The applicant is requesting a setback variance to allow
construction of a family room approximately 37.5' fror a lot line
where a 50' setback is normally required. This is a unique lot
located in the Crystal Bay area. The lot is surrounded on 3
sides by roads, and is approximately 0.4 acres in area. The
house has existed on the property for many decades and does not
meet any of the curr,nt setback requirements, nor do most of the
houses in Crystal Bay. The proposed addition does not cause an
encroachment that is inconsistent with the neighborhood, and the
location of the adliFion is the locati(n requiring the least
extensive varia^.--es.
This property wi 11 :)e served by municipal sewer when the
Crystai Bay project 13 complete. The proposed addition will
have no effect on thy: existing septic system or the sewer
connection.
Staff recommends approval of the variance as proposed.

Zoning Administrator Mabusth noted that the survey has been
received from applicant. She noted the drainage plan and
reviewed staff's recommended conditions.
Everand Geyen was present for this matter and stated he had no
objections to the conditions.
There were no persons present objecting and the public
hearing was closed.
Kelley felt that in order to maintain a desired building
envelope, no additional variances should be granted.
It was moved by Sime, seconded by McDonald, to recommend
approval of the lot area variance subject to staff 's
conditions and subject to the condition that no additional
variances be granted in the future. Motion, Ayes 5, Nays 0.

WHEREAS, Philip F. Kaiey (hereinafter "the applicant")
is the owner of the property located at 135' Brown Road South
within the City of Orono (hereinafter "City") and legally des-
cribed as follows:
Lot 5, Block 1, Markville, Hennepin County, Minnesota,
(hereinafter "property"); and
WHEREAS, the applicant has applied to the City for a
variance to Municipal Zoning Code Section 10.28, Subdivision 5
(B) to permit the construction of a 12'x22' room addition located
37.5 feat from a rear property line where a 50 foot rear yard
setback is normally reyuir�?d.
NOW, THEREFORE, BE IT RESOLVED by the City Council of
Orono, Minnesota:
FINDINGS
1. This application was reviewed as 'oning F_le #981.
2. The property is located in the RR-lB Single Family Rural
Residential Zoning District.
3. The Orono Planning Commissiun reviewed this application
on October 21, 1985, and recommended approval of the pro-
posed variance based upon the following findings:
A) The property is appoximately 0.4 acres in area in a
2-acre zoning district.
1.1) The property is unique in that it is surrounded on
3 sides by right-of-way.
C) The existing house does not meet front or rear
setbacks of the RR-1B zoning district.
D) The proposed addition is located such that the
setback variance required is relatively minor.

E) The property will be sewered as part of the Crystal
Bay Sewer Project and the addition will not have an
effect on the septic system or sewer connection.
4. The City Council has considered this application
including the findings and recommendations of the Planning
Commission, reports by City staff, comments by the applicant
and the effect of the proposed variance on the health,
safety and welfare of the comminity.
5. The City Council finds that the conditions existing on
this property are peculiar to it and do not apply generally
to other property in this zoning district; that granting the
variance would not adversely affect :traffic condit-ons,
light, air nor pose a fire hazard or other danger to
neighboring property; would not merely serve as a
convenience to the applicant, but is necessary to alleviate
a demonstrable hardship or difficulty; is necessary to pre-
serve a substantial property right of the applicant; and
would be in keeping with the spirit and intent of the Zoning
Code and Comprehensive Plan of the City.
CONCLUSIONS, ORDER AND CONDITIONS
Based upon the above findings, the Orono City Council
hereby grants a variancr� to the Municipal Zoning Code Section
10.28, Subdivision 5 (B) to permit the construction of a 12'x22'
room addition located 37.5 feet from a rear property line where a
50 foot rear yard setback is normally required, subject to the
following conditions;
1. Authorities granted by this variance run with the
property not with the applicant, but are permissive only and
;nust b, exercised by application for a building permit
within one year of the date of Council approval, or this
variance will expire on that. date (October 28, 1986).
2. Violation of or non-compliance with any of the terms and
conditions of this variance shall constitute a violation of
the zoning code, shall automatically terminate any authority
granted herein, and shall be punishable as a misdemeanor.
3. The undersigned applicant has read, understood and here-
by agrees to the terms of this resolution and on behalf of
himself, hit- heirs, successors and assigns, hereby agrees to
the record: r i of this resoi ut ion in the chain of title of
the property.

Phil Kaley was present for this matter.
City Administrator Bernhardson explained the request for a
setback variance for a family room addition.
Mr. Kaley stated he had no problems with the proposed
resolution.
It was moved by Councilmember Frahm, seconded by
Councilmember fiammerel, to adopt Resolution #1980 approving
the variance. Motion, Ayes 4, Nays 0.

George and Susan Rovegno were present for this matter.
City Administrator Bernhardson explained the request for an
after -the -fact variance for construction of a 5 foot fence
within the 0-75' whereas ,based on interpretation) only a 3-
1/2 foot fence is allowed.
George Rovegno noted the serious problems he has had which
placement of this fence has solved. He submitted a memorandum
containing a series o'_ facts pertaining to the issues for
Council to review. Mr. Rovegno stated he is willing to do
one of the following to solve this matter: 1) leave the fence
at its existing location and cut it down to 44" except for the
first 30 feet by the public access which must be only 30" in
height, or; 2) move the fence hack to the lathe mark and keep
it at its existing 5 foot height except for the first 30 feet
by the public access which must be only 30" in ',eight. He
noted that he believes Code Section 10.03 15(k could only
have been written al-Dut intersecting street lots. He also
indicated his frustr,ition with the City in dealing with the
problems he has encountered which forced him to erect: the
fence.
Mayor Butler stated that the fence poses a safety hazard.
Councilmember Frahm indicated that applicant's problems
were valid and felt the City should address the problem of
trespassing and litter. He also stated he was agreeable to a
3-1/2 foot high fence in its present location.
Mayor Butler stated it would be setting a r_recedent by
allowing this fence.
City Administrator Bernhardson noted that applicant needs a
