An OAS must meet a minimum of a 30 foot setback from all property lines. Plumbing may be installed within a
conforming accessory building via an administrative plumbing permit. Because the required 30-foot setbacks
are not met, a variance is necessary to permit plumbing within the garage.
Planning Commission Recommendation
On September 19th the Planning Commission held a public hearing and reviewed the application including the
evidence submitted. Following the public hearing the Commission voted 6 to O on a motion to approve the
variance contingent upon the owners signing the covenant regarding plumbing within an accessory building.
Planning Staff Recommendation
Staff recommends approval. A draft approval resolution has been provided for Council's consideration which
incorporates the plumbing covenants.
COUNCIL ACTION REQUESTED
Council should consider adopting or amending the approval resolution.

A RESOLUTION
APPROVING VARIANCES FROM
MUNICIPAL ZONING CODE
SECTIONS 78-1437
FILE NO. 16-3851
WHEREAS, Peter Marcus Bluth and Neff Marie Bluth, a married couple
{hereinafter the "Applicants"), are the owners of the property located at 2413 Carman Street and
legally described as: .
Lots 1, 2, and 3, Block 2, NAVARRE, according tb the recorded plat thereof,
Hennepin County, Minnesota (hereinafter the •Property');
WHEREAS, on August 22, 2016 the City Council approved variances to Orono
Municipal Zoning Code Section 78-1434 to allow a second.· story addition to the Applicants'
existing garage, (hereinafter the "OAS") less than 30~t.from the side and rear lot lines; and
WHEREAS, the Applicants' intent was to inetaU plumbing consisting of a toilet and
sink (hereinafter the "Half Bath") in the OAS.
WHEREAS, according to City Code 78-1437, plumbing is permitted within a
conforming accessory structut'$. Because the OAS does :not meet the required setbacks it is
considered non-confomung; and
WHEREAS, the Applicants are requesting a variance to City Code 78-1437 to
permit instaHation of a Half Bath within the OAS; and
WHEREAS, on September 19, 2016, after published and mailed notice in
accordance with Minnesota Statutes and the City Code, the Planning Commission held a public
hearing, at which time all persons desiring to be heard concerning this application were given the
opportunity to speak thereon; .-nd
WHEltEAS, on September 19, 2016, the Planning Commission recommended
approval of the varianc::.; and
WHEREAS, on September 26, 2106, the City Council reviewed the application and
the recommendations of the Planning Commission and City staff; and
NOW, THEREFORE, BE IT RESOLVED that the City Council of Orono, Minnesota
hereby approves the requested variance as described above based on one or more of the
following findings of fact concerning the Property:

FINDINGS OF FACT:
1 This application was reviewed as Zoning File #16-3851. The analysis contained within staff
memos and the exhibits attached to the aforesaid memos, all minutes from the above
mentioned meetings, and any and all other materials distributed at these meetings are
hereby incorporated by reference.
2. The Property is located in the LR-1 C Zo'ning Di&tnct.
3. The Property contains 0.48 acres in area and has a defined lot width of 140 feet.
4. The Property is within Tier 2 and hardcov,r is limited to 30% according to the Stormwater
Quality Overlay District.
5. Applicant has applied for the following variance:
a. Installation of a HalfBath (plumbing) within a nonconforming OAS.
6. In considering this application for a variance, the Council has considered the advice and
recommendation of the Planning Commlse10n and the effect of the proposed variance
upon the health; safety and welfare of the ~munity, e>dsting and anticipated traffic
conditions, light and air,. danger of tire, risk to the put)Hc safety, and the effect on values
of property in the surrouriding area. ·
ANALY§IS:
1. '.'Variances shall only be permitted when they are in harmony with the general purposes
and intent of the ordinance .... ". The garage is residential in nature. The proposed Half
Bath within the second story addition of the nonconforming OAS will not adversely
impact adjacent properties and will not be apparent from the exterior. The variances are
in harmony with the Ordinance. The variance is in harmony with the Ordinance.
2. "Variances shall only be permitted . . . when the variances are consistent with the
comprehensive plan." The variance resulting in a permit for plumbing improvements within
a residential garage in a residential zone is consistent with the Comprehensive Plan.
3. "Variances may be granted when the applicant for the variance establishes that there are
practical difficulties in complying with the zoning ordinance. 'Practical difficulties,' as used in
connection with the granting of a variance, means that:
a. The property owner in question proposes to use the property in a reasonable manner,
however, the proposed use is not permitted by the official controls.

