued Gappa stated the City would need an extension of the 60-day rule requirement. Kail said he would grant it. Mayor Peterson stated the City would not consider vacating the adjacent lot at this time because of the stormwater issue. She told Mr. Kail to work with Bottenberg on the numbers. White moved, and Murphy seconded, to table Item 9. Vote: Ayes 5, Nays 0. MAYOR/COUNCIL REPORT Sansevere stated that the City of Plymouth mandates establishments card anyone who appears to be under 40 and suggested Orono do the same. Moorse stated it was a "best practice" policy that was encouraged, but could not be enforced with a penalty. Barrett stated that as such, there would be no problem implementing the practice in Orono. White asked about removal of hazardous old wood from playground equipment on public property. Gappa stated that he only knew of Bederwood Park needing things removed. Murphy asked if the problem was legitimate. Deb Halvorson, Park Commission member, indicated a recent newspaper article described the potential effects of the hazardous materials in the wooden playground equipment. Nygard stated that arsenic is released wl1en people bum old wood items like picnic tables. The only safe disposal was to bury the item in a clay soil, or to bum it at the Hennepin County waste facility, which has the ability to contain the pollutants. Nygard stated that he spoke to Mr. Weiss regarding his letter in the newspaper about Navarre Fire Service. Weiss was concerned that Orono wanted to move away from Mound regarding fire service. Nygard assured him that the City was happy with Mound's service, but needed the new station for other reasons. Mayor Peterson asked who would attend the Elected Official Conference in St. Louis Park at the end of February. Mayor Peterson, White, and Murphy expressed interest. Moorse stated that the Long Lake Fire Department moved to their new station last Saturday. They held a nice ceremony with a parade of the trucks and gave tours of the new facility. They had a flag raising ceremony and a blessing of the station. 6 MINUTES OF THE ORONO PLANNING COMMISSION MEETING Wednesday, January 22, 2003 6:30 o'clock p.m. (#02-2862 STEVEN GRONW ALL, Continued) Gronwall indicated that he could remove a patio slab at the rear of the house and consider removing a bordered garden elsewhere. · Bottenberg agreed that not much else existed that could be removed to maintain current levels, although the patio would balance the equation. Zugschwert moved, Hannaford seconded, to approve Application #02-2859, Steven Gronwall, granting rear yard setback and side yard adjacent street setback variances to permit constructioJJ of an attached garage with a second story to be located 14' from the side yard adjacent street for the property at 1586 Long Lake Blvd. VOTE: Ayes 5, Nays 1, Rahn dissenting. Rahn felt this proposal allowed too much mass merely 4.5' from the property line. (#11) #02-2863RICHARD KAIL, 3753 CASCO A VENUE, VARIANCES 11:46 -12:02 AM Richard Kail, Applicant, was present. Bottenberg explained that the applicant was requesting lot area and lot coverage by structure variances to construct a new residence on the property. She pointed out that approximately 4 years ago the residence on the property burned and all that remains on the property is a foundation a:nd accessory structure (detached garage). She added that, in 1995 , the applicant applied for and was granted a lot area variance to construct a new residence on the property, which has since expired. Since that time, the ownership of the subject property changed between family members, the applicant regained ownership and has applied for variances to construct a new residence on the property. Whereas the lot area is .37 acres in an LR-IC zoning district where .5 acres is required, and existing lots ofrecord would be required to meet .4 acres, Bottenberg pointed out that in 1995 the applicant was granted a lot area variance. The proposed residence is 2,856 s.f. and a covered porch of 406 s.f .. for a total of 3,262 s.f. (20%). Bottenberg stated that the lot coverage by structures is over the allowed amount by 847.75 s.f. Bottenberg explained that staff recommends approval of the lot area variance; however, based on city regulations staff recommends denial of the lot coverage by structure variance. Chair Smith indicated that while there would not be an issue with regard to the lot area variance, the lot coverage variance would likely not be approved . Kail indicated that if the lower porch were removed, they could eliminate 408 s.f. There were no public comments. Rahn asked if the plan reflected a two or three car garage. Kail believed if the neighboring alley were vacated he would be closer to the 15% coverage requirement. Chair Smith asked if the applicant could make any further reductions to reduce the structural lot coverage numbers or ifhe had adequate hardship to convince the Commission the variance is warranted. Kail reiterated that if the neighboring alley were vacated he would gain more area. He believed the City had never filed for the alley and