HomeMy WebLinkAboutResolution 1519 . ,� - __ _ . .� � Cit of ORONO ; � d . . �' . . i r� RESOLUTION OF THE CITY COUNCIL � � � NO: i �iA . � • � � - � � ORDERING PREPARATION OF A SEWER AND WATER FEASIBILITY REPORT FOR PROPERTY ABUTTING THE NORTH SIDE OF WAYZATA BOULEVARD ' BETWEEN WILLOW DRIVE AND BROWN ROAD WHEREAS, McDonald ' s Corporation has applied to the City for a Conditional Use Permit to construct a new restaurant on a portion of property described as tax parcel property identification no. 34-118-23 � 21 0001; and . WAEREAS, McDonald' s Corporation on July 15, 1983, submitted to the City a request to have sewer and water service provided to their part of the above ' described property; which request wasreviewed at the Planning Commission public hearing on August 15, 1983 , and which request was thereafter referred to the City � Council on September 12, 1983; and iWHEREAS, said request does not constitute a petition for public improvement pursuant to Minnesota Statutes, Section 429.035, because it is not signed by the fee owner of the property involved; and ' WHEREAS, the above described property is located in the B-1 Retail Sales � Zoninq District , which district has not yet been served by an Orono Water or Sewer main, but which district is included within the Metropolitan Urban Service Area for which the City' s Comprehensive Community management Plan has contemplated eventual sewer and water service. � NOW, THEREFORE BE IT RESOLVED by the City Council of the City of Orono , Minnesota : 1 . The above referenced request is hereby accepted by the City Council as being consistent with long range planning and zoning objectives of the City. � � 2. The City Council hereby determines that the above referenced request should be studied in a wider context than providing service to just one � proposed business on just part of one commercially-zoned �property. � 3. The City Council hereby determines that the scope of the proposed sewer � and water feasibility study will be expanded to include for study 4 purposes all the following properties : � . � a) All property currently zoned B-1 Retail Sales in Section 34, Township ( 118, Range 23, including those portions of adjacent residentially zoned I property which are the subject of current rezoning application file A! #768 . � � .