The request to permit installation of plumbing within the detached garage appears
to be reasonable as the adjacent properties do not appear to be adversely
impacted.
b. The plight of the landowner is due to circumstanceB unique to his property not created
by the landowner.
The size of the garage, and the size and orientation on the Property were not the
result of actions by the landowner. Plu~bing is permitted within residential
garages.
c. The variance, if granted, will not .altt!¥" the essential character of the locality. 11
The proposed plumbing within the garage will not alter the character of the
neighborhood.
4. "Economic considerations alone do not consti141e practical difficulties." The Applicants have
not requested approval based on economic considerations.
5. "Practical difficulties also include but are not limited to. inadequate access to direct sunlight
for solar energy systems. Variances shalt be grantecf fQr earth-sheltered construction as
defined in Minn .. stat.§ 216C.06, subd. 2, when in.harmony-with Orono City Code Chapter
78." This criterion is not applicable.
6. ''The board or the council may not perm'lt u a variance any use that is not permitted under
Orono City Code ·Chapter 7'8 _for property ln the zone where the affected person•s land is
located.11 The proposed improvements are residential in nature and are consistent with the
resi~ential zoriing and the Comprehensive Plan.
7. "The board or council.may permit as a variance the temporary use of a one-family dwelling
as a two-family dwelling." This criterion is not applicable.
8. ''The speaal conditions applying to the structure or land in question are peculiar to such
property or immediately adjQining property." The Property is a corner lot with a defined front
yard on Shoreline Drive with the functional front facing Carman Street. The garage,
constructed in 1975, is in a nonconforming location on the Property. The proposed
plumbing improvements will not increase the nonconformity.
9. "The conditions do not apply generally to other land or structures in the district in which the
land is located." The nonconforming location of the garage and the corner lot status make
the Property unique in the neighborhood.

1 O. ''The granting of the application is necessary for the preservation and enjoyment of a
substantial property right of the applicant." Staff finds this criterion to be met.
11. "The granting of the proposed variance will not in any way impair health, safety, comfort or
morals, or in any other respect be contrary to the intent of this chapter." Granting the
requested variances will not adversely impact health, safety, comfort, or morals; nor will it
be contrary to the intent of the Code. ·
12. "The granting of such variance will not merely serve• a convenience to the applicant, but
is necessary to alleviate demonstrable difficulty.• The location and size of the garage create
practical difficulties affecting the Property; the variance is necessary and not merely serve
as a convenience to the Applicants. ·
CONCLUSIONS. ORDgA AND CONDITIONS:
Based upon one or more of the above findin"s; the Orono City CouncU hereby grants a
variance from Orono Municipal Zonmg Code Section· 78--1437 to allow the installation of a Half
Bath within the nonconforming OAS on thtt Property, subject to the following conditions:
1. Council approval is based on the bu~ding plains submittec;i by the Applicants and annotated
by City staff, attached to this Resolution as Exhibit A, hereinafter the "Plans". Any
amendments tothe Pfaim which are not in conformity with City codes may require further
Planning Commission and City Councd rev!~.
2. Authorities granted by this reeotution run wtth the Property not with the Applicants, but are
permi.-sive only and muet be ex•rcised by obtaining a building permit for the new
con$ti'uctlon and com~ncing construction of said project. A framing inspection must be
completed within one year of the date of Council approval, or the variance will expire on
that date (SeptemblH' 26, 2017).
3. By signing this Resolution, the Applicants agree and covenant in writing that the accessory
building will not be: ·
a. Used for a home occupation unless specifically approved by the city or if allowed
by this Code.
b. Used as a dwelrtng unless a guest house conditional use permit is obtained.
c. Rented, leased or otherwise provided for use as a dwelling under any
circumstances.