due to the presence of a shed foundation and well in the alley belonging to this parcel he should be entitled to file for its rights. Mabusth questioned whether the alley had ever been vacated. Kail indicated that he was trying to find out who owns the alley, arguing the City did not file for it, and felt the Council would allow him to vacate it. Gaffron pointed out that, since the alley was a dedicated plat, the City need not file. In addition, Gaffron stated that he had difficulty believing the City would ever vacate the parcel due to drainage issues. Chair Smith maintained that the proposed new construction would need to be reduced to 15%, rather than the 20% as proposed. She explained that, while the lot area variance would be acceptable, not more than 15% structural lot coverage would be allowed, therefore a revision was needed. Kail stated that he saw no way to reduce the proposed application to 15%. Rahn reiterated that 15% is the maximum structural lot coverage allowed. Chair Smith stated that, if the applicant chose for the Commission to vote on what was in front of them it would likely be a denial. Kail repeated that he saw no way to downsize the proposal and asked for a vote. Chair Smith moved, Mabusth seconded, to approve the Lot Area Variance and deny the Lot Coverage Variance for Application #02-2863, Richard Kail, to construct a new residence on the property located at 3753 Casco Avenue. Gaffron indicated that the January 29 Work Session topics will include rebuilds versus new construction, and other topics as noted on the packet cover sheet. The applicant decided to go forward with an application to vacate the adjacent alley in hopes of increasing the size of the property. The vacation application was denied at the March 24, 2003 City Council meeting. The applicant is requesting lot area and lot coverage by structure variances for construction of a new residence to replace the existing foundation and detached accessory building left on the property after the residence was destroyed by fire. Planning Commission has recommended approval of the lot area variance and denial of the lot coverage by structure variance. The last revised plan staff received from the applicant is still over the 15% lot coverage by structures at 2,631 s.f. (16.3%). Discussion: Approximately 4 years ago the residence on the subject property burned and all that remains on the property is a foundation and accessory structure ( detached garage). In 1995 the applicant applied for and was granted a lot area variance to construct a new residence on the property. The variance expired without the applicant applying for a building permit. Since that time the ownership of the subject property has changed between family members. The applicant again owns the property and has applied for variances to construct a new residence on the property. Lot Area: The lot area is 16,095 s.f. (.37 acre) in the LR-lC zoning district where 21,780 s. f. (.5 acre) is required and where existing lots of record would be required to meet 17,424 s. f. ( .4 acre) or 80%. In 1995, the applicant was granted a lot area variance to construct a new residence on the property. (Res. #3573). Lot Coverage by Structures: The proposed redesigned residence is 2,631 s.f. (16.3%). The lot coverage by structures is OVER the allowed amount. Hardcover: The subject property falls in two hardcover zones, 250-500' and 500-1000'. The construction of the residence is located in the 500-1000' setback zone. The proposed hardcover in the 500- 1000' setback zone is 4,624 s. f. ( 44 % ) and exceeds the allowed 3643 s. f. (35 % ) , the applicant has not used all of the 1706.25 s.f. in the 250-500' setback zone. The City does allow credit for unused hardcover allotment to be transferred to zones further from the lake. This is referred to as transfer of hardcover allotments from zone to zone. Therefore, a hardcover variance in the 500-1000' setback zone is not required. PLANNING COMMISSION: The Planning Commission recommended by a 6 to O vote to: Approve the lot area variance but deny the request for a lot coverage variance. Planning Commission indicated that there is no hardship to support the lot coverage variance. The applicant would have to downsize the house in order to obtain a building permit. (15%) is allowed; and WHEREAS, after due published notice and mailed notice in accordance with Minnesota Statutes and the City of Orono Zoning and Planning Codes, the Orono Planning Commission held a public hearing on January 22, 2003, at which time all persons desiring to be heard concerning this application were given the opportunity to speak thereon. NOW, THEREFORE, BE IT RESOLVED by the City Council of Orono, Minnesota: FINDINGS 1. This application was reviewed as Zoning File #02-2863. 2. The property is located in the LR-IC Zoning District, where 0.5 acres is the minimum required lot area. The property consists of approximately 0.37 acres. Page 1 of 5 3. The property contained an existing residence foundation and detached garage originally built in 1950, which was destroyed by fire in 1998, leaving only the foundation and a detached garage. 