In tldition, some of the Co cil Members questioned what the implications would be if some of th wiring west of Navarre Lane as salvaged. Struve indicated Staff has revi ed the lighting spectrum and it is Staf opinion that there will be adequate light throughout th corridor with the new lights at the proposed cations . Staff also looked at the intersection of Carma treet and Casco Point Road. The home will be conforming with respect to all setbacks, structural coverage and hardcover; it will be constructed right up to the average lakeshore setback line . They are proposing to construct an elevated patio on the southeast side of their new home entirely ahead of the average lakeshore setback line. It will be elevated by adding fill to a level 7.8 feet above existing grade . Because the patio will be nearly 8 feet higher than the existing grade and ahead of the average lakeshore setback, a variance is necessary . The patio will be 2 feet lower than the adjacent grade outside of the home to the southeast at 2696 Caroline Avenue {Millers) and screened from the Millers' home by a stand of existing mature trees. The Millers and Mr. Pulver {2691 Caroline Avenue) have provided letters of support for the applicants' variance request which are included in the packet. Planning Commission Recommendation On November 18, 2013, the Planning Commission voted 5 to Oto recommend approval of the variance. Planning Staff Recommendation Staff recommends approval of the average setback variance noting the practical difficulties inherent to the property and the neighbor support. COUNCIL ACTION REQUESTED The Council should consider adopting or amending the attached approval resolution. A RESOLUTION GRANTING A VARIANCE TO MUNICIPAL ZONING CODE SECTION 78-78-1279(6) FILE NO. 13-3642 Council Exhibit A WHEREAS, Ziv Liberman and Tai Liberman, a married couple (hereinafter "the Applicants") are the owners of the property located at2690 Caroline Avenue within the City of Orono (hereinafter the "City") and legally described as follows: Attached as Exhibit A (hereinafterthe "Property"); and WHEREAS, the Applicants have made application to the City of Orono for a variance to Orono Municipal Zoning Code Section 78-1279(6) to allow construction of a new above grade patio ahead of the average lakeshore setback in conjunction with the construction of a new single family residence on the Property; and WHEREAS, after due published notice and mailed notice in accordance with Minnesota Statutes and the Orono, Minnesota, City Code, the Orono Planning Commission held a public hearing on November. 18, 2013 at which. times all persons desiring to be heard concerning this application were given the opportunity to speak thereon. NOW, THEREFORE BE IT RESOLVED by the City Council of Orono, Minnesota: FINDINGS 1. This application was reviewed as Zoning File number 13-3642. 2. The Property is located in the LR-1 C One Family Lakeshore Residential Zoning District which requires a minimum lot area of 0.5 acre and a minimum lot width of 100'. 3. The Planning Commission reviewed this application at a public hearing held on November 18, 2013 and voted 5 for and O against on a motion to approve the average lakeshore setback variance based on the following findings: a. The Property contains 28,994 square feet in area and has a defined width of 225-feet at the lake and 122-feet at the 75-foot setback. Page 1 of 4 b. The Planning Commission finds a new home can be constructed to meet the required average lakeshore setback. c. The Property has a unique shape and a large 0-75' area which partially functions as though it is a peninsula. d. Both adjacent neighbors (at 2691 Caroline Avenue and 2696 Caroline Avenue) have submitted letters of support for the application including the average lakeshore setback variance as requested. e. The proposed elevated patio and associated ~rading will meet the 75-foot lake setback. · f. The Property will conform to the hardcover limitations of Tier 1. g. The Applicants' proposed elevated patio will not alter the essential character of the neighborhood and will result in. minimal or no negative impact on adjacent properties. h. The Applicants' proposal to remove the existing above grade deck and move the outdoor living space to the southeast side of the Property will improve the potential lake views enjoyed from the home at 2691 Caroline Avenue. i. The existing lake views enjoyed from the property at 2696 Caroline Avenue will not .be adversely impacted by the Applicants' proposed patio due to the elevation difference between the properties and the existing trees on both properties. j. The Applicants' request is in harmony with the purpose and intent of the ordinance. k. The Applicants have demonstrated that enforcing the provisions of the Zoning .Ordinance deprives the Applicants of the reasonable use of their Property. I. The Applicants' proposed elevated patio is designed in a way which minimizes. impact of the visual encroachment as opposed to the existing elevated deck. m. The Applicants' request is in harmony with the purpose and intent of the ordinance. Page 2 of 4 4. The City Council has considered this application including the findings and recommendation of the Planning Commission, reports by City staff, comments by the Applicants and the public, and the effect of the proposed variance on the health, safety and welfare of the community. 