4. Violation of or non-compliance with any of the terms and conditions of this resolution shall
constitute a violation of the zoning code, shall automatically terminate any authority
granted herein, and shall be punishable as a misdemeanor.
5. The undersigned Applicants have read, understand and hereby agree to the terms of this
resolution and on behalf of the Applicants and the Applicants' heirs, successors and
assigns, hereby agree to the recording of this resolution 1n the chain of title of the Property.

Monday, September 19, 2016
6:30 o'clock p.m.
The Orono Planning Commission met on the above-mentioned date with the following members present:
Chair John Thiesse, Commissioners Bruce Lemke, Denise Leskinen, Chad Olson, Loren Schoenzeit and
Jon Schwingler. Representing Staff were Community Development Director Jeremy Barnhart, Senior
Planner Michael Gaffron, City Planner Melanie Curtis, and Recorder Jackie Young. Council Member
Lizz Levang was present. Mayor McMillan arrived at 6:55 p.m.
Chair Thiesse called the meeting to order at 6:30 p.m., followed by the Pledge of Allegiance.
Chair Thiesse noted Item No. 4 has been removed from tonight's agenda at the request of the applicants.
NEW BUSINESS
1. APPROVAL OF PLANNING COMMISSION MEETING MINUTES OF AUGUST 15,
2016
Leskinen moved, Olson seconded, to approve the minutes of the Orono Planning Commission
meeting of August 15, 2016, as submitted. VOTE: Ayes 6, Nays 0.
2. #16-3851 PETER BLUTH, 2413 CARMAN STREET, VARIAN CE, 6:32 P.M. -6:35 P.M.
Peter Bluth, Applicant, was present.
Curtis stated the City Council recently approved variances allowing a second story addition over the
existing detached garage, which is a nonconforming oversized accessory structure. There were a number
of plan revisions between the initial submission and fmal plans for approval. In the revision process, the
bathroom fixtures originally proposed in the detached garage upstairs were inadvertently removed from
the plans. Staff also missed this omission. The applicants do wish to install a half bath in the upper level
of the detached garage.
An oversized accessory structure must meet a minimum of a 30-foot setback from all property lines.
Plumbing may be installed within a conforming accessory building via an administrative plumbing
permit, but because the required 30-foot setbacks are not met, a variance is necessary to permit plumbing
within the structure.
Staff finds that the nonconforming location of the oversized garage constitutes a practical difficulty with
respect to making any typical residential improvements such as plumbing.
The Planning Commission may wish to discuss the practical difficulty analysis contained in Staffs report.
Staff recommends approval of the variance as requested. Staff would also suggest the applicant apply a
recorded covenant which states that the accessory building will not be:
1 Used for a home occupation unless specifically approved by the City or if allowed by this Code.
2. Used as a dwelling unless a guest house conditional use permit is obtained.

Thiesse asked whether the City has a standard form relating to the covenant.
Curtis indicated standard language would be included in the language of the resolution.
Peter Bluth, Applicant, stated they removed the bathroom due to cost and then put it back in. Bluth stated
they would like to improve the functionality of the garage.
Thiesse asked if the size of the room is the same.
Curtis stated the room size is consistent with what was originally shown but the bathroom fixtures had
been removed.
Thiesse commented it appears the room is large enough for a bathtub. Thiesse asked if the applicant
plans to come back later to request a bathtub.
Bluth stated that is just the way the room fits in the building and that he has no intention of putting in a
bathtub.
Chair Thiesse opened the public hearing at 6:35 p.m.
There were no public comments regarding this application.

Schwingler moved, Schoenzeit seconded, to recommend approval of Application No. 16-3851,

Robert Gumnit, Applicant, was present.
Curtis stated the owners of the property would like to modify the existing two-story tack building to
include a full bathroom so that it can serve as a caretaker's quarters. According to the code, it would be
considered a guest house. The property consists of over nine acres in area, so therefore a guest house is
permitted via a guest house conditional use permit.
The lot is considered a lakeshore property. Therefore the location of the tack building between the home
and the street is conforming. The guest house would be within the 999 square foot building footprint and
the required setbacks are also conforming.