4. The Orono Planning Commission reviewed this application on January 22, 2003 and recommended approval of the lot area variance and denial of the lot coverage by structures variance by a vote of 6 to 0. The Planning Commission made the following finding of fact: A. The lot area of 0.37 acres is sufficient to allow reconstruction on the site, where a residence has previously existed for many years. B. Removal of the existing foundation and building a new residence is new construction requiring that all lot standards must be met. C. There is insufficient hardship to support the requested lot coverage by structures variance. The need for extra storage and lack of land to combine suggested by the applicant as a hardship, can be ameliorated by downsizing the design of the residence to meet the required lot coverage by structure limitation. Furthermore, while the land adjacent to the subject property is a platted alley, the City does not intend to vacate it. 5. The City Council finds that the conditions existing on this property are peculiar to it and do not apply generally to other property in this zoning district; that granting the variances will not adversely affect traffic conditions, light, air, nor pose a fire hazard or other danger to neighboring property; would not merely serve as a convenience to the applicants, but is necessary to alleviate a demonstrable hardship or difficulty; is necessary to preserve a substantial property right of the applicants; and would be in keeping with the spirit and intent of the Zoning Code and Comprehensive Plan of the City. 6. The City Council has considered this application including the findings and recommendations of the Planning Commission, reports by City Staff, comments by the applicants and the effect of the proposed variances on the health, safety and welfare of the community. Page 2 of 5 CONCLUSIONS, ORDER, AND CONDITIONS Based upon one or more of the above findings, the Orono City Council hereby grants a variance to Municipal Zoning Code Section 10.25, Subdivision 6 (B) to allow construction of a new single family residence to replace a pre-existing residence on a .3 7 acre lot in the LR-1 C Zoning District where a .5 acre minimum lot area is required; and to deny a variance for lot coverage by structures for said construction. Approval is subject to the following conditions: 1. No variances other than lot area are granted by this resolution. The applicant must provide construction plans meeting all city lot requirements in order to obtain a building permit. 2. Authorities granted by this variance run with the property not with the applicants, but are permissive only and must be exercised by application for a building permit within one year of the date of Council approval, or these variances will expire on that date (April 14, 2004). 3. Violation of or non-compliance with any of the terms and conditions of this variance shall constitute a violation of the zoning code, shall automatically terminate any authority granted herein, and shall be punishable as a misdemeanor. 4. The undersigned applicants have read, understood and hereby agree to the terms of this resolution and on behalf of themselves, their heirs, successors and assigns, hereby agree to the recording of this resolution in the Chain of Title of the property. Discussion: Approximately 4 years ago the residence on the subject property burned and all that remains on the property is a foundation and accessory structure ( detached garage). In 1995 the applicant applied for and was granted a lot area variance to construct a new residence on the property. The variance expired without the applicant applying for a building permit. Since that time the ownership of the subject property has changed between family members. The applicant again owns the property and has applied for variances to construct a new residence on the property. Lot Area: The lot area is 16,095 s.f. (.37 acre) in the LR-lC zoning district where 21,780 s. f. (.5 acre) is required and where existing lots of record would be required to meet 17,424 s.f. (.4 acre) or 80%. In 1995, the applicant was granted a lot area variance to construct a new residence on the property. (Res. #3573). Lot Coverage by Structures: The proposed residence is 2,856 s.f. and a porch is 406 s.f. for a total 3,262 s.f. (20%). The porch is covered, therefore is included in lot coverage by structures. The lot coverage by structures is OVER the allowed amount by 847.75 s.f. Hardcover: The subject property falls in two hardcover zones, 250-500' and 500-1000'. The construction of the residence is primarily located in the 500-1000' setback zone. A small portion of the residence a·nd porch are located in the 250-500' setback zone for a total of 408 s.f. Even though the proposed hardcover in the 500-1000' setback zone is 3,960 s.f. (38%) and exceeds the allowed 3642.63 S;f. (35 % ), the applicant has not used all of the 1706.25 s.f. in the 250- 500' setback zone. The City does allow credit for unused hardcover allotment to be transferred to zones