5. The City Council finds that the conditions existing on this Property are peculiar to it and do not apply generally to other property .in this zoning district; that granting the variance would not adversely affect traffic conditions, light, air nor pose a fire hazard or other danger to neighboring property; would not merely serve as a convenience to the Applicants, but is necessary to alleviate a practical difficulty; is necessary to preserve a substantial property right of the Applicants; and would be in keeping with the spirit and intent of the Zoning Code and Comprehensive Plan of the City. CONCLUSIONS, ORDERAND CONDITIONS Based upon one or more of the above findings, th.e Orono City Council hereby grants variances to Orono Municipal Zoning Code Section 78..:1279(6) to allow construction of a new above grade patio ahead of the average lakeshore setback in conjunction with the construction of a new single family residence on the Property, subject to the following conditions: 1. Council approval is based on the survey submitted by the Applicants and annotated by City staff, attached to this Resolution as Exhibit 8. Any amendments to the site plan which are not in conformity with City codes will require further Planning Commission and City Council review. 2. Proposed hardcover levels are conforming to the Tier 1 standards and no hardcover variances are granted. 3. Authorities granted by this resol.ution run with the property not with the Applicants, but are permissive only and must be .exercised by obtaining a building permit for the home which includes the proposed patio and commencing construction of said project. A framing inspection must be completed for the home within one year of the date of Council approval, or the variance for the patio will expire on that date (November 25, 2014). 4. Violation of or non-compliance with any of the terms and conditions of this resolution shall constitute a violation of the zoning code, shall automatically terminate any authority granted herein, and shall be punishable as a misdemeanor. 5. The undersigned Applicants have read, understand and hereby agree to the terms of this resolution and on behalf of the Applicants and the Applicants' heirs, successors and Page 3 of 4 assigns, hereby agree to the recording of this resolution in the chain of title of the Property. No principal or accessory structure shall be located closer to the lakeshore than the average distance from the shoreline of existing residence buildings on adjacent lots; except that this does not apply to stairways, lifts, landings and lockboxes. Background The applicants have applied for a building permit to construct a new residence on the property. The home will be conforming with respect to all setbacks, structural coverage and hardcover; it will be constructed right up to the average lakeshore setback line. The existing home on the property is located similarly up to the average lakeshore setback line and has an above grade deck on the north side which encroaches entirely within the average lakeshore setback. With the new home the applicants would be permitted an in-kind replacement of the above grade deck in the non-conforming location, however they wish to improve upon the impact to the adjacent neighbor to the north at 2691 Caroline Avenue (Pulver) and construct an outdoor living area more conducive to the topography of the property. The have proposed to construct an elevated patio by adding fill to a level 7.8 feet above existing grade. The new patio will be screened from view from the property to the south by existing trees. Because the patio will be nearly 8 feet higher than the existing grade and ahead of the average lakeshore setback, a variance is necessary. The applicants propose to grade the lake side of the home up to the 75 foot setback and create a patio off of the first floor of the new home. This patio will be 7.8 feet above the existing patio on the property today. The patio will be 2 feet lower than the adjacent grade outside the home to the south at 2696 Caroline Avenue (Miller). Practical Difficulties Statement Applicant has completed the Practical Difficulties Documentation Form attached as Exhibit B, and should be asked for additional testimony regarding the application. Practical Difficulties Analysis In considering applications for variance, the Planning Commission shall consider the effect of the proposed variance upon the health, safety and welfare of the community, existing and anticipated traffic conditions, light and air, danger of fire, risk to the public safety, and the effect on values of property in the surrounding area. The Planning Commission shall consider recommending approval for variances from the literal provisions of the Zoning Code in instances where their strict enforcement would cause practical difficulties because of circumstances unique to the individual property under consideration, and shall recommend approval only when it is demonstrated that such actions will be in keeping with the spirit and intent of the Orono Zoning Code. The applicants' property has 28,994 square feet in area; approximately 18,800 square feet of which is unbuildable due to the average lakeshore setback. The applicants' lot has a unique shape and partially functions as though it is a peninsula. Their proposal to remove the above grade deck and move the outdoor living space to the southeast side of their property will improve the potential lake views enjoyed by Pulver. The orientation of the lot line between the applicant's property and the Miller property is awkward. If not for the stand of existing mature trees along the lot line, the orientation of the Millers' home would provide lake views over the applicants' property. It does not appear the Millers will be adversely impacted by the applicants' proposed patio due to the elevation difference between the properties and the existing trees. The Millers and Pulvers have provided letters of support for the applicants' variance request which are attached as Exhibit I. Staff finds practical difficulty in the shape and orientation of the property. Further the topography and existing trees on the applicants, and neighbor's property, assure that the views of the lake enjoyed by the Millers will not be impacted by the proposed elevated patio; the lake views enjoyed by Pulver will also be improved with