The Council, on August 22 nd , approved variances allowing an upward expansion of the existing
non-conforming oversized accessory structure (OAS). There were a number of plan revisions
between initial submittal and final plans for approval. In the revision process the bathroom
fixtures were inadvertently removed from the plans; staff also missed this omission. The
applicants wish to install a half bath in the upper level of the detached garage. Because the
existing OAS is nonconforming with respect to setbacks a variance from Section 78-1437 is
required.
Applicable Regulations:
Plumbing in a Nonconforming Accessory Structure Variance (Code Section 78-1437)
An OAS must meet a minimum of a 30 foot setback from all property lines. Because the
required 30-foot setbacks are not met, a variance is necessary to permit plumbing within the
OAS.
Governing Regulation: Variance (Section 78-123)
In reviewing applications for variance, the Planning Commission shall consider the effect of the
proposed variance upon the health, safety and welfare of the community, existing and

anticipated traffic conditions, light and air, danger of fire, risk to the public safety, and the effect
on values of property in the surrounding area. The Planning Commission shall consider
recommending approval for variances from the literal provisions of the Zoning Code in instances
where their strict enforcement would cause practical difficulties because of circumstances unique
to the individual property under consideration, and shall recommend approval only when it is
demonstrated that such actions will be in keeping with the spirit and intent of the Orono Zoning
Code. Economic considerations alone do not constitute practical difficulties. Practical difficulties
also include but are not limited to inadequate access to direct sunlight for solar energy systems.
Variances shall be granted for earth-sheltered construction as defined in Minn. Stat. § 216C.06,
subd. 2, when in harmony with this chapter. The board or the council may not permit as a
variance any use that is not permitted under this chapter for property in the zone where the
affected person's land is located. The board or council may permit as a variance the temporary
use of a one-family dwelling as a two-family dwelling.
According to MN §462.537 Subd. 6(2) variances shall only be permitted when:
1. The variance is in harmony with the general intent and purpose of the Ordinance. The
garage is residential in nature. The proposed half bath within the second story
addition of the nonconforming OAS will not adversely impact adjacent properties and
will not be apparent from the exterior. The variances are in harmony with the
Ordinance.
2. The variance is consistent with the comprehensive plan. The variances resulting in a
permit for plumbing improvements within a residential garage in a residential zone is
consistent with the Comprehensive Plan.
3. The applicant establishes that there are practical difficulties.
a. The property owner proposes to use the property in a reasonable manner not
permitted by the official controls; The request to permit installation of
plumbing within the detached garage appears to be reasonable as the
adjacent properties do not appear to be adversely impacted.
b. There are circumstances unique to the property not created by the landowner;
The size of the garage, and the size and orientation property were not the
result of actions by the landowner. Plumbing is permitted within residential
garages; and
c. The variance will not alter the essential character of the locality.
The proposed plumbing within the garage will not alter the character of the
neighborhood.
Additionally City Code 78-123 provides additional parameters within which a variance may be
granted as follows:
4. The special conditions applying to the structure or land in question are peculiar to such
property or immediately adjoining property. The applicant's home is a corner lot with
a defined front yard on Shoreline Drive with the functional front facing Carman
Street. The garage, constructed in 1975, is in a nonconforming location on the
property. The proposed plumbing improvements will not increase the nonconformity.
5. The conditions do not apply generally to other land or structures in the district in which
the land is located. The nonconforming location of the garage and the corner lot
status make this property unique in the neighborhood.
6. The granting of the application is necessary for the preservation and enjoyment of a
substantial property right of the applicant. Staff finds this criterion to be met.

7. The granting of the proposed variance will not in any way impair health, safety, comfort
or morals, or in any other respect be contrary to the intent of this chapter. Granting
the requested variances will not adversely impact health, safety, comfort, or morals;
nor will it be contrary to the intent of the Code.
8. The granting of such variance will not merely serve as a convenience to the applicant,
but is necessary to alleviate demonstrable difficulty. The location and size of the
garage create practical difficulties affecting the Property; the variance is necessary
and does not merely serve as a convenience to the Owner.
The Commission may recommend or Council may impose conditions in granting of variances.
Any conditions imposed must be directly related to and must bear a rough proportionality to the
impact created by the variance. No variance shall be granted or changed beyond the use
permitted in this chapter in the district where such land is located.