further from the lake. This is referred to as transfer of hardcover allotments from zone to zone. Therefore, a hardcover variance in the 500-1000' setback zone is not required. PLANNING COMMISSION: The Planning Commission recommended by a 6 to 0 vote to: Approve the lot area variance but deny the request for a lot coverage variance. Planning Commission indicated that there is no hardship to support the lot coverage variance. The applicant would have to downsize the house in order to obtain a building permit. The property is located in the LR-lC Zoning District, where 0.5 acres is the minimum required lot area. The property consists of approximately 0.37 acres. Page 1 of 5 3. The property contained an existing residence foundation and detached garage originally built in 1950, which was destroyed by fire in 1998, leaving only the foundation and a detached garage. 4. The Orono Planning Commission reviewed this application on January 22, 2003 and recommended approval of the lot area variance and denial of the lot coverage by structures variance by a vote of 6 to 0. The Planning Commission made the following finding of fact: A. The lot area of 0.37 acres is sufficient to allow reconstruction on the site, where a residence has previously existed for many years. B. Removal of the existing foundation and building a new residence is new construction requiring that all lot standards must be met. C. There is insufficient hardship to support the requested lot coverage by structures variance. The need for extra storage and lack of land to combine suggested by the applicant as a hardship, can be ameliorated by downsizing the design of the residence to meet the required lot coverage by structure variance. Furthermore, while the land adjacent to the subject property is a platted alley, the City does not intend to vacate it. 5. The City Council finds that the conditions existing on this property are peculiar to it and do not apply generally to other property in this zoning district; that granting the variances will not adversely affect traffic conditions, light, air, nor pose a fire hazard or other danger to neighboring property; would not merely serve as a convenience to the applicants, but is necessary to alleviate a demonstrable hardship or difficulty; is necessary to preserve a substantial property right of the applicants; and would be in keeping with the spirit and intent of the Zoning Code and Comprehensive Plan of the City. 6. The City Council has considered this application including the findings and recommendations of the Planning Commission, reports by City Staff, comments by the applicants and the effect of the proposed variances on the health, safety and welfare of the community. Page 2 of 5 CONCLUSIONS, ORDER, AND CONDITIONS Based upon one or more of the above findings, the Orono City Council hereby grants a variance to Municipal Zoning Code Section 10.25, Subdivision 6 (B) to allow construction of a new single family residence to replace a pre-existing residence on a .3 7 acre lot in the LR-1 C Zoning District where a .5 acre minimum lot area is required; and to deny a variance for lot coverage by stru~tures for said construction. Approval is subject to the following conditions: 1. No variances other than lot area are granted by this resolution. The applicant must provide construction plans meeting all city lot requirement in order to obtain a building permit. 2. Authorities granted by this variance run with the property not with the applicants, but are permissive only and must be exercised by application for a building permit within one year of the date of Council approval, or these variances will expire on that date (February 10, 2004). 3. Violation of or non-compliance with any ofthe terms and conditions of this variance shall constitute a violation of the zoning code, shall automatically terminate any authority granted herein, and shall be punishable as a misdemeanor. 4. A single family residence existed on the property for over 50 years prior to being destroyed by fire. 2. The properties in the immediate neighborhood to the applicant's lot are also undersized and most do not meet the required area in the zoning district. (See plat map). 6. Other issues raised by the Planning Commission. Staff Recommendation: Staff recommends approval of the lot area variance. Based on city regulations staff recommends denial of the lot coverage by structure variance. If the Planning Commission feels the applicant can meet all the requirements, including lot coverage by structures, then a recommendation of approval for the lot area variance would be appropriate. It states that structural cover cannot be more than 15 percent. As you can see per the survey, we are at 17.7 percent. We have looked at many plans that meet compliance to all of the setbacks and hardcover issues, and this one is the closest we could find. As you can see from the survey, we have met the setbacks on Front, Back, and both sides along with the hardcover calculations provided by the surveyor at 27 percent. It has been brought to my attention . with a concern for depth of the garage where as I have replied that I cannot change this because we are already over on allowable structure cover. We have looked at all possibilities of down sizing this house plan with qualified architects and structural engineers with the response being, we have to follow the plan. We have 3 vehicles; this is why the need exists for the garage space. We currently have room for 5 on our present property along with room to store 2 snowmobiles and lawn equipment. NOW, THEREFORE, BE IT RESOLVED by the City Council of Orono, Minnesota: ,_ FTh"TIINGS 1. This application was -reviewed as Zoning File #2027. 