the removal of the above grade deck. An application will not be considered complete or placed on any meeting agenoas until this form is complete and submitted to the City. Minnesota State Statutes Section 462.357, Subdivision 6(2) requires that practical difficulties be demonstrated in order for a variance to be granted. The difficulties must be unique to the property as variances run with the land and not the land owner. Personal and economic situations are not considered valid practical difficulties. In order for an application to be heard by the Planning Commission and City Council practical difficulties having merit must be demonstrated. HOW DO I PROVE A PRACTICAL DIFFICULTY? This form has 12 points outlining the basis City staff uses to determine if practical difficulties exist and how the variance will affect the surrounding community. To prove practical difficulties, address all the relevant points listed below and answer them as clearly as possible .. Since you are requesting the code exception, you have the burden of proving that the variance is justified. The information the City receives is what is used in determining a denial or approval recommendation. If you leave something out it will not be considered. Therefore, additional contouring, spot elevations, arrows, and notes should be added along the northwest property line near the proposed driveway to ensure that stormwater runoff is directed toward the lake and not onto the adjacent property. 2. The slope on the north side of the proposed patio appears to be greater than 3: 1. The plan should be revised to adjust grades or add retaining wall as necessary to reduce slopes to less than 3: 1. 3. The plans are unclear what is proposed for retaining walls. The Grading Plan should be revised to provide more detail for all proposed retaining wall work. Provide top of wall and bottom of wall elevations and dimensions on the retaining wall in key locations (i.e. grade changes, alignment changes). Walls four feet or greater in height must be designed by a licensed Professional Engineer. Multi-level walls spaced less than double the height of the bottom wall apart shall be considered one wall, and the height shall be determined from the base of the bottom wall to the top of the upper wall. 4. Perimeter siltfence should be installed down gradient from all land disturbing activities. The siltfence should be inspected and approved by the City prior to any work. 5. Page 21 of 35 MINUTES OF THE ORO]SO PLANNING COMMISSION MEETING ~onoay, ovember 18, 2013 6:30 o'clock p.m. Mike Sharratt, Designer, stated they started on this project in 2011 and have been working through the changes in the zoning ordinance. Sharratt stated it is their opinion that the proposed grades they are now proposing to fill in were originally there at one point in time. The wood retaining walls were the result of the dirt that was removed and that they are proposing to remove those retaining walls and refill in that area. Sharratt stated the other item is that the two side yard nonconformities will be made conforming as part of this project. The existing deck, which is currently almost entirely over the average lakeshore setback, will be made conforming. Sharratt noted the property owners have the right to rebuild the deck but that they have elected to fill in the grade beyond the deck on the northeast comer and then remove the deck structure and railing. Sharratt noted the one comer of the house is also nonconforming and will be cured as part of this project. The current proposed hardcover is 21.1 percent and structural coverage will be 13.5 percent. Sharratt stated once the project is complete, the property owners will end up with a fully landscaped yard where the slope occurs and that their plans are being revised to meet the 3: 1 slope. Sharratt indicated they will be forwarding those revised plans to Staff in the next couple of days . Sharratt stated the plan will be fully compliant in every way and that they are simply attempting to recreate what was originally there. Schwingler commented the application is pretty straight forward and will be an improvement. Landgraver stated when you are on the property, you can see that the property to the south has a drainage issue . Landgraver asked what the applicants ' plans are relating to the drainage. Sharratt illustrated the drainage swales and the flow of the drainage on the overhead. Sharratt indicated drainage swales will be created to divert the runoff down the property onto the flatter portion of the slope . Sharratt noted there is also a catch basin that was installed by the City. Sharratt stated at some point in time there was a significant amount of erosion that was occurring which resulted in the retaining walls . Landgraver asked if it is the applicants ' expectation that they will be able to implement the swales on the upper part of the property without any significant damage to the trees in the area. Sharratt stated the one existing tree is located 15 feet away from the property line and it will not be impacted by the work. Landgraver noted one of the neighbors had expressed a concern about the tree and the drainage. Leskinen asked if a portion of the stone patio will be at the level of the top of the timbers . Sharratt illustrated the location of the patio. Sharratt stated it would be at essentially at the elevation of the first floor of the existing house . Thiesse asked whether all of the timber walls would be removed. Sharratt stated they will be . Sharratt pointed out a portion of the retaining wall that is located on the neighbor's property. The home will be conforming with respect to all setbacks, structural coverage and hardcover; it will be constructed right up to the average lakeshore setback line. They are proposing to construct an elevated patio on the south side of their new home entirely ahead of the