Practical Difficulties Statement
Applicant should be asked for testimony regarding the practical difficulties.
Practical Difficulties Analysis
Staff finds that the nonconforming location of the OAS (garage) constitutes a practical difficulty

Sec. 78-1437. -Plumbing.
Because the provision of plumbing fixtures and wastewater plumbing in accessory buildings has the
potential to allow such buildings to be used as dwelling units, and because it is the policy of the city to limit
residential development density to the allowed densities within the respective zoning districts, plumbing in
accessory buildings shall be regulated as follows:
(1) The provision of outside sillcocks and indoor water supply shall be allowed in any accessory
building that is conforming in location, size and height.
(2) Installation of any combination of fixtures requiring wastewater plumbing that does not include a
shower or bathtub shall be allowed in any accessory building that is conforming in location, size
and height with, subject to provision of municipal sanitary sewer or a conforming sewage
treatment system designed to handle the anticipated flows from such fixtures, and subject to the
property owner's executing a covenant providing that the accessory building will not be:
a. Used for a home occupation unless specifically approved by the city or if allowed by this
Code.
b. Used as a dwelling unless a guest house conditional use permit is obtained.
c. Rented, leased or otherwise provided for use as a dwelling under any circumstances.
(3) Installation of any combination of fixtures requiring wastewater plumbing that includes a shower
or bathtub shall be allowed only in an accessory building that is conforming in location, size and
height and which meets one of the following criteria:
a. The accessory building has been approved for a guest house conditional use permit; or
b. The accessory building has been approved for a bathtub or shower in accessory building
conditional use permit.

Peter Bluth, Applicant, was present.
Curtis stated the City Council recently approved v ariances allowing a second story addition over the
existing detached garage, which is a nonconforming oversized accessory structure. There were a number
of plan revisions between the initial submission and final plans for approv al. In the revision process, the
bathroom fixtures originally proposed in the detached garage upstairs were inadvertently removed from
the plans . Staff also missed this omission. The applicants do wish to install a half bath in the upper level
of the detached garage .
An oversized accessory structure must meet a minimum of a 30-foot setback from all property lines.
Plumbing may be installed within a conforming accessory building via an administrative plumbing
permit, but because the required 30-foot setbacks are not met, a variance is necessary to permit plumbing
within the structure .
Staff finds that the nonconforming location of the oversized garage constitut es a practical difficulty with
respect to making any typical residential improvements such as plumbing.
The Planning Commission may wish to discuss the practical difficulty analysis contained in Staff's report.
Staff recommends approv al of the variance as requested. Staff would also suggest the applicant apply a
recorded covenant which states that the accessory building will not be:
1 Used for a home occupation unless specifically approved by the City or if allowed by this Code,
2, Used as a dw elling unless a guest house conditional use permit is obtained.

Thiesse asked whether the City has a standard form relating to the covenant.
Curtis indicated standard language would be included in the language of the resolution.
Peter Bluth, Applicant, stated they removed the bathroom due to cost and then put it back in. Bluth stated
they would like to improve the functionality of the garage.
Thiesse asked if the size of the room is the same.
Curtis stated the room size is consistent with what was originally shown but the bathroom fixtures had
been removed.
Thiesse commented it appears the room is large enough for a bathtub. Thiesse asked if the applicant
plans to come back later to request a bathtub.
Bluth stated that is just the way the room fits in the building and that he has no intention of putting in a
bathtub.
Chair Thiesse opened the public hearing at 6:35 p.m.
There were no public comments regarding this application.

Staff recommends approval. A draft approval resolution has been provided for Council's consideration which
incorporates the OAS covenants.