2. The property is located in the LR-lC Lakeshore Residential Zoning District requiring one-half acre in area. 3. The Orono Planning Commission reviewed this application on.June 19, 1995 and recommended approval of the proposed variance based upon the following unique findings and hardships: A. A single family residence has existed on the property for over 50 years. B. The property is served with municipal sewer and water. C. There is no adjacent land available to acquire except for the 14' unimproved public alley to the east. If alley were to be vacated, applicant \Vould receive 1,253 s.f. of additional area. The existing structure is located 18' from the street lot line where a 30' setback is required. F. The existing structure is located O' from the east side lot line where a 10' setback is required. G. The subject property is consistent with the size and width of other adjacent properties in the immediate neighborhood. H. The new construction will have no impact on residential development as all drainage will drain directly to a ponding area on land owned by City to south and west. ' 4. The City Council finds that the conditions existing on this property are peculiar to it and do not apply generally to other property in this zoning district; that granting the variances would not adversely affect traffic conditions, light, air nor pose a fire hazard or other danger to neighboring property; would not merely serve as a convenience to the applicant, but is necessary to . alleviate a demonstrable hardship or difficulty; is necessary to preserve a substantial property right of the applicant; and would be in keeping with the spirit and intent of the Zoning Code and Comprehensive Plan of the City. 5. The City Council has considered this application including the findings and recommendations of the Planning Commission, reports by City staff, comments by the applicant and the effect of the proposed variance on the health, safety and welfare of the community. CONCLUSIONS, ORDER AI\1) CO:\'DITIONS Based upon one or more of the above findings, the Orono City Council hereby grants a variance to Municipal Zoning Code Section 10.25, Subdivision 6 (B) to permit the construction of a residence on a property that does not meet the required area for the zoning district and grants a variance of 6,135 s.f. or 28 % (per Section 10.03, Subdivision 16 (A-1), variance of 1,779 s.f. or 10%), subject to the following conditions: Page 2 of 4 CITY of ORONO RESOLUTION OF THE CITY COUNCIL NO. 3 5 7 3 1. Upon application for a building permit, applicant shall provide a survey locating designated wetland at the southwest corner and proposed house. Applicant shall also provide detailed grading and drainage plans. 2. The concrete pad located within public alley to be removed prior to the issuance of a building permit for new construction. 3. Applicant to obtain a demolition permit for the removal of both the garage and house. The Building staff shall determine if detached garage can remain 1during the period of construction of new residence. Per Section 10.03, Subdivision 7, applicant may apply for a permit from the City that will allow applicant to reside in the existing residence for a three-rrionth period. 4. Authorities granted by this variance run with the property not with the applicant, but are permissive only and must be exercised by application for a building permit within one year of the date of Council approval, or this variance will expire on that date (June 26, 1996). 5. Violation of or non-compliance with any of the terms and conditions of this variance shall constitute a violation of the zoning code, shall automatically terminate any authority granted herein, and shall be punishable as a misdemeanor. 6. The undersigned applic;ant has read, understood and hereby agrees to the terms of this resolution and on behalf of himself, his heirs, successors and assigns, hereby agrees to the recording of this resolution in the Chain of Title of the property. After speaking to Brad Nielsen, Planning Director for the City of Shorewood, Gaffron indicated that their threshold for new construction is 50%. Zugschwert stated that the City may be faced with legal challenges in the future if it does not set parameters in ordinance form for new construction versus remodels. Type of data. The rights of individual on whom the data is stored or to be stored shall be as set forth in this section. Subd. 2. Information required to be given individual.