average lakeshore setback line . It will be elevated by adding fill to a level 7.8 feet above existing grade. The new patio will be screened from view from the property to the south_ by existing trees . Because the patio will be nearly 8 feet higher than the existing grade and ahead of the average lakeshore setback, a variance is necessary . The applicants propose to grade the lake side of the home up to the 75 foot setback and create this patio off of the first floor of the new home. The pat io will be 2 feet lower than the adjacent grade outside of the home to the south at 2696 Caroline Avenue (Miller). The applicants' property has approximately 29,000 square feet in area ; approximately 18,000 square feet of which is unbuildable due to the average lakeshore setback . Their lot has a very unique shape and partially functions as though it is a peninsula . Their proposal to the outdoor living space to the southeast side of their property will improve the potential lake views enjoyed by Mr. Pulver, the neighbor to the north. The Millers and Pulvers have provided letters of support for the applicants' variance request which included in the packet. Staff finds practical difficulty in the shape and orientation of the property. The topography and existing trees on the applicants, and neighbor's property, assure that the views of the lake enjoyed by the Millers will not be impacted by the proposed elevated patio; the lake views enjoyed by Pulver will also be improved with the removal of the above grade deck. The slope on the north side of the proposed patio appears to be greater than 3: I. The plan should be revised to adjust grades or add retaining wall as necessary to reduce slopes to less than 3 : I. 3. The plans are unclear what is proposed for retaining walls. The Grading Plan should be revised to provide more detail for all proposed retaining wall work. Provide top of wall and bottom of wall elevations and dimensions on the retaining wall in key locations (i .e . grade changes , alignment changes). Walls four feet or greater in height must be designed by a licensed Professional Engineer. Multi-level walls spaced less than double the height of the bottom wall apart shall be considered one wall , and the height shall be determined from the base of the bottom wall to the top of the upper wall. 4 . Perimeter siltfence should be installed down gradient from all land disturbing activities. The siltfence should be inspected and approved by the City prior to any work. 5. We understand that the Liberman's property requires variances to elevate their existing Patio to be on grade with their new main level, thus restoring what was likely the original grade, and eliminating the unsightly timber walls foreign to the site. We also understand that they will be eliminating the current above grade deck that is none conforming, and the new elevated patio is smaller than the aggregate of the existing lower patio and above grade deck. We also understand that they will be removing the existing stairs that encroach on our property, fill in the cavity, and blend in the grade. We have reviewed the design plans dated 10/25/2013 that they are proposing, and we fully support the plans and have no objection to their proposed project. As work proceeds and the final survey is completed on the Liberman project at 2690 Caroline Ave, Orono, MN, I would respectfully ask that the City of Orono continue to mindfully monitor these drainage issues to ensure that there are no negative effects from this new construct ion. Applications for a setback variance; demolition permit and building permit have been filed for a demolition and construction of a new single family residence located at 2690 Caroline Avenue the ("Subject Property"), legally described on attachment Exhibit A. 2. Owners request the City to review this application. 3. The City will commence its review of the application and incur costs associated with said review only if the Owner establishes an escrow to ensure reimbursement to the City of its costs. NOW THEREFORE, THE PARTIES AGREE AS FOLLOWS: 1. DEPOSIT OF ESCROW FUNDS. Contemporaneously with the execution of this Escrow Agreement, the Owners shall deposit $2,500 with the City. All accrued interest, if any, shall be paid to the City to reimburse the City for its cost in administering the escrow account. 2. PURPOSE OF ESCROW. The purpose of the escrow is to guarantee reimbursement to the City for all out-of-pocket costs the City has incurred (including planning, engineering, in excess of $500, or legal consultant review) or will incur in reviewing the plan. Eligible expenses shall be consistent with expenses the Owners would be responsible for under a building permit application. The escrow will also guarantee reimbursement to the City for all out-of-pocket costs the City has incurred to assure that the work is completed in accordance with the Stormwater Pollution Prevention Plan and the provisions of Orono City Code Chapter 79. The financial security may also be used by the City to eliminate any hazardous conditions associated with the work and to repair any damage to public property or infrastructure that is caused by the work (including planning, engineering, or legal consultant review) associated with Land use application #13-3642; demo permit #2013- 00959; and building permit #2013-01052 if compliance with the approved building permit is not accomplished. 3. MONTHLY BILLING. As the City receives consultant bills for incurred costs, the City will in turn send a bill to the Owners. Owners shall be respoffllibte. for paymefnt to the City within 30 days of the Owners' receipt of bill. · 4. DISBURSEMENT FROM ESCRO'll'ACCOUNT. In the event that the Owners do not make payment to the City within the timeframe outlined in #3 above, shall issue a Stop Work Order until the Owners pay al! expenses invoiced pursuant to #3.