Peter Bluth, Applicant, was present.
Curtis stated the applicant is requesting side and rear setback variances in order to add a second story to
the existing non-conforming garage to allow for storage and living space. The garage exceeds 1,000
square feet and is therefore defined as an oversized accessory structure requiring additional setbacks.
The applicant also proposes to construct an addition to the home over an existing grade-level deck where
a screen porch currently exists which would result in a separation of approximately nine feet from the
garage where a 10-foot separation setback is required.
The property is a comer lot and by definition Shoreline Drive is defined as the front. The south lot line is
the rear, which requires a 30-foot setback from the existing garage. The side setback variance is
requested to allow expansion of the second story over the garage 28.4 feet from the side lot line where a
30-foot setback is required. In addition, a variance is requested to allow expansion 11.9 feet from the rear
lot line where a 30-foot setback is required.
The 10-foot code required separation between buildings is for the purpose ofreducing massing and bulk
on properties. The existing screen porch structure is ten feet from the nearest garage comer. However,
the applicants are proposing to construct the addition in line with the west line of the home, which would
result in a 9-foot setback.
Staff finds that the nonconforming location of the garage constitutes a practical difficulty with respect to
making any improvements or changing the footprint. The proximity of the house to the garage further
limits options. The encroachment of a comer of the garage by one foot into the separation distance is
minimal and does not appear to be impactful as a full wall encroachment from a crowing standpoint.
Planning Staff recommends approval of the variances as requested. Staff would recommend the applicant
be requested to enter into the standard Oversized Accessory Structure covenant.
The Planning Commission had no questions for Staff.
Peter Bluth, Applicant, stated he can answer any questions the Planning Commission may have.
Thiesse asked if the applicant understands that the oversized accessory structure cannot have a bathroom
and that he will be asked to sign an agreement to that effect.
Bluth indicated that is correct.
Schoenzeit asked if the current garage has footings.
Bluth indicated it is slab on grade.

Thiesse stated he cannot attach it to the house but he can go up. Thiesse asked if the screened-in porch is
on posts.
Bluth indicated it is and that it is a deck with a screened-in sunroom.
Thiesse asked how the front line is defined.
Curtis indicated it would be the narrower of the two street frontages.
Thiesse noted there is no way he would ever be able to construct a driveway in that area. Thiesse asked if
anything would change if it was defined otherwise.
Curtis stated with respect to the requests he is making today, he would still need to meet the 30-foot
setbacks.
Chair Thiesse opened the public hearing at 7:23 p.m.

Thiesse noted for discussion purposes that the porch is a clean slate and that it should be in conformance

The property is a corner lot and by definition Shoreline Drive is considered the "front" yard for setback purposes, making
the south lot line the rear. The side setback variance is requested to allow expansion of the second story over the garage
28.4' from the side lot line where a 30-foot setback is required; a rear setback variance is requested to allow expansion
11.9' from the rear lot line where a 30-foot setback is required.
The code requires a 10-foot separation between buildings to reduce the appearance of massing. The existing screen
porch structure is 10 feet from the nearest garage corner, however the property owner proposes to construct the
addition in line with the foundation of the west side of the house to the extent of the existing deck. This results in a one
foot encroachment into the 10 separation requirement from corner to corner.
Staff finds that the nonconforming location of the garage constitutes a practical difficulty with respect to making any
improvements or changing the footprint. The proximity of the house to the garage further limits options. The
encroachment of a corner of the garage by one foot into the separation distance is minimal and does not appear to be
impactful from a crowding standpoint.
The Planning~n recommends approval of the variances as requested. Staff would also suggest the applicant be
requested to enter into the OAS covenant.

The property is a corner lot. By definition, as the short side, Shoreline Drive is considered the
"front" yard for setback purposes; the south lot line is the rear. The garage exceeds 1,000
square feet and is therefore defined as an oversized accessory structure (OAS) requiring
additional setbacks. The property owner would like to construct a second story over the OAS,
an upward expansion, to allow for storage and living space on the second level. Because the OAS
does not meet the required 30-foot setbacks from all property lines, variances are required.
A side setback variance is requested to allow expansion of the second story 28.4' from the side
lot line where a 30-foot setback is required; additionally a variance is requested to allow
expansion 11.9' from the rear lot line where a 30-foot setback is required.
Building to Building Separation Variance (Code Section 78-1438)
The code requires a 10-foot separation between buildings to reduce the appearance of massing.
The existing screen porch structure is 10 feet from the nearest garage corner, however the
property owner proposes to construct the addition in line with the foundation of the west side
of the house to the extent of the existing deck. This results in a one foot encroachment into the
10 separation requirement from corner to corner.
Governing Regulation: Variance (Section 78-123)
In reviewing applications for variance, the Planning Commission shall consider the effect of the
proposed variance upon the health, safety and welfare of the community, existing and
anticipated traffic conditions, light and air, danger of fire, risk to the public safety, and the effect
on values of property in the surrounding area. The Planning Commission shall consider
recommending approval for variances from the literal provisions of the Zoning Code in instances
where their strict enforcement would cause practical difficulties because of circumstances unique
to the individual property under consideration, and shall recommend approval only when it is
demonstrated that such actions will be in keeping with the spirit and intent of the Orono Zoning
Code. Economic considerations alone do not constitute practical difficulties. Practical difficulties
also include but are not limited to inadequate access to direct sunlight for solar energy systems.
Variances shall be granted for earth-sheltered construction as defined in Minn. Stat. § 216C.06,
subd. 2, when in harmony with this chapter. The board or the council may not permit as a
variance any use that is not permitted under this chapter for property in the zone where the
affected person's land is located. The board or council may permit as a variance the temporary
use of a one-family dwelling as a two-family dwelling.
According to MN §462.537 Subd. 6(2) variances shall only be permitted when:
1. The variance is in harmony with the general intent and purpose of the Ordinance. The
proposed addition and second story on the garage are residential in nature. There is
adequate space for light air and open space between the proposed addition and
garage; the proposed second story addition will not further encroach into the rear or
side setbacks. The variances are in harmony with the Ordinance.
2. The variance is consistent with the comprehensive plan. The variances resulting in a
permit for construction of improvements to a single family residence and residential
garage in a residential zone are consistent with the Comprehensive Plan.
3. The applicant establishes that there are practical difficulties.

a. The property owner proposes to use the property in a reasonable manner not
permitted by the official controls; The request to permit construction of
additions to the existing garage, an oversized accessory structure, within the 30
foot side and rear setback areas appears to be reasonable as the adjacent
properties do not appear to be adversely impacted; the mature vegetation and
topography separate the Property from the adjacent neighbors. The proposed
setback between the house and the garage at 9 feet is a corner-to-corner
measurement. The encroachment will not create an unreasonable perception
of additional massing.
b. There are circumstances unique to the property not created by the landowner;
The size of the garage, and the size and orientation property were not the result
of actions by the landowner. The neighboring home is set back sufficiently to
allow for light, air, and open space between the garage and the home; and
c. The variance will not alter the essential character of the locality.
The proposed additions to the garage and home will not alter the character of
the neighborhood. The existing home plus detached garage to be expanded are
set back sufficiently from Carman Street and it does not appear that a second
story addition on the existing garage will adversely impact the neighbor to the
south who has provided supportive comments. The structures on adjacent lots
are set back 62 feet for the home and 27 feet for the detached garage to the
north; and the home to the south is over 84 feet from the property line.
Additionally City Code 78-123 provides additional parameters within which a variance may be
granted as follows:
4. The special conditions applying to the structure or land in question are peculiar to such
property or immediately adjoining property. The applicant's home is a corner lot with a
defined front yard on Shoreline Drive with the functional front facing Carman Street.
The garage, constructed in 1975, is in a nonconforming location on the property. The
proposed improvements to the garage will not increase the nonconformity.
5. The conditions do not apply generally to other land or structures in the district in which
the land is located. The nonconforming location of the garage and the corner lot status
make this property unique in the neighborhood.
6. The granting of the application is necessary for the preservation and enjoyment of a
substantial property right of the applicant. Staff finds this criterion to be met.
7. The granting of the proposed variance will not in any way impair health, safety, comfort
or morals, or in any other respect be contrary to the intent of this chapter. Granting the
requested variances will not adversely impact health, safety, comfort, or morals; nor
will it be contrary to the intent of the Code.
8. The granting of such variance will not merely serve as a convenience to the applicant,
but is necessary to alleviate demonstrable difficulty. The location and size of the garage
as well as the garage's proximity to the home create practical difficulties affecting the
Property; the variances are necessary and not merely serve as a convenience to the
Owner.
The Commission may recommend or Council may impose conditions in granting of variances.
Any conditions imposed must be directly related to and must bear a rough proportionality to the
impact created by the variance. No variance shall be granted or changed beyond the use
permitted in this chapter in the district where such land is located.

impacts created by the granting of the requested variance(s)?

Planning Staff Recommendation
The Planning Commission recommends approval of the variances as requested. Staff would also
suggest the applicant be requested to enter into the OAS covenant which states:
1. No future subdivision will be approved that places the structure within a lot that has no
principal structure, except that the city in its subdivision approval may grant a finite time
period in which the oversized accessory structure may remain without a principal
structure, in order that a principal structure may be constructed. At the end of this time
period, the oversized accessory structure must be removed if no principal structure has
been constructed.
2. If the property is subdivided, the oversize accessory structure and principal structure will
be located together within a lot that meets the minimum lot area requirement for the
given size of accessory building.
3. In subdivision approval, the setback required for the oversize accessory structure shall
remain.
Such covenant shall be binding on current and future property owners and shall be filed in the
chain of title of the property.

PRACTICAL DIFFICULTIES DOCUMENTATION FORM
This form is a required submittal for ALL variance applications. An application will not be considered
complete or placed on any meeting agendas until this form is complete and submitted to the City.
Minnesota State Statutes Section 462.357, Subdivision 6(2) requires that practical difficulties be demonstrated in
order for a variance to be granted . The difficulties must be unique to the property as variances run with the land
and not the land owner. Personal and economic situations are not considered valid practical difficulties. In order
for an application to be heard by the Planning Commission and City Council practical difficulties having merit must
be demonstrated .
HOW DO I PROVE A PRACTICAL DIFFICULTY?
This form has 12 points outlining the basis City staff uses to determine if practical difficulties exist and how the
variance will affect the surrounding community. To prove practical difficulties, address all the relevant points listed
below and answer them as clearly as possible.

To whom it may concern,
I'm writing in reaction to Pete and Nell Bluth's application for a variance for their home renovation and
addition. I have reviewed the plans with them and we talked over what it will look like and the build
schedule, and I feel it won't impact me or my property at all. I think the design fits in nicely with the rest
of the neighborhood, and they have been conscious to keep with what design will work best for their
property while enhancing the curb appeal.
In short, I support the approval of the variance.

not grant permission for additional or related work which requires separate

2. Owners request the City to review said plans which requires City approval and may require
consulting legal and/or engineering review.
3. The City is willing to commence its review of the application and incur costs associated with said
review only if the Owners establish an escrow to ensure reimbursement to the City of its costs.
NOW THEREFORE, THE PARTIES AGREE AS FOLLOWS:
1. DEPOSIT OF ESCROW FUND~ Contemporaneously with the execution of this Escrow
Agreement; the Owners shall deposit $ czS:M. with the City. All accruea interest, lf any, shall be paid to the
City to reimburse the City for its cost in administering the escrow account.
2. PURPOSE OF ESCROW. The purpose of the escrow is to guarantee reimbursement to the City
for all out-of-pocket costs the City has incurred (including planning, engineering, or legal consultant review) or will
incur in meeting with the Owners, reviewing the plans, and preparing agenda packet material for City Council review
of application # / G:, -B f'5 / . Eligible expenses shall be consistent with expenses the Owners would
be responsible for under a land use application.
3. MONTHLY BILLING. As the City receives consultant bills for incurred costs, the City will in turn
send a bill to the Owners. Owners shall be responsible for payment to the City within 30 days of the Owners' receipt
of bill.
4. DISBURSEMENT FROM ESCROW ACCOUNT. In the event that the Owners do not make
payment to the City within the timeframe outlined in #3 above, shall cease all reviews until the Owners pay all
expenses invoiced pursuant to #3. The City may draw from the escrow account without further approval of the
Owners to reimburse the City for eligible expenses the City has incurred.
5. CLOSING ESCROW. The Balance on deposit in the escrow, if any, shall be returned to the Owners
when all requirements related to the project are complete. City Staff shall review the terms of this escrow agreement
two times per year to determine whether the requirements of the project have been successfully completed and
whether it is appropriate to return the funds. Owner may also request the release of the funds, and such funds shall
be released upon City Staff receiving the appropriate verification that all requirements of the project have been
successfully completed.
6. CERTIFY UNPAID CHARGES. If the project is abandoned by Owners, or if the eligible expenses
incurred by the City exceed the amount in escrow, the City shall have the right to certify the unpaid balance to the
subject property pursuant to Minn. Stat. §§ 415.01 and 